Fines for Failing to Comply
Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on a Trentham rental property, all Healthy Homes compliance items have to be done within 90 days.
Since the 1st July of 2021, once a new, renewed or varied lease is entered into on a Trentham rental property, all Healthy Homes compliance work must be done by the end of 90 days.
Failure to meet each of Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy agreement there could be an additional penalty or infringement fee.
Every tenant is entitled to request details regarding the Healthy Homes Standard and how they are related to the house they are living in. If the property manager does not provide the required information within 21 days from having received the inquiry, they can receive an infringement notification and be fined upto $750.
Furthermore, there’s also a fine of approximately $900 for landlords and property managers who have provided a false or false Healthy Homes Statement of Compliance or other information. The person liable to pay this fine is the one who is identified on the tenancy agreement as being the person renting the property which could be the name of the landlord as well as the property management company.
The information contained in the Compliance Statement needs to be correct when the tenancy agreement is completed, and should be maintained during the entire tenancy, as necessary work related to it is finished.
It’s also crucial to be aware that a landlord who have multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are handed down only for serious violations. Those who have six or more properties could be fined up to $50,000 and as high as $100,000 in hearing claims.
