Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Wilton rental property, all Healthy Homes compliance items have to be done inside of 90 days.

As of 1st July 2021, if a new or renewed lease is entered into on a Wilton rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Wilton Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is mandatory to all Wilton and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the conformance to each Healthy Homes Standards that apply or will apply during the tenure of the rental property.

Starting 1 July 2021

  • Property managers and private landlords should make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All households rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of the date when the tenancy started.

If the main living room already has a central heating source, such as heat pumps, it could need a top up in order to comply with the standards. Certain kinds of heaters aren’t able to be used to achieve the standard since they’re either costly, not cost-effective to run, and/or unhealthy to run.
