Fines for Failing to Comply

As of 1st July 2021, once a new or renewed contract is signed on a Wilton rental property, all Healthy Homes compliance tasks need to be done by the end of 90 days.

Since the 1st July of 2021, when a brand new or renewed lease is entered into on a Wilton rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to comply with each of Healthy Homes Standards by the end of the deadlines can result in an amount of $7200. Furthermore, if a existing Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy agreement there may be an additional penalty or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager fails to provide the necessary information within 21 days from being informed of the request, they may receive an infringement notice and be fined upto $750.

Additionally, there is an additional fine of as much as $900 for property owners or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or other information. The person responsible to pay this fine is the one who is named on the tenancy agreement as being the person who is letting the property which could be the name of the landlord as well as the company that manages the property.

Tenancies signed beginning on 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement to all Wilton and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records that demonstrate conformance with any Healthy Homes Standard that apply or will apply to the rental property.

From 1 July 2021

  • All rental homes are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Ceiling and underfloor insulation is a requirement on all rental homes from 1 July 2019. Property managers and landlords are required to ensure that the insulation is in line with the new quality.
