Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed on a Timberlea rental property, all Healthy Homes compliance work need to be done inside of 90 days.

It is also important to be aware that landlords who have several rental properties can face more severe penalties for not complying. The highest penalties are reserved only for serious breaches, and landlords with six or more properties can be fined up to $50,000, or as high as $100,000 in hearing claims.

Timberlea Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is mandatory in all Timberlea and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate the conformance to any Healthy Homes Standards that apply or will be applied throughout the tenancy period of your rental home.

From July 1st 2021

  • Property managers and private landlords should make sure their rental properties conform with the Healthy Homes Standards within 90 days of a new, renewed , or altered tenant.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.
