Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed for a Timberlea rental property, all Healthy Homes compliance items must be completed inside of 90 days.

From the 1st of July in 2021, when a brand new or renewed lease is entered into on a Timberlea rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards within the period of time expected can lead to penalties of up to $7200. In addition, if the present Healthy Homes Statement of Compliance is not incorporated in a new, renewed or amended tenancy agreement there may be an additional fine or infringement fee.

Anyone can request information about the Healthy Homes Standard and how they relate to the building they live in. If the the property manager doesn’t provide the required information within 21 days from receiving the request, they can be issued an infringement notice and be fined upto $750.

In addition, there’s also a penalty up to $900 for landlords or property managers providing a false or false Healthy Homes Compliance Statement or other information. The person liable for this fine is the one who is named on the lease agreement as being the person who is letting the property, so it could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement needs to be accurate at the time that the tenancy agreement is signed, and ideally it should be kept updated throughout the tenancy as any related work is completed.

It’s also important to keep in mind that a landlord who have multiple rental properties may face additional fines for non-compliance. The most severe penalties are given for the most serious violations, and landlords who own six or more properties could receive fines of up to $50,000, and even as high as $100,000 for hearing claims.

Timberlea Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory for all Timberlea and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records that prove conformance with the Healthy Homes Standards that apply or will be applied throughout the tenancy period of an apartment rental.

From July 1st 2021

  • Property managers and private landlords are required to make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a renewal, new or a change in lease.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Timberlea

Draughts are a major cause of lower temperatures in homes. A humid home is more expensive to heat, which completed jobs in wasting energy and resulting in higher bills.

If a draft can be perceived as a result of gaps or holes, it needs to be sealed.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or the sound of a clear draught emanating from a gap or hole that is, it is probably a gap or hole which requirements sealing in somehow. Cracks or gaps with large gaps must be permanently stopped. Any gaps greater than 3mm that allow air in or out of your house need the sealing. For example, if the open fireplace isn’t in use it can create draughts. This should be sealed off. Property managers and landlords are responsible for ensuring that such draughts are squelched as much as possible.

You don’t require to block gaps or holes which are part of the building. For instance, small gaps around windows and doors may be required to allow movement of the building as the household is heated and cools so that they can still be closed and opened instead of than being stuck. Heating Timberlea

Timberlea rental properties require a reliable source of heat that can warm the principal or the biggest living area to at minimum 18degC, even on the winter coldest days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source needs for it to be permanent (i.e., not portable) with at minimum 1.5 kW of heating capacity, and it must have the minimum requirement for heat capacity for the main living space. A Heating Assessment Tool can be used to determine whether your current fixed heater(s) are adequate or whether you will require to ‘top up’ by adding a second heater. Fires that are open and unflued heaters like portable LPG bottle heaters are not considered to be safe heating options for the Healthy Homes Standard.

If the heating system you offer is an electric heater (or heat pump), it requirements to have a thermostat. This makes your heating more consistent and effective. For most houses, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are required. In some instances, like apartments with small spaces an electric, fixed heater may suffice.

If your main living space already has a central heating source like heat pumps, it might just require an update to meet the standards. Some types of heaters can’t be used to achieve the quality as they are either expensive, inefficient or are unsafe to operate.

Ventilation Timberlea

Insulation Timberlea

Underfloor and ceiling insulation is mandatory on all rental homes since July 1, 2019. Property managers and landlords are required to make sure that the insulation is up to the new quality.
