Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Trentham rental property, all Healthy Homes compliance work must be done inside of 90 days.

From the 1st of July in 2021, once a new, renewed or varied Tenancy is signed for the Trentham rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards within the period of time expected can lead to penalties of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not included within the new, renewed or revised tenancy contract, there could be an additional fine or violation fee.

Anyone can request information regarding the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager is unable to provide the required information within 21 days of being informed of the request, they could receive an infringement letter and be fined up to $750.

Furthermore, there’s an additional fine of approximately $900 for landlords and property managers who provide a false or incorrect Healthy Homes Compliance Statement or other information. The person responsible for this fine is the one who is named on the tenancy contract as the person leasing the property out which could be the name of the landlord or the company that manages the property.

The information contained in the Compliance Statement needs to be correct when the tenancy contract is signed. It must be updated through the tenancy period as necessary work related to it is finished.

It is also important to be aware that landlords who manage multiple rental properties may receive more severe penalties for not complying. The harshest penalties are reserved for severe breaches, and landlords with more than six properties could be fined as high as $50,000, or as high as $100,000 for hearing claims.

Trentham Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is a requirement for all Trentham and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords must keep records that demonstrate conformance with all Healthy Homes Standards that apply or will be in force during the tenure of your rental home.

From July 1st 2021

  • Private landlords and property managers are required to make sure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Trentham

Draughts are a major cause of lower temperatures in households. A draughty home costs more to heat, resulting in wasted energy and incurring higher costs.

If a draught is perceived as a result of gaps or holes, it requirements to be closed.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or a clear draught from a crack or a gap, then it is likely a crack or an opening that needs sealing in any way. Cracks and gaps that are large should be sealed permanently. Any gaps greater than 3mm that allow air to enter or exit of the home need to be sealed. For example, if the open fireplace isn’t in use it can cause draughts and must be sealed from. Landlords and property managers are accountable for making sure that draughts from the fireplace are removed whenever imaginable.

You don’t need to cover up holes or gaps that are part of the construction. For instance, small gaps around doors and windows could be required to allow for movement within the building when the home heats and cools, in order to let them be opened and closed rather than being stuck. Adequate heaters are crucial to ensure healthy houses

Heating Trentham

Trentham rental properties should have a permanent source of heating that can warm the principal or the biggest living room to at least 18degC even on the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source needs for it to be permanent (i.e. not portable), at minimum 1.5 kW in heating capacity, and must meet the minimum capacity for heating required in the living area. A Heating Assessment Tool can be used to determine if the permanent heater(s) are adequate or if you’ll require to "top-up" with a new heater. Fires that are open and unflued heaters such as portable LPG bottle heaters aren’t considered to be safe heating options in The Healthy Homes Standard.

If the heating that you provide is electric heating or heat source, then it must have a thermostat. This will make the heating more uniform and effective. For most houses, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. In certain situations, like apartments with small spaces, a smaller fixed electric heater could be enough.

If the main living room is already equipped with a fixed heating source like an air conditioner, it may need an upgrade in order to comply with the standards. Certain kinds of heaters aren’t able to be used to meet the standard as they are either expensive, inefficient and/or unsafe to run.

Ventilation Trentham

Every living space in the rental property should contain at minimum one open door or window to provide natural airflow. In addition, humid areas such as kitchens and bathrooms need to have an externally vented extractor to get rid of moisture.

The ventilation standard is about recognising the fact that dry air is much easier to heat and a well ventilated rental property is less likely to be a victim of damp and mould.

Bedrooms, living rooms kitchens, and dining areas are considered to be liveable spaces. Connecting spaces like the hallway aren’t considered living spaces and therefore don’t require an opening window or door.

Each window, door or Skylight needs at least to open up to the outside and remain closed in order to allow for fresh air circulation and ventilation.

All bathrooms and kitchens and any other room in your home with a bath, shower or cooktop, or any other water-generating appliance will need proper extractor fan systems that can be vented to the outside. Insulation Trentham

Ceiling and underfloor insulation is mandatory in all rental houses as of July 1st, 2019. All landlords and property managers should make sure that the insulation meets this new quality. In certain situations, the existing ceiling insulation or insulation in the subfloor space may need to be topped up or replaced.

A house that is well-insulated will help to control condensation, and decrease the risk of mould and dampness and will also make more easy to the home to keep heat.
