Fines for Failing to Comply
Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed for a Timberlea rental property, all Healthy Homes compliance tasks have to be completed within 90 days.
Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on a Timberlea rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.
Failure to comply with all of the Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement it could result in an additional fine or violation fee.
Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the property they reside in. If the the property manager doesn’t supply the information requested within 21 days from being informed of the request, they could receive an infringement letter and be fined upto $750.
In addition, there’s also a penalty of approximately $900 for property owners or property managers who provide a false or inaccurate Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is whoever is named on the lease contract as the person who is letting the property and it could be the name of the landlord or the property management company.
All the information on the Compliance Statement needs to be accurate when the tenancy contract is signed, and ideally it is updated throughout the duration of the tenancy when any necessary work related to it’s finished.
It is crucial to keep in mind that a landlord with several rental properties can face additional fines for non-compliance. The highest penalties are handed down for serious breaches, and landlords with six or more properties could be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.
