Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed on a Trentham rental property, all Healthy Homes compliance tasks have to be done by the end of 90 days.

As of 1st July 2021, when a brand new, renewed or varied Tenancy is signed for the Trentham rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to comply with one of the Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included in an updated, renewed, or revised tenancy agreement there could be an additional fine or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the home they live in. If the landlord or the property manager doesn’t supply the required information within 21 days from having received the inquiry, they can receive an infringement notice and be fined as high as $750.

Furthermore, there’s also a penalty approximately $900 for landlords and property managers who provide a false or misleading Healthy Homes Statement of Compliance or other information. The person liable for this fine is the one who is named on the lease agreement as the one who is renting the property, so it could be the landlord’s name or the property management company.

The information contained in the Compliance Statement requirements to be up-to-date at the time that the tenancy agreement is signed. It must be updated through the tenancy period as related work is completed.

It’s also important to be aware that landlords who own several rental properties can face even higher fines for non-compliance. The most severe penalties are given for severe breaches, and landlords with six or more properties can be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

In the end, a failure to adhere to your Healthy Homes requirements can hit your bank account hard, and result in large fines in addition to still being required to comply with the regulations. Unreasonable Gaps & Holes

Draught Stopping Trentham

Draughts may lead to dropping temperatures within households. A damp house costs more to heat, resulting in wasted energy and resulting in higher bills.

If a draught is felt from unreasonable gaps or holes, it needs to be sealed.

What are unreasonable gaps or holes?

If you can feel external air entering or the sound of a clear draught emanating from a crack or a gap that is, it’s likely to be a gap or an opening that needs sealing in some way. Cracks or gaps with large gaps must be stopped permanently. Any gaps greater than 3mm that allow air in or out of the home need seals. For example, if the open fireplace isn’t used it can create draughts. This must be sealed off. Property managers and landlords are responsible for making sure such draughts are eliminated as much as possible.

You don’t need to cover up holes or gaps which are part of the building. For instance, small gaps around doors and windows might be necessary to allow for movement of the building as the household heats and cools, to allow them to be closed and opened instead of than being stuck. We will check the windows and doors during our Healthy Homes assessment of your rental property.

Heating Trentham

Rental properties in Trentham require a reliable source of heat which can warm the largest or main living area to at minimum 18degC, even during the most coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat needs to remain fixed (i.e., not portable) with at least 1.5 horsepower in capacity, and must meet the minimum capacity for heating required for the main living space. The Heating Assessment Tool can be used to determine whether your current fix heater(s) are sufficient or if you’ll need to top up with an additional heater. Unflued combustion and open fire heaters like portable LPG bottle heaters aren’t considered acceptable heating options for the Healthy Homes Standard.

If the heating that you provide is an electric heater (or heat pump), it requirements to have the thermostat. This will help make the heating more uniform and efficient. In most homes, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are required. In certain situations, like small apartment buildings an electric, fixed heater might be enough.

If your living space is already equipped with a fixed heating source such as heat pumps, it might need some additional energy to be able to meet the standards. Certain types of heaters cannot be used to comply with the standard as they are either not efficient, cost prohibitive to operate and/or unhealthy to run.

Ventilation Trentham

Every living space in the rental property should have at least one opening doors or windows to provide natural airflow. In addition, humid areas such as kitchens or bathrooms need to have an externally vented extractor fan that can get rid of moisture.

The ventilation standard is all about understanding the fact that dry air is less difficult to heat and that a property that is well ventilated is less likely to be a victim of damp and mould.

Bedrooms, living spaces, kitchens and dining rooms are considered liveable areas. Connecting spaces like the hallway aren’t liveable and therefore don’t require an opening door or window.

Every window, door or skylight needs to be able of opening to the outside, but remain closed, allowing ventilation and fresh air air flow.

All bathrooms and kitchens and any other room in your home that has a bath, shower or cooktop, or any other water-generating appliance will require proper extractor fan systems that are vented to the outside. The Healthy Homes Assessment service will verify that there is enough ventilation in every living space that includes extractor fans that are suitable in high moisture areas.

Insulation Trentham

Underfloor and ceiling insulation is a requirement on all rental homes since 1 July 2019. All landlords and property managers must make sure the insulation meets standards that are in line with the latest quality. In some instances, an existing insulation on the ceiling or in the subfloor space may need to be added or replaced.

A properly insulated home can reduce condensation, and decrease the risk of mould and dampness and will also make much easier for the house to hold heat.

Insulation requirements to be in compliance with the R-values for your area

The "R" refers to thermal resistance, and is a gauge of how well insulation can withstand heat flow. The greater the R-value, the more effective the insulation.

  • Zone 1 - Auckland & Northland Ceiling R 2.9 Underfloor R 1.3
  • Zone 2 – the remainder part of North Island except Taupo and the Central Plateau – ceiling R 2.9 and underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3, underfloor R 1.3

Trentham Moisture Ingress & Drainage

Protecting your rental property from moisture isn’t just about the inside of the building; you have to make sure there is somewhere to allow surface, rain and ground water to go and prevent it from getting into the building. When it comes to moisture and damp it is typically not apparent that it can cause a lot of trouble, causing damages to your investment and harming the tenant’s well-being.

Properties that are rented must be equipped with effective drainage for the removal of storm water, surface water, and groundwater, with the proper outfall or runoff. Making sure that water has a proper place to go, and that it isn’t allowed to remain beneath structures is an crucial aspect of keeping your property dry.

In addition to a drainage system to prevent moisture from entering, if your rental has an enclosed gap between the floor and the ground, a ground water barrier must be constructed if it’s reasonably practicable to do so.

A ground moisture barrier is usually a polythene sheet laid over the ground, to block any moisture that is present in the ground from accumulating into the structure. It also helps prevent from causing damage to the flooring insulation.
