Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed contract is signed on a Trentham rental property, all Healthy Homes compliance items must be taken care of by the end of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied lease is entered into on a Trentham rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

It is crucial to note that landlords with multiple rental properties could face even higher fines for non-compliance. The highest penalties are reserved for serious breaches, and landlords with six or more properties could be fined as high as $50,000, and even as high as $100,000 for hearing claims.

Trentham Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory throughout Trentham and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords must keep records that demonstrate compliance with each Healthy Homes Standards that apply or will be in force throughout the tenancy period of their rental properties.

From 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties comply to the Healthy Homes Standard within 90 days of any new, renewed or varied lease.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All households rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.
