Fines for Failing to Comply
Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Thorndon rental property, all Healthy Homes compliance items need to be finished within 90 days.
From the 1st of July in 2021, if a new, renewed or varied contract is signed on the Thorndon rental property, all Healthy Homes compliance work must be taken care of within 90 days.
Failure to adhere to all of the Healthy Homes Standards by the end of the anticipated timeframe could result in penalties of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement there may be additional penalties or an infringement fee.
Any tenant may request details about the Healthy Homes Standard and how they relate to the building they reside in. If the property manager is unable to provide the necessary information within 21 days from receiving the request, they could be issued an infringement notice and be fined as high as $750.
Furthermore, there’s an additional fine of as much as $900 for landlords or property managers who provide a false or false Healthy Homes Compliance Statement or any other information. The person liable to pay this fine is the one who is identified on the tenancy agreement as being the person who is letting the property It could also be the name of the landlord or the company that manages the property.
All information in the Statement of Compliance needs to be correct at the time that the tenancy agreement is signed. It should be maintained throughout the duration of the tenancy when any necessary work related to it is finished.
It’s also crucial to keep in mind that a landlord who own multiple rental properties could face more severe penalties for not complying. The harshest penalties are reserved only for serious breaches. Landlords with six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearing claims.
