Did you know that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords must make sure that their Timberlea rental properties meet the minimum Healthy Homes Standards within 90 days of any new or renewed tenancy, and all private rental properties must be fully certified by 1 July 2024.

Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Timberlea rental property, all Healthy Homes compliance tasks must be completed within 90 days.

From the 1st of July in 2021, if a new or renewed tenancy is signed on the Timberlea rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not incorporated in an updated, renewed, or amended tenancy agreement it could result in an additional penalty or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager fails to provide the required information within 21 days from being informed of the request, they could be issued an infringement notice and be fined upto $750.

Additionally, there is also a penalty up to $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Compliance Statement or information. The person who is liable for this fine is whoever is named on the tenancy agreement as the person who is letting the property out It could also be the name of the landlord or the company that manages the property.

All the information on the Statement of Compliance requirements to be up-to-date when the tenancy contract is executed, and it should be kept updated throughout the tenancy as any related work is completed.

It is important to be aware that a landlord who own multiple rental properties may receive even higher fines for non-compliance. The highest penalties are handed down for severe violations, and landlords who own at least six rental properties could be penalised up to $50,000, and even as high as $100,000 in hearings.

Timberlea Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is required in all Timberlea and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records of their the compliance with each Healthy Homes Standard that apply or will apply during the tenancy of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords are required to make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a renewal, new or a change in lease.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draughts can lead to dropping temperatures within houses. A humid house will cost more to heat, resulting in wasted energy and incurring higher costs.

If a draught can be perceived as a result of gaps or holes the area requirements to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air entering or the sound of a clear draught emanating from a hole or gap that is, it’s likely to be a gap or an opening that requirements sealing in the way you can. Large gaps and cracks should be sealed permanently. The gaps that exceed 3mm that let air in or out of your home require seals. For instance, if an open fireplace isn’t in use it can cause draughts and should be shut off. Property managers and landlords are accountable for making sure that these draughts are stopped as far as imaginable.

There is no need to block holes or gaps that are part of the building. For instance, small gaps around doors and windows might be necessary to allow movement of the structure when the house is heated and cools so that they can still be opened and closed rather than being stuck. Heating Timberlea

Timberlea rental properties should have a permanent heating source that can warm the main or largest living space to a minimum of 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating needs that it be permanently fixed (i.e., not portable), at least 1.5 horsepower in capacity, and meet the minimum capacity for heating required for the main living room. A Heating Assessment Tool may be used to determine if the current permanent heater(s) are sufficient or if you’ll need to "top up" with a new heater. Unflued combustion and open fire heaters such as the portable LPG bottle heaters are not considered to be suitable heating options for the Healthy Homes Standard.

If the heating you offer is an electric heater or heat pump it should be equipped with the thermostat. This makes your heating more consistent and efficient. For the majority of houses, bigger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in some cases like small apartments the smaller fixed electric heater might be enough.

If your living space already has a fixed heating source, like an air conditioner, it might require an upgrade in order to comply with the standards. Some types of heaters can’t be utilised to meet the quality as they are either costly, not cost-effective to run, and/or unhealthy to run.

Ventilation Timberlea

Each living space within a rental house must include at least one open window or exterior door to offer natural airflow. Additionally, areas with high moisture areas such as kitchens and bathrooms should have an venting fan outside to remove moisture.

The ventilation standard is all about acknowledging the fact that dried air can be easier to heat and heat, and a property that is well ventilated is less likely to grow mould and damp.

Bedrooms, living spaces, kitchens and dining rooms are all considered living spaces. Spaces that connect, such as the hallway aren’t liveable and therefore do not need an opening window or door.

The bathrooms in all kitchens and any other room in your home that has a bath, shower cooker or any other humidity-generating items will require adequate extractor fans that can be vented towards the outside. Insulation Timberlea

The insulation of the ceiling and underfloor is a requirement on all rental homes since 1 July 2019. Property managers and landlords should make sure that the insulation is in line with this new standard. In some instances, old ceiling insulation as well as insulation within the sub floor space may need to be added or replaced.

A properly insulated home can help control condensation and reduce the chances of dampness and mould, and also makes an easier task to the home to retain the heat.

The "R" stands for thermal resistance, and is a measure of how well the insulation can withstand heat flow. The more R-value is higher, the more effective the insulation.

Timberlea Moisture Ingress & Drainage

Making sure your rental property is protected from dampness isn’t just about the inside it is also about the outside. You must ensure there is somewhere to allow surface, rain or ground water, and to prevent it from getting into the building. When it is damp and moisture, it’s usually what you don’t see that can cause a lot of trouble that can cause the property to suffer and harming your tenant’s health.

Rental properties should have efficient drainage for the removal of floodwaters, surface water and ground water. This includes the proper outfall or runoff. Making sure the water has a location to go, and that it doesn’t sit beneath buildings is an essential part of keeping your property dry.

Alongside a drainage system to prevent water ingress, if the apartment has an enclosed gap between floorboards and ground, a ground water barrier must be installed if it is reasonably practicable to do so.

A ground moisture barrier is usually an insulating sheet of polythene laid over the ground, in order to block any moisture in the ground from rising into the building. It also helps prevent water damage to the floor insulation.
