Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for a Thorndon rental property, all Healthy Homes compliance items need to be taken care of inside of 90 days.

From the 1st of July in 2021, when a new or renewed lease is entered into on a Thorndon rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Inability to adhere to each of Healthy Homes Standards inside of the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or amended tenancy agreement it could result in an additional fine or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager does not supply the required information within 21 days of getting the notice, the tenant will be issued an infringement notice and be fined up to $750.

In addition, there’s also a penalty as much as $900 for landlords and property managers who have provided a false or false Healthy Homes Statement of Compliance or any other information. The person who is liable to pay this fine is the one who is identified on the tenancy contract as the person renting the property which could be the name of the landlord or the property management company.

All the information on the Statement of Compliance requirements to be current before the tenancy agreement can be signed. It should be maintained through the tenancy period as relevant work gets completed.

It’s important to note that landlords with several rental properties can face more severe penalties for not complying. The most severe penalties are reserved for the most serious breaches. Landlords with six or more properties can receive fines of up to $50,000, or as high as $100,000 in the case of hearing claims.

Healthy homes matter

What are the reasons why Healthy Homes Compliance important?

About 1 in 3 households rent from New Zealand and Thorndon, and research has shown that these rental homes are likely to be colder, older, are not as effective heating, and generally have lower quality than homes that are owned by the owner.

Moldy, damp and cold homes can have negative well-being outcomes, especially for illnesses such as colds and influenza, asthma, and cardiovascular issues. In addition, people who report at least four key home quality issues often suffer from less satisfaction in their lives and lower psychological well-being.

Improve the quality of Thorndon rental property will allow tenants to enjoy improved physical and mental health, and lessen the disruption to work, learning and living due to diseases. Your investment will be protected from mildew, mould and damp-related damage, which results in lower maintenance costs in the long run.

Unreasonable Gaps & Holes

Draught Stopping Thorndon

Draughts can lead to less temperature in households. A cold house costs more to heat, resulting in wasted energy and incurring higher costs.

If a draught is felt from unreasonable gaps or holes or holes, it requirements to be sealed.

What are unreasonable gaps and holes?

If you can feel external air entering or the sound of a clear draught emanating from a hole or gap, then it is likely a crack or an opening that needs sealing in somehow. Cracks or gaps with large gaps must be sealed permanently. The gaps that exceed 3mm that allow air in or out of your house need to be sealed. For instance, if an open fireplace isn’t in use it could cause draughts, and must be sealed off. Landlords and property managers are responsible for making sure such draughts are eliminated whenever imaginable.

There is no require to block holes or gaps that are part of the construction. For example, tiny gaps around windows and doors may be required to allow for the movement of the structure when the house warms and cools so that they can still be closed and opened rather than sticking. We will inspect all windows and doors during your Healthy Homes assessment of your rental property.

Heating Thorndon

Thorndon rental properties must have a fixed source of heat that can warm the principal or the biggest living area to at minimum 18 degrees Celsius, even on the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heating requirements to be fixed (i.e., not portable) with at minimum 1.5 Kilowatts in heating capacity and have the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool could be used to check if the current permanent heater(s) are adequate or whether you will require to ‘top up’ by adding a second heater. Fires that are open and unflued heaters, such as portable LPG bottle heaters are not considered to be acceptable heating options in the Healthy Homes Standard.

If the heating you provide is an electric heater or heat source, it should be equipped with a thermostat. This will make the heating more reliable and efficient. For the majority of homes, bigger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are necessary. However, in certain instances such as small apartments an electric, fixed heater may suffice.

If your living space already has a central heating source such as the heat pump, it may require an update to make sure it meets the requirements. Certain kinds of heaters cannot be utilised to meet the standard since they’re either not effective, cost prohibitive to operate and/or unhealthy to run.

Ventilation Thorndon

Each living space within the rental property should include at least one open door or window to provide natural airflow. In addition, high moisture areas like kitchens and bathrooms must have a suitable externally vented extractor fan that can get rid of moisture.

A ventilation standard is all about understanding how the dry atmosphere is easier to heat, and that the property that is properly ventilated is less likely to grow mould and damp.

Bedrooms, living rooms, dining rooms, and kitchens are considered liveable spaces. Connecting spaces like the hallway aren’t considered living spaces and therefore do not require an opening window or door.

Each window, door , or Skylight requirements for them to be in a position of opening to the outside and remain set in an opening position, allowing the circulation of fresh air and ventilation.

The bathrooms in all kitchens and any other area in your home with a bath, shower and cooktop or another humidity-generating items will require suitable extractor fans that vent to the outdoors. We offer a Healthy Homes Assessment service will verify that there is enough ventilation in each livable space and will also check for the proper extractor fans in high moisture areas.

Insulation Thorndon

Ceiling and underfloor insulation has been compulsory on all rental homes since July 1, 2019. All landlords and property managers should ensure the insulation meets this new standard. In some instances, old ceiling insulation as well as insulation within the sub floor space may require to be replaced or replaced.

A well-insulated house will reduce the risk of condensation, and decrease the risk of dampness and mould, as well as making an easier task to allow the household to retain warmth.

Insulation needs to be in compliance with the R-values that are appropriate for your region.

The "R" stands for thermal resistance, and is a gauge of how well insulation withstands heat flow. The greater the R-value, the more effective the insulation.

  • Zone 1 - Auckland & Northland Ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – the remainder of North Island except Taupo and the Central Plateau – ceiling R 2.9 and underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 and underfloor R 1.3

Thorndon Moisture Ingress & Drainage

Making sure your rental property is protected from dampness isn’t just about the inside but you must make sure there is somewhere for surface as well as groundwater to move, and also stop it from getting into the building. When it is about damp and water, it is usually not apparent that it could become a major issue, causing damage to your investment and harming the tenant’s health.

Rental properties need to have efficient drainage for the removal of floodwaters, surface water and ground water, including an appropriate runoff or outfall. Making sure the water has a location to go and that it doesn’t get sucked into buildings is a vital aspect of making sure your property is dry.

In addition to a drainage system to avoid moisture ingress, if your apartment has an enclosed gap between floorboards and the soil, a ground-water barrier must be installed if it’s reasonably practicable to install it.

Ground moisture barriers are typically a polythene sheet laid over the ground to stop any moisture in the ground from getting into the structure. It also helps in preventing moisture damage to the underfloor insulation.
