Did you have any idea that the Healthy Homes Standards came into effect on the 1st of July 2021? The landlords are now required to make sure that their Timberlea rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any renewal or new tenancy and all private rental properties must be fully in compliance by July 1st 2024.

Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed for a Timberlea rental property, all Healthy Homes compliance items need to be completed inside of 90 days.

As of 1st July 2021, if a new or renewed contract is signed on the Timberlea rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to comply with all of the Healthy Homes Standards inside of the deadlines can result in the possibility of a fine up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not incorporated in an updated, renewed, or revised tenancy contract, there may be an additional fine or violation fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the home they live in. If the property manager is unable to supply the required information within 21 days from having received the inquiry, they can be issued an infringement notice and could be fined up to $750.

Additionally, there is also a penalty up to $900 for property owners or property managers who offer a false or false Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the one who is identified on the tenancy contract as the person renting the property and it could be the name of the landlord, or the property management company.

All information in the Statement of Compliance requirements to be current before the tenancy agreement can be signed. It must be updated through the tenancy period as related work is completed.

It’s crucial to remember that a landlord who own multiple rental properties may receive additional fines for non-compliance. The harshest penalties are given for the most serious violations, and landlords who own six or more properties can be penalised up to $50,000 and as high as $100,000 in hearing claims.

Timberlea Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is compulsory in all Timberlea and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords are required to keep records to demonstrate conformance with each Healthy Homes Standard that apply or will be applied throughout the tenancy period of your rental home.

From July 1st 2021

  • Private landlords and property managers have to make sure their rental properties comply with the Healthy Homes Standard within 90 days of a new, renewed , or altered lease.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All households which are rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of when the tenancy began.

Draughts can lead to dropping temperatures within homes. A damp house will cost more to heat, resulting in wasted energy and incurring higher costs.

Heating Timberlea

Rental properties in Timberlea should have a permanent heating source that can warm the largest or main living space to a minimum of 18degC, even on the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat requirements to be fixed (i.e. not portable) with at minimum 1.5 kW of heating capacity, and it must have the minimum requirement for heat capacity to heat the living space in general. In certain situations, like small apartment buildings, a smaller fixed electric heater may suffice.

If the main living room already has a central heating source, such as an air conditioner, it may need an update to meet the standards. Certain types of heaters cannot be used to meet the standard because they’re expensive, inefficient or unsafe to operate.

Every living space in a rental home must contain at minimum one open doors or windows to offer natural ventilation. Additionally, areas with high moisture areas like kitchens and bathrooms should have an externally vented extractor fan that can eliminate moisture.
