Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on a Wallaceville rental property, all Healthy Homes compliance work need to be taken care of by the end of 90 days.

The information contained in the Compliance Statement needs to be current at the time that the tenancy agreement is signed, and ideally it should be kept updated throughout the duration of the tenancy when any associated work has been completed.

It’s important to note that landlords who own multiple rental properties may receive additional fines for non-compliance. The most severe penalties are given for serious violations, and landlords who own more than six properties could be penalised up to $50,000, and even as high as $100,000 for hearing claims.

Tenancies commenced between 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is a requirement for all Wallaceville and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords must keep records that demonstrate conformance with each Healthy Homes Standards that apply or will be applicable during the tenure of the rental property.

From July 1st 2021

  • Private landlords and property managers are required to make sure their rental properties conform with the Healthy Homes Standard within 90 days of any new, renewed or varied tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All homes let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of when the tenancy began.
