Fines for Failing to Comply

As of 1st July 2021, if a new or renewed tenancy is signed on a Trentham rental property, all Healthy Homes compliance work have to be taken care of by the end of 90 days.

From the 1st of July in 2021, when a new, renewed or varied Tenancy is signed for the Trentham rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to adhere to all of the Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy agreement, there could be an additional fine or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager fails to provide the information requested within 21 days of getting the notice, the tenant may receive an infringement notice and be fined up to $750.

In addition, there is also a penalty of as much as $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the one who is listed on the tenancy agreement as the one who is leasing the property out, so it could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance needs to be accurate at the time that the tenancy agreement is signed, and ideally it is updated during the entire tenancy, as necessary work related to it’s finished.

It’s also important to keep in mind that a landlord who have multiple rental properties could face even higher fines for non-compliance. The most severe penalties are reserved only for serious breaches, and landlords with six or more properties can be penalised up to $50,000, or as high as $100,000 in hearing claims.

Healthy homes are important

Why is Healthy Homes Compliance So Important?

A majority of households rent homes in New Zealand and Trentham, and research indicates that rental homes tend to be colder, older and are not as efficient heating and have lower standard than those owned by owners.

Moldy, damp and cold homes can have negative health outcomes, particularly illnesses like colds, flu, asthma and cardiovascular issues. In addition, people who report at least four major home quality issues often suffer from low life satisfaction and reduced mental wellbeing.

Improving the standard of Trentham rental property can help tenants enjoy better mental and physical health, and lessen the disruption to work, learning and daily life because of diseases. Your investment will also be better protected from mould, mildew and damp-related damage, which results in less costs of maintenance over the long term.

Unreasonable Gaps & Holes

Draught Stopping Trentham

Draughts may lead to lower temperatures in households. A cold house will cost more to heat, resulting in wasted money and energy.

If a draught could be felt from unreasonable gaps or holes that it needs to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air flowing in or the sound of a clear draught emanating from a gap or hole or crack, then it’s probably a gap or an opening that requirements sealing in the way you can. Large gaps and cracks should be fixed permanently. Cracks that are greater than 3mm and allow air in or out from the house need seals. For example, if an open fireplace isn’t being used, it can create draughts. This should be sealed off. Landlords and property managers are responsible for making sure that such draughts are squelched whenever imaginable.

You don’t need to block off gaps or holes that are part of the construction. For instance, small gaps around doors and windows may be required to allow for movement within the building as the house warms and cools so that they can still be shut and opened, rather instead of being stuck. We will test every window and door as part of our Healthy Homes assessment of your rental property.

Adequate heaters are important for well-being homes

Heating Trentham

Trentham rental properties need to have a stable source of heat that can heat the principal or the biggest living space to a minimum of 18degC even on the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heating needs for it to be permanent (i.e., not portable), at least 1.5 Kilowatts in heating capacity and have the minimum required heating capacity in the living area. The Heating Assessment Tool can be used to determine if your current fix heater(s) are sufficient or whether you will need to "top-up" with a new heater. Unflued combustion and open fire heaters, such as small portable LPG bottle heaters aren’t considered to be suitable heating options under the Healthy Homes Standard.

If the heating system you provide is an electric heater or heat source, then it must have an thermostat. This makes the heating more uniform and effective. In most homes, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are necessary. However, in certain instances like small apartments, a smaller fixed electric heater may be sufficient.

If the main living room is already equipped with a fixed heating source, like an air conditioner, it might require an upgrade to be able to meet the standards. Certain kinds of heaters cannot be used to comply with the standard since they’re either inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Trentham

Every living space of a rental home must include at least one open windows or an exterior door to provide natural ventilation. In addition, humid areas such as kitchens or bathrooms need to have an externally vented extractor fan that can take moisture away.

It is the ventilation quality is all about understanding it is that dry air will be more easy to heat and that an apartment that is well-ventilated is less likely to be a victim of mould and damp.

Bedrooms, living spaces, kitchens, and dining areas are all considered living spaces. Spaces that connect, such as the hallway aren’t considered living spaces and therefore don’t need an opening window or door.

Every window, door or skylight needs for them to be in a position to open to the outside, but remain set in an opening position in order to allow for fresh air circulation and ventilation.

All kitchens and bathrooms, as well as any other space in your home with a bath, shower and cooktop or another water-generating appliance will require proper extractor fan systems that are vented out to the outside. We offer a Healthy Homes Assessment service will make sure there is sufficient ventilation in every living space, including suitable extractor fans in areas of high moisture.

Insulation Trentham

The insulation of the ceiling and underfloor is a requirement to all rental homes from 1 July 2019. All landlords and property managers must ensure that the insulation meets the new standard. In some cases, an existing insulation on the ceiling or in the sub floor space might require to be replaced or replaced.

A properly insulated home can help control condensation and reduce the chances of mould and dampness and also makes much easier to the home to keep warmth.

Insulation needs to meet the R-values required for your area

The "R" signifies thermal resistance, and it is a measurement of how well the insulation can withstand heat flow. The greater the R-value, the more effective the insulation.

  • Zone 1 - Auckland & Northland Ceiling R 2.9 Underfloor R 1.3
  • Zone 2 – the remainder part of North Island except Taupo and the Central Plateau – ceiling R 2.9 underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 and underfloor R 1.3

Trentham Moisture Ingress & Drainage

Making sure your rental property is protected from the effects of moisture isn’t just a matter of what’s inside the building it is also about the outside. You must ensure there is somewhere for rain, surface and underground water to flow and to prevent it from getting into the building. When it comes to moisture and damp it’s usually what you don’t see that can cause a lot of trouble that can cause damage to your investment as well as harming your tenant’s health.

Rental properties should have efficient drainage for the removal of floodwaters, surface water, and ground water. This includes the proper outfall or runoff. Making sure that the water has a place to go, and it isn’t allowed to remain beneath structures is an important aspect of keeping your property dry.

In addition to a drainage system to avoid moisture ingress, if your rental has an enclosed gap between your flooring and ground, a ground moisture barrier must be constructed if it is reasonably practicable to install it.

A ground moisture barrier is usually a polythene sheet laid over the ground, in order to block any moisture present in the ground from getting into the building. It also assists in preventing from causing damage to the flooring insulation.
