Did you know that the Healthy Homes Standards came into effective on July 1st, 2021? Landlords must make sure their Timberlea rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy, and all private rentals must be completely certified by 1 July 2024.

Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed on a Timberlea rental property, all Healthy Homes compliance items need to be finished within 90 days.

Since the 1st July of 2021, once a new, renewed or varied contract is signed on the Timberlea rental property, all Healthy Homes compliance work must be completed within 90 days.

Inability to adhere to one of the Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy agreement there could be an additional fine or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the property they reside in. If the property manager does not supply the information requested within 21 days from having received the inquiry, they may receive an infringement notice and be fined up to $750.

Additionally, there is an additional fine of up to $900 for landlords and property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person who is responsible to pay this fine is the one who is identified on the tenancy agreement as being the person letting the property out and it could be the name of the landlord as well as the property management company.

All the information on the Statement of Compliance needs to be accurate when the tenancy agreement is signed, and ideally it should be kept updated during the entire tenancy, as relevant work gets completed.

It’s also crucial to note that a landlord who own multiple rental properties could face even higher fines for non-compliance. The most severe penalties are given for the most serious breaches. Landlords with six or more properties could receive fines of up to $50,000, and as much as $100,000 for hearing claims.

Timberlea Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory throughout Timberlea and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords must keep records of their the conformance to the Healthy Homes Standards that apply or will be applied to the rental property.

From July 1st 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Timberlea

Draughts may lead to low temperatures inside homes. A humid house costs more to heat, meaning wasting energy and increased bills.

If a draft can be noticed from gaps that are not adequate or holes, it needs to be sealed.

What are unjustifiable gaps or holes?

If you can feel external air flowing in or a clear draught from a crack or a gap, then it is likely a crack or hole which needs sealing in somehow. Cracks or gaps with large gaps must be sealed permanently. The gaps that exceed 3mm that allow air in or out of the home require to be sealed. For example, if the open fireplace isn’t in use it may cause draughts and should be shut off. Landlords and property managers are responsible for ensuring that these draughts are stopped as far as possible.

There is no need to cover up gaps or holes which are part of the construction. For instance, small gaps around windows and doors may be required to allow for the movement of the building as the household is heated and cools so that they are able to be closed and opened rather instead of being stuck. Heating Timberlea

Timberlea rental properties require a reliable heating source that is able to heat the living space to at least 18degC, even on the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat needs to remain fixed (i.e. not portable) that is, at least 1.5 kW in heating capacity, and it must have the minimum heating capacity needed in the living area. A Heating Assessment Tool can be used to determine if the existing permanent heater(s) are sufficient or whether you will need to top up with a new heater. Fires that are open and unflued heaters, such as mobile LPG bottle heaters aren’t considered to be safe heating options for those following the Healthy Homes Standard.

If the heating system you provide is an electric heater (or heat pump), it requirements to have an thermostat. This makes the heating more uniform and efficient. For most houses, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in some cases like apartments with small spaces small apartments, a smaller electric fixed heater may suffice.

If the main living room already has a permanent heating source such as an air conditioner, it may require a top up to meet the standards. Certain kinds of heaters cannot be utilised to meet the standard as they are either not effective, cost prohibitive to operate and/or unsafe to run.
