Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed contract is signed on a Wilton rental property, all Healthy Homes compliance tasks must be finished by the end of 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied lease is entered into on the Wilton rental property, all Healthy Homes compliance work must be completed within 90 days.

Inability to adhere to all of the Healthy Homes Standards within the period of time expected can lead to penalties of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t included in the new, renewed or amended tenancy agreement there could be an additional fine or violation fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager is unable to supply the necessary information within 21 days from receiving the request, they will receive an infringement notice and be fined upto $750.

Furthermore, there’s an additional fine of approximately $900 for property owners or property managers that provide false or false Healthy Homes Statement of Compliance or any other information. The person liable for this fine is whoever is named on the tenancy contract as the person renting the property which could be the name of the landlord as well as the property management company.

The information contained in the Compliance Statement needs to be current when the tenancy contract is completed, and should be kept updated throughout the tenancy as any associated work has been completed.

It is also crucial to remember that landlords with several rental properties can face even higher fines for non-compliance. The most severe penalties are reserved for the most serious breaches, and landlords with at least six rental properties could be fined up to $50,000, and as much as $100,000 for hearing claims.

Wilton Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is a requirement throughout Wilton and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the conformance to the Healthy Homes Standards that apply or will be applied during the tenancy of the rental property.

From 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties comply with the Healthy Homes Standards within 90 days of a new, renewed or varied lease.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Wilton

Draughts are a major cause of dropping temperatures within homes. A humid house costs more to heat, meaning wasting energy and increased bills.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or the sound of a clear draught emanating from a gap or hole and you can feel it, it’s likely to be a gap or hole which requirements sealing in the way you can. Large gaps and cracks should be sealed permanently. The gaps that exceed 3mm that allow air to enter or exit into your home require seals. For example, if the open fireplace isn’t used it may cause draughts and should be sealed off. Landlords and property managers are accountable for making sure that such draughts are squelched whenever possible.

There is no require to cover up holes or gaps which are part of the building. For instance, small gaps around windows and doors could be necessary to allow for movement of the structure when the household warms and cools to allow them to be shut and opened, rather than sticking. Adequate heaters are crucial for healthy homes

Heating Wilton

Rental properties in Wilton need to have a stable source of heat that can warm the main or largest living room to at least 18 degrees Celsius, even on the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

Ventilation Wilton

Insulation Wilton

Underfloor and ceiling insulation is a requirement for all rent houses from 1 July 2019. All landlords and property managers should ensure that the insulation is up to current standard. In some instances, current ceiling insulation, or the insulation of the sub floor space might need to be filled with or replaced.
