Fines for Failing to Comply
From the 1st of July in 2021, when a new, renewed or varied contract is signed on a Wilton rental property, all Healthy Homes compliance tasks must be finished inside of 90 days.
As of 1st July 2021, once a new or renewed Tenancy is signed for the Wilton rental property, all Healthy Homes compliance work must be done by the end of 90 days.
Inability to adhere to one of the Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not included within the new, renewed or revised tenancy agreement it could result in additional penalties or an infringement fee.
Every tenant is entitled to request information regarding the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager is unable to supply the information requested within 21 days of getting the notice, the tenant will receive an infringement notification and be fined upto $750.
In addition, there is an additional fine of as much as $900 for property owners or property managers who have provided a false or false Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the person who is listed on the tenancy agreement as being the person leasing the property out, so it could be the name of the landlord, or the company that manages the property.
All the information on the Statement of Compliance needs to be accurate when the tenancy contract is executed, and it should be maintained throughout the duration of the tenancy when any necessary work related to it is finished.
It’s also important to remember that landlords who have several rental properties can face even higher fines for non-compliance. The harshest penalties are handed down for the most serious violations, and landlords who own six or more properties could be fined as high as $50,000, and as much as $100,000 in hearing claims.
