Rental Property Healthy Homes Fines
Fines for Failing to Comply
As of 1st July 2021, when a brand new or renewed tenancy is signed for a Trentham rental property, all Healthy Homes compliance work have to be taken care of by the end of 90 days.
From the 1st of July in 2021, if a new or renewed lease is entered into on a Trentham rental property, all Healthy Homes compliance work must be done within 90 days.
Failure to adhere to all of the Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance isn’t included within the new, renewed or amended tenancy agreement there could be an additional fine or infringement fee.
Any tenant can ask for information about the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager fails to supply the information requested within 21 days from having received the inquiry, they may be issued an infringement notice and be fined upto $750.
Additionally, there is also a fine of as much as $900 for property owners or property managers providing a false or misleading Healthy Homes Compliance Statement or any other information. The person responsible for this fine is whoever is named on the tenancy contract as the person who is letting the property and it could be the name of the landlord, or the property management company.
All information in the Statement of Compliance needs to be up-to-date when the tenancy agreement is signed, and ideally it must be updated through the tenancy period as necessary work related to it is finished.
It is important to remember that a landlord who own multiple rental properties may receive more severe penalties for not complying. The most severe penalties are reserved for severe breaches. Landlords with more than six properties could be penalised up to $50,000, and even as high as $100,000 for hearing claims.
