Did you know that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords now have to make sure their Wilton rental properties meet the minimum Healthy Homes Standards within 90 days of a renewed or new tenancy and all private rentals are required to be fully conforming by the 1st July 2024.

Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Wilton rental property, all Healthy Homes compliance work need to be done by the end of 90 days.

Since the 1st July of 2021, if a new, renewed or varied lease is entered into on a Wilton rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the anticipated timeframe could result in penalties of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy agreement there could be an additional penalty or infringement fee.

The person liable for this fine is whoever is named on the lease agreement as the person who is who is letting the property and it could be the name of the landlord, or the company that manages the property.

All information in the Statement of Compliance requirements to be current before the tenancy agreement can be completed, and must be updated throughout the duration of the tenancy when any associated work has been completed.

It is crucial to keep in mind that landlords who manage multiple rental properties may receive more severe penalties for not complying. The highest penalties are given for severe breaches, and landlords with more than six properties could be fined up to $50,000, and as much as $100,000 for hearing claims.

Wilton Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is required in all Wilton and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records that prove conformance with the Healthy Homes Standards that apply or will be applicable to the rental property.

Starting 1 July 2021

  • Property managers and private landlords have to ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must adhere to the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All households let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.
