Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on a Totara Park rental property, all Healthy Homes compliance work need to be taken care of inside of 90 days.

Totara Park Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory to all Totara Park and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords must keep records that demonstrate compliance with any Healthy Homes Standard that apply or will apply during the tenure of an apartment rental.

Beginning 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any renewal, new or a change in tenant.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All houses that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

  • All rentals houses are required to comply with Healthy Homes Standard regardless of when the tenancy first began.
