Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed contract is signed on a Wilton rental property, all Healthy Homes compliance tasks need to be taken care of within 90 days.

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on the Wilton rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet all of the Healthy Homes Standards within the period of time expected can lead to an amount of $7200. Additionally, if the most present Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy contract, there could be an additional penalty or infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they are related to the house they are living in. If the property manager is unable to supply the necessary information within 21 days from receiving the request, they could receive an infringement notification and could be fined up to $750.

It is also important to note that landlords with several rental properties can face additional fines for non-compliance. The highest penalties are handed down for severe violations, and landlords who own six or more properties can be fined as high as $50,000, and as much as $100,000 in the case of hearing claims.

Wilton Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is mandatory to all Wilton and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records that demonstrate the compliance with each Healthy Homes Standard that apply or will be applied to their rental properties.

Starting 1 July 2021

  • Property managers and private landlords should make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a renewal, new or a change in lease.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All households which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Draughts are a major cause of low temperatures inside homes. A cold home will cost more to heat, meaning wasting energy and incurring higher costs.

Adequate heaters are important for healthy homes

Heating Wilton

Wilton rental properties require a reliable heating source that can heat the main or largest living space to at least 18degC, even during the most coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat requirements for it to be permanent (i.e. not portable) with at minimum 1.5 kW of heating capacity, and meet the minimum requirement for heat capacity to heat the living space in general. The Heating Assessment Tool can be used to determine whether the fix heater(s) are adequate or whether you will need to top up by adding a second heater. Fires that are open and unflued heaters such as the portable LPG bottle heaters aren’t considered acceptable heating options under the Healthy Homes Standard.

If the heating you provide is electric heating or heat pump, then it must include an thermostat. This will help make the heating more consistent and efficient. For the majority of homes, bigger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in certain instances like small apartments, a smaller fixed electric heater might be enough.

If your living space already has a central heating source such as an air conditioner, it might require an update to make sure it meets the requirements. Certain types of heaters cannot be used to meet the standard as they are either expensive, inefficient or are unsafe to operate.

Insulation for underfloor and ceilings is a requirement in all rental homes since 1 July 2019. Property managers and landlords should ensure that the insulation is in line with standards that are in line with the latest standard. In some instances, current ceiling insulation, or the insulation of the subfloor space may need to be replaced or replaced.
