Healthy Homes Assessment Services

Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords are now required to make sure their Timberlea rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rentals must be completely conforming by the 1st July 2024.

Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on a Timberlea rental property, all Healthy Homes compliance work need to be taken care of within 90 days.

Beginning on July 1st, 2021, when a brand new or renewed lease is entered into on a Timberlea rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy agreement it could result in an additional penalty or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager fails to supply the information requested within 21 days from having received the inquiry, they can receive an infringement letter and could be fined up to $750.

In addition, there is also a fine of up to $900 for landlords or property managers who provide a false or incorrect Healthy Homes Statement of Compliance or other information. The person who is responsible to pay this fine is the one who is named on the lease agreement as the person who is leasing the property out and it could be the landlord’s name or the property management company.

All the information on the Compliance Statement requirements to be accurate when the tenancy contract is executed, and it should be maintained throughout the tenancy as any associated work has been completed.

It’s also important to keep in mind that a landlord who have multiple rental properties may receive greater penalties for non-compliance. The most severe penalties are reserved for the most serious breaches. Landlords with at least six rental properties could be fined up to $50,000, and even as high as $100,000 in the case of hearing claims.

Timberlea Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory throughout Timberlea and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords are required to keep records to demonstrate compliance with each Healthy Homes Standard that apply or will apply during the tenure of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties comply with the Healthy Homes Standard within 90 days of a newly renewed, extended or changed Tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All homes rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Timberlea

Draughts increase the likelihood of lower temperatures in households. A humid house costs more to heat, which means wasting energy and resulting in higher bills.

If a draft can be felt through gaps that are too large or holes the area requirements to be sealed.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or the air is clear from a gap or hole and you are able to feel it, it is likely a crack or hole which requirements sealing in somehow. Large gaps and cracks should be sealed permanently. The gaps that exceed 3mm that let air in or out of the home need to be sealed. In the case of an open fireplace is not in use, it can create draughts. This should be shut from. Landlords and property managers are responsible for ensuring that draughts from the fireplace are removed in the maximum extent imaginable.

There is no require to block off gaps or holes which are part of the construction. For instance, small gaps around doors and windows may be required to allow for movement of the structure when the house heats and cools, to allow them to be shut and opened, rather instead of being stuck. Adequate heaters are important for healthy houses

Heating Timberlea

Rental properties in Timberlea should have a permanent heating source that can heat the main or largest living area to at minimum 18 degrees Celsius, even on the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating requirements to be fixed (i.e. not portable), at least 1.5 Kilowatts in heating capacity, and must meet the minimum required heating capacity in the living area. A Heating Assessment Tool could be used to check if the current installed heater(s) are sufficient or if you’ll need to "top-up" with a new heater. Unflued combustion and open fire heaters such as small portable LPG bottle heaters aren’t considered acceptable heating options in The Healthy Homes Standard.

If the heating system you provide is an electric heater or heat pump it needs to include a thermostat. This makes your heating more consistent and effective. For most properties, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in some cases like small apartments the smaller fixed electric heater may suffice.

If the living area already has a central heating source, like a heat pump, then it might need a top up to be able to meet the standards. Some types of heaters can’t be used to comply with the standard since they’re either costly, not cost-effective to run, and/or unsafe to run.

Ventilation Timberlea

Every window, door or Skylight needs to have the ability of opening to the outside while remaining fixed in an open position to allow for fresh air circulation and ventilation.

The bathrooms in all kitchens and any other room in your property with shower, bath, cooktop or other high moisture-producing item will need suitable extractor fans that can be vented towards the outside. Insulation Timberlea

Ceiling and underfloor insulation has been compulsory to all rental houses since 1 July 2019. All landlords and property managers have to ensure the insulation meets standards that are in line with the latest standard. In some cases, current ceiling insulation, or the insulation of the subfloor space may need to be added or replaced.

A properly insulated home will help to control condensation and reduce the chances of mould and damp, and also makes more easy to allow the house to hold warmth.

Insulation needs to meet the R-values of your area.

The "R" refers to thermal resistance and it is a measurement of how well insulation resists heat flow. The higher the R-value, the higher the standard of insulation.

Timberlea Moisture Ingress & Drainage
