Did you know that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords must make sure that their Timberlea rental properties meet the minimum Healthy Homes Standards within 90 days of any renewed or new tenancy and all private rentals must be completely compliant by 1 July 2024.

Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Timberlea rental property, all Healthy Homes compliance items must be taken care of inside of 90 days.

From the 1st of July in 2021, once a new or renewed lease is entered into on the Timberlea rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet each of Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy contract, there could be an additional fine or violation fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager is unable to provide the required information within 21 days from receiving the request, they can receive an infringement notice and could be fined up to $750.

In addition, there’s an additional fine of up to $900 for property owners or property managers who provide a false or misleading Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the one who is named on the lease contract as the person renting the property It could also be the name of the landlord, or the property management company.

The information contained in the Statement of Compliance needs to be correct when the tenancy contract is completed, and should be kept updated throughout the tenancy as any associated work has been completed.

It is also important to note that a landlord with multiple rental properties may face more severe penalties for not complying. The highest penalties are reserved only for serious breaches. Landlords with six or more properties could be penalised up to $50,000, and even as high as $100,000 in hearings.

Timberlea Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory to all Timberlea and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate conformance with any Healthy Homes Standards that apply or will be applied to an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords are required to make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of when the tenancy first began.

Timberlea rental properties should have a permanent heating source that can warm the main or largest living space to a minimum of 18degC even on the coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat needs that it be permanently fixed (i.e., not portable), at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum requirement for heat capacity for the main living space. The Heating Assessment Tool can be used to determine if the current permanent heater(s) are adequate or if you’ll require to "top up" with an additional heater. Open fires and unflued combustion heaters, such as mobile LPG bottle heaters aren’t considered to be suitable heating options in The Healthy Homes Standard.

If the heating system you offer is electric heating or heat pump, it must have the thermostat. This will help make the heating more uniform and efficient. In most homes, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in certain instances such as small apartments, a smaller fixed electric heater may be sufficient.

If your living space already has a central heating source, such as a heat pump, then it could need an upgrade in order to comply with the standards. Some types of heaters can’t be used to achieve the quality as they are either costly, not cost-effective to run, or are unsafe to operate.

Ventilation Timberlea

Every living space of a rental house must include at least one open windows or an exterior door to provide natural ventilation. Furthermore, moist areas such as kitchens or bathrooms must have a suitable externally vented extractor fan that can remove moisture.

A ventilation quality is all about acknowledging the fact that dry air will be less difficult to heat and the property that is properly ventilated is less likely to be a victim of damp and mould.

Living rooms, bedrooms, dining rooms, and kitchens are considered to be liveable spaces. Spaces that connect, such as the hallway are not considered liveable and do not need an opening window or door.

Every window, door or skylight needs to have the ability to open up to the outside, but remain closed to allow to circulate fresh air as well as air flow.

Property managers and landlords must ensure the insulation meets standards that are in line with the latest quality. In certain situations, the current ceiling insulation, or the insulation of the subfloor space may need to be topped up or replaced.

A house that is well-insulated can reduce condensation and reduce the chances of mould and dampness and also makes much easier for the home to retain warmth.
