Did you not know that Healthy Homes Standards came into effect on the 1st July 2021? The landlords are now required to make sure that their Timberlea rental properties meet the minimum Healthy Homes Standards within 90 days of any new or renewed tenancy and all private rentals must be fully compliant by 1 July 2024.

Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed contract is signed on a Timberlea rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

As of 1st July 2021, once a new, renewed or varied Tenancy is signed for the Timberlea rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to adhere to any of the Healthy Homes Standards by the end of the expected timeframe can result in a fine of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy agreement it could result in an additional fine or violation fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the building they are living in. If the the property manager doesn’t supply the information requested within 21 days of being informed of the request, they may be issued an infringement notice and be fined upto $750.

Furthermore, there’s an additional fine of up to $900 for landlords or property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or other information. The person responsible to pay this fine is the one who is named on the tenancy agreement as the person who is leasing the property out and it could be the name of the landlord, or the property management company.

The information contained in the Compliance Statement needs to be correct when the tenancy agreement is signed, and ideally it should be maintained during the entire tenancy, as associated work has been completed.

It’s important to note that landlords who have multiple rental properties may face even higher fines for non-compliance. The harshest penalties are given for the most serious breaches, and landlords with six or more properties could receive fines of up to $50,000, and even as high as $100,000 in hearings.

Timberlea Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is required for all Timberlea and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate conformance with any Healthy Homes Standard that apply or will apply during the tenure of an apartment rental.

From 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any new, renewed , or altered lease.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draughts can lead to low temperatures inside households. A damp house is more expensive to heat, which means wasting energy and resulting in higher bills.

What are unjustifiable gaps or holes?

If you can feel external air flowing in or a clear draught from a hole or gap that is, it is likely a crack or hole that needs sealing in the way you can. Cracks and gaps that are large should be sealed permanently. The gaps that exceed 3mm that allow air to enter or exit from your house need to be sealed. For instance, if an open fireplace is not in use, it could cause draughts, and should be sealed off. Property managers and landlords are accountable for making sure that these draughts are stopped in the maximum extent imaginable.

You don’t need to cover up gaps or holes which are part of the construction. For instance, small gaps around windows and doors may be required to allow for movement within the building as the home heats and cools, so that they can still be opened and closed rather than being stuck. A good heating system is important for well-being homes

Heating Timberlea

Rental properties in Timberlea must have a fixed source of heating that can heat the largest or main living area to at minimum 18degC, even on the winter coldest days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source needs to be fixed (i.e. not portable), at minimum 1.5 kW in heating capacity, and must meet the minimum capacity for heating required to heat the living space in general. A Heating Assessment Tool can be used to determine if your current installed heater(s) are adequate or whether you will require to "top up" with an additional heater. Open fires as well as unflued combustion heaters such as small portable LPG bottle heaters aren’t considered acceptable heating options in The Healthy Homes Standard.

Insulation for underfloor and ceilings is required for all rent houses since July 1, 2019. All landlords and property managers must ensure that the insulation is up to current quality.
