Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed on a Timberlea rental property, all Healthy Homes compliance tasks must be taken care of by the end of 90 days.

Beginning on July 1st, 2021, once a new or renewed contract is signed on a Timberlea rental property, all Healthy Homes compliance work must be finished inside of 90 days.

All the information on the Compliance Statement needs to be correct when the tenancy agreement is executed, and it should be maintained during the entire tenancy, as necessary work related to it’s finished.

It’s also crucial to be aware that landlords who have multiple rental properties could face even higher fines for non-compliance. The most severe penalties are reserved only for serious breaches, and landlords with six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearings.

When should I require to be in compliance with The Healthy Homes Standards?

Timberlea Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is required to all Timberlea and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records of their conformance with all Healthy Homes Standard that apply or will be applicable to your rental home.

From 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a renewal, new or a change in tenant.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All houses let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

For example, tiny gaps around windows and doors could be required to allow for movement of the building when the household gets warmer and cooler, so that they can still be opened and closed rather instead of being stuck. Heating Timberlea

Rental properties in Timberlea need to have a stable source of heat that can heat the living space to a minimum of 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating needs to be fixed (i.e. not portable) with at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum requirement for heat capacity for the main living room. For most properties, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. However, in certain instances like apartments with small spaces an electric, fixed heater could be enough.

If your main living space already has a permanent heating source such as an air conditioner, it may need an update to meet the standards. Some types of heaters can’t be used to comply with the standard since they’re either costly, not affordable to run, and/or unhealthy to run.

Ventilation Timberlea
