Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on a Timberlea rental property, all Healthy Homes compliance items have to be finished within 90 days.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager is unable to provide the necessary information within 21 days of being informed of the request, they could receive an infringement letter and could be fined up to $750.

Additionally, there is also a penalty of as much as $900 for landlords or property managers providing a false or incorrect Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the person who is named on the tenancy contract as the person renting the property It could also be the landlord’s name or the company that manages the property.

All the information on the Statement of Compliance needs to be up-to-date when the tenancy agreement is signed. It is updated during the entire tenancy, as relevant work gets completed.

It is important to be aware that a landlord who own multiple rental properties may face greater penalties for non-compliance. The highest penalties are given for serious breaches, and landlords with six or more properties could be penalised up to $50,000, or as high as $100,000 in hearings.

Timberlea Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is compulsory throughout Timberlea and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records of their conformance with any Healthy Homes Standard that apply or will be in force throughout the tenancy period of the rental property.

Starting 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All boarder households (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All houses let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of when the tenancy began.

Draughts are a major cause of less temperature in homes. A cold house will cost more to heat, meaning wasting energy and incurring higher costs.

What are unreasonable gaps and holes?

If you can feel external air coming in or an unobstructed draught coming from a gap or hole that is, it’s probably a gap or crack that needs sealing in somehow. Large gaps and cracks should be permanently stopped. Any gaps greater than 3mm that let air into or out into the home require seals. For example, if the open fireplace isn’t being used, it may cause draughts and must be sealed from. Landlords and property managers are responsible for making sure that these draughts are stopped as far as imaginable.

You don’t require to block holes or gaps in the building. For instance, small gaps around doors and windows may be required to allow movement of the structure as the home gets warmer and cooler, so that they can still be shut and opened, rather instead of being stuck. Heating Timberlea

Rental properties in Timberlea require a reliable source of heating which can warm the main or largest living area to at minimum 18degC, even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat needs to remain fixed (i.e. not portable) with at minimum 1.5 kW in heating capacity and have the minimum requirement for heat capacity for the main living room. If the living area is already equipped with a fixed heating source like an air conditioner, it might just need some additional energy in order to comply with the standards. Certain kinds of heaters aren’t able to be used to achieve the quality as they are either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Timberlea

Insulation for underfloor and ceilings is a requirement in all rental homes as of July 1st, 2019. Property managers and landlords should ensure that the insulation meets this new standard.
