Did you know that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords now have to ensure that their Timberlea rental properties meet the minimum Healthy Homes Standards within 90 days of a new or renewed tenancy and all private rental properties are required to be completely certified by 1 July 2024.

Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed for a Timberlea rental property, all Healthy Homes compliance tasks have to be done within 90 days.

Since the 1st July of 2021, once a new or renewed Tenancy is signed for a Timberlea rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet each of Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy contract, there could be additional penalties or an infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager fails to provide the information requested within 21 days of being informed of the request, they will receive an infringement letter and be fined up to $750.

Additionally, there is also a fine of as much as $900 for landlords or property managers who offer a false or false Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the person who is named on the tenancy agreement as being the person renting the property It could also be the name of the landlord as well as the company that manages the property.

All the information on the Compliance Statement requirements to be current before the tenancy agreement can be signed. It is updated throughout the tenancy as any associated work has been completed.

It is also important to remember that a landlord who manage multiple rental properties may receive more severe penalties for not complying. Timberlea Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory to all Timberlea and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords have to keep records of their the conformance to the Healthy Homes Standard that apply or will apply to the rental property.

Starting 1 July 2021

  • Private landlords and property managers should ensure their rental properties conform according to Healthy Homes Standards within 90 days of a new, renewed , or altered lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must adhere to the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of when the tenancy began.

Draughts may lead to low temperatures inside homes. A cold house costs more to heat, which results in wasting energy and incurring higher costs.

Heating Timberlea

Timberlea rental properties require a reliable source of heating that is able to heat the main or largest living space to a minimum of 18degC, even during the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat needs to remain fixed (i.e., not portable) and at least 1.5 kW in heating capacity, and must meet the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool could be used to determine if the fix heater(s) are sufficient or if you’ll require to "top up" by adding a second heater. Fires that are open and unflued heaters, such as portable LPG bottle heaters aren’t considered to be acceptable heating options under The Healthy Homes Standard.

If the heating system you provide is electric heating or heat source, it should have a thermostat. This makes the heating more consistent and efficient. For most properties, larger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. However, in some cases like small apartment buildings small apartments, a smaller electric fixed heater may be sufficient.

If the main living room is already equipped with a fixed heating source like an air conditioner, it might need an update to be able to meet the standards. Some types of heaters can’t be utilised to meet the quality since they’re either not efficient, cost prohibitive to operate and/or unsafe to run.

All landlords and property managers have to ensure that the insulation meets standards that are in line with the latest standard. In some instances, existing ceiling insulation or insulation in the sub floor space may require to be topped up or replaced.
