Did you not know that Healthy Homes Standards came into effect on the 1st of July 2021? Landlords now have to make sure their Wilton rental properties meet the minimum Healthy Homes Standards within 90 days of a renewed or new tenancy and all private rental properties must be fully certified by 1 July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied contract is signed on a Wilton rental property, all Healthy Homes compliance items have to be completed inside of 90 days.

As of 1st July 2021, when a new or renewed Tenancy is signed for a Wilton rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy agreement, there may be an additional fine or infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager does not supply the information requested within 21 days from being informed of the request, they will receive an infringement notification and could be fined up to $750.

In addition, there is also a penalty approximately $900 for property owners or property managers providing a false or misleading Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the one who is listed on the tenancy agreement as the person who is renting the property and it could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance requirements to be up-to-date when the tenancy agreement is completed, and should be kept updated throughout the duration of the tenancy when any associated work has been completed.

It’s crucial to remember that landlords who own multiple rental properties could face more severe penalties for not complying. The highest penalties are given only for serious violations. Those who have six or more properties can be fined up to $50,000, or as high as $100,000 in hearing claims.

Wilton Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is required throughout Wilton and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records of their conformance with the Healthy Homes Standards that apply or will apply during the tenure of an apartment rental.

From July 1st 2021

  • Property managers and private landlords should ensure their rental properties comply with the Healthy Homes Standards within 90 days of a new, renewed , or altered tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All households rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Wilton rental properties require a reliable heating source that can heat the main or largest living area to at minimum 18degC, even during the winter coldest days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

In certain situations, like small apartments small apartments, a smaller electric fixed heater may suffice.

If the living area is already equipped with a fixed heating source, such as an air conditioner, it may need an update in order to comply with the standards. Ventilation Wilton
