Fines for Failing to Comply

It is important to be aware that a landlord with multiple rental properties may face even higher fines for non-compliance. The highest penalties are given for severe breaches, and landlords with six or more properties could be fined as high as $50,000, or as high as $100,000 for hearing claims.

Tenancies signed beginning on 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is required in all Wallaceville and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate compliance with the Healthy Homes Standard that apply or will be in force during the tenure of the rental property.

From 1 July 2021

  • Private landlords and property managers must ensure their rental properties comply according to Healthy Homes Standards within 90 days of a newly renewed, extended or changed lease.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All houses rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.
