Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed for a Wainuiomata rental property, all Healthy Homes compliance tasks must be completed inside of 90 days.

From the 1st of July in 2021, if a new, renewed or varied Tenancy is signed for a Wainuiomata rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to meet any of the Healthy Homes Standards inside of the deadlines can result in the possibility of a fine up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or amended tenancy agreement there could be an additional fine or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the home they live in. If the property manager is unable to provide the required information within 21 days of getting the notice, the tenant could receive an infringement notification and could be fined up to $750.

Furthermore, there’s also a penalty as much as $900 for landlords and property managers who have provided a false or misleading Healthy Homes Statement of Compliance or information. The person who is liable to pay this fine is the one who is named on the lease agreement as the one who is renting the property and it could be the name of the landlord, or the property management company.

All information in the Statement of Compliance needs to be correct before the tenancy agreement can be executed, and it must be updated throughout the duration of the tenancy when any relevant work gets completed.

It is also crucial to keep in mind that landlords who manage multiple rental properties may face greater penalties for non-compliance. The harshest penalties are reserved for severe breaches, and landlords with at least six rental properties could be fined up to $50,000, and as much as $100,000 for hearing claims.

Wainuiomata Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is mandatory throughout Wainuiomata and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records that prove the compliance with each Healthy Homes Standard that apply or will be in force during the tenure of an apartment rental.

From July 1st 2021

  • Private landlords and property managers have to make sure their rental properties conform in accordance with Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must adhere to the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of when the tenancy first began.

Landlords and property managers are accountable for making sure such draughts are eliminated as far as possible.

There is no need to block off gaps or holes that are part of the construction. For instance, small gaps around doors and windows could be required to allow for movement of the structure when the house heats and cools, so that they are able to be opened and closed rather than being stuck. Adequate heaters are important for well-being homes

Heating Wainuiomata

Wainuiomata rental properties require a reliable heating source that is able to heat the main or largest living space to at least 18degC, even during the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat needs to remain fixed (i.e. not portable), at minimum 1.5 horsepower in capacity, and meet the minimum capacity for heating required in the living area. A Heating Assessment Tool could be used to check if the current permanent heater(s) are adequate or whether you will require to ‘top up’ with an additional heater. Open fires and unflued combustion heaters such as small portable LPG bottle heaters aren’t considered to be safe heating options in the Healthy Homes Standard.

If the heating you provide is an electric heater (or heat pump), it should have a thermostat. This will make the heating more uniform and efficient. For the majority of homes, bigger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters will be required. However, in certain instances such as small apartments small apartments, a smaller electric fixed heater may be sufficient.

If the living area already has a central heating source such as heat pumps, it might need a top up in order to comply with the standards. Certain types of heaters cannot be used to comply with the standard because they’re inefficient, unaffordable to operate or are unsafe to operate.
