Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Totara Park rental property, all Healthy Homes compliance work need to be done within 90 days.

Since the 1st July of 2021, if a new or renewed contract is signed on the Totara Park rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to adhere to each of Healthy Homes Standards by the end of the expected timeframe can result in a fine of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy contract, it could result in an additional fine or violation fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the home they reside in. If the property manager fails to provide the required information within 21 days from receiving the request, they may receive an infringement letter and be fined as high as $750.

In addition, there is an additional fine of up to $900 for landlords or property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or other information. The person who is responsible to pay this fine is the one who is named on the tenancy agreement as being the person letting the property out and it could be the landlord’s name or the property management company.

All information in the Compliance Statement requirements to be current when the tenancy agreement is executed, and it must be updated during the entire tenancy, as relevant work gets completed.

It is crucial to be aware that landlords who own multiple rental properties may face even higher fines for non-compliance. The harshest penalties are reserved for serious violations. Those who have at least six rental properties could be fined up to $50,000, or as high as $100,000 in hearing claims.

Totara Park Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement for all Totara Park and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records of their conformance with any Healthy Homes Standard that apply or will apply during the tenure of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers have to ensure their rental properties comply to the Healthy Homes Standards within 90 days of any new, renewed , or altered tenant.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts can lead to dropping temperatures within homes. A damp home is more expensive to heat, which means wasting money and energy.

What are unreasonable gaps or holes?

If you are able to feel external air flowing in or a clear draught from a gap or hole and you are able to feel it, it is likely to be a gap or an opening that requirements sealing in somehow. Heating Totara Park

Rental properties in Totara Park must have a fixed source of heating which can warm the largest or main living space to a minimum of 18degC, even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat requirements for it to be permanent (i.e. not portable), at minimum 1.5 horsepower in capacity, and must meet the minimum requirement for heat capacity in the living area. The Heating Assessment Tool can be used to determine whether the permanent heater(s) are adequate or whether you will need to top up with a new heater. Open fires and unflued combustion heaters, such as mobile LPG bottle heaters are not considered to be suitable heating options under Healthy Homes Standard. Healthy Homes Standard.

If the heating system you offer is an electric heater or heat source, it must include a thermostat. This will make your heating more consistent and efficient. For most houses, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. However, in some cases such as small apartments small apartments, a smaller electric fixed heater may be sufficient.

If the main living room is already equipped with a fixed heating source, like heat pumps, it might just need a top up to ensure it meets the requirements. Some types of heaters can’t be used to comply with the standard since they’re either expensive, inefficient and/or unhealthy to run.

Ventilation Totara Park

Insulation Totara Park

Ceiling and underfloor insulation is mandatory for all rent houses since 1 July 2019. All landlords and property managers must make sure that the insulation is in line with this new quality.
