Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed for a Trentham rental property, all Healthy Homes compliance tasks must be finished within 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied Tenancy is signed for the Trentham rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with all of the Healthy Homes Standards inside of the deadlines can result in the possibility of a fine up to $7200. The person who is liable for this fine is the person who is named on the lease contract as the person who is letting the property, so it could be the landlord’s name or the property management company.

All information in the Statement of Compliance requirements to be correct when the tenancy agreement is executed, and it should be kept updated throughout the duration of the tenancy when any necessary work related to it’s finished.

It’s also important to keep in mind that landlords with multiple rental properties may receive additional fines for non-compliance. The highest penalties are handed down for the most serious violations, and landlords who own at least six rental properties could be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

Trentham Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is required throughout Trentham and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records that prove the conformance to all Healthy Homes Standard that apply or will be in force during the tenure of your rental home.

Starting 1 July 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a new, renewed or varied tenant.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From July 1st 2023

  • All households let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.

Draughts are a major cause of less temperature in households. A humid home will cost more to heat, which means wasting energy and increased bills.

What are unjustifiable gaps or holes?

If you can feel external air flowing in or a clear draught out of a hole or gap that is, it’s likely a crack or crack that requirements sealing in the way you can. Adequate heaters are important to ensure well-being homes

Heating Trentham

Trentham rental properties should have a permanent source of heat that can warm the main or largest living space to at least 18degC, even during the most coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat needs to remain fixed (i.e. not portable), at minimum 1.5 horsepower in capacity, and it must have the minimum requirement for heat capacity in the living area. A Heating Assessment Tool could be used to check if the existing fix heater(s) are adequate or if you’ll require to top up by adding a second heater. If the heating you provide is an electric heater (or heat pump), it needs to have a thermostat. This will make the heating more uniform and effective. In most homes, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are required. In certain situations, like small apartments, a smaller fixed electric heater may suffice.

If the main living room already has a fixed heating source, like the heat pump, it might require a top up to ensure it meets the requirements. Some types of heaters can’t be used to meet the standard because they’re expensive, inefficient or unsafe to operate.

Ventilation Trentham

Every living space in a rental property has to contain at minimum one open windows or an exterior door to offer natural airflow. In addition, humid areas such as kitchens and bathrooms should be equipped with an externally vented extractor to remove moisture.

Insulation Trentham

Insulation for underfloor and ceilings is mandatory to all rental homes since 1 July 2019. Property managers and landlords have to make sure that the insulation is in line with current quality. In some cases, an existing insulation on the ceiling or in the subfloor space might need to be added or replaced.
