Fines for Failing to Comply

It’s important to remember that landlords who have multiple rental properties may face even higher fines for non-compliance. The highest penalties are handed down for serious breaches, and landlords with six or more properties could be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.

Wilton Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is mandatory to all Wilton and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords must keep records that demonstrate the conformance to each Healthy Homes Standards that apply or will be applicable during the tenure of your rental home.

From 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties conform with the Healthy Homes Standards within 90 days of a newly renewed, extended or changed lease.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must adhere to the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.

Wilton rental properties need to have a stable heating source which can warm the principal or the biggest living room to at least 18degC even on the coldest winter days. Insulation for underfloor and ceilings is mandatory for all rent houses since 1 July 2019. All landlords and property managers have to make sure the insulation meets standards that are in line with the latest standard.
