Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on a Thorndon rental property, all Healthy Homes compliance work have to be done by the end of 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on the Thorndon rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet each of Healthy Homes Standards inside of the period of time expected can lead to an amount of $7200. The person responsible for this fine is the person who is listed on the tenancy agreement as being the person renting the property which could be the name of the landlord or the property management company.

All the information on the Statement of Compliance requirements to be accurate when the tenancy contract is signed. It should be kept updated throughout the tenancy as any relevant work gets completed.

It’s crucial to note that landlords who manage several rental properties can face additional fines for non-compliance. The most severe penalties are reserved for serious violations, and landlords who own more than six properties could receive fines of up to $50,000, and as much as $100,000 for hearing claims.

When Do I require to be in compliance with requirements of the Healthy Homes Standards?

Thorndon Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory in all Thorndon and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove the compliance with each Healthy Homes Standard that apply or will apply throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Property managers and private landlords must ensure their rental properties comply with the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenancy.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All households rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

What are unjustifiable gaps or holes?

If you can feel external air getting in, or see an unobstructed draught coming out of a hole or gap and you are able to feel it, it is likely a crack or hole which requirements sealing in somehow. Cracks or gaps with large gaps must be fixed permanently. Gaps greater than 3mm that allow air to enter or exit into your home require sealing. For example, if an open fireplace is not in use, it could cause draughts, and should be blocked off. Landlords and property managers are responsible for ensuring that such draughts are squelched as far as imaginable.

Adequate heaters are crucial to ensure healthy houses

Heating Thorndon

Rental properties in Thorndon must have a fixed source of heat that can heat the largest or main living room to at least 18degC, even during the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat needs to remain fixed (i.e. not portable) and at minimum 1.5 horsepower in capacity and have the minimum capacity for heating required in the living area. A Heating Assessment Tool can be used to determine if the current fixed heater(s) are sufficient or whether you will require to "top-up" with an additional heater. Open fires and unflued combustion heaters like small portable LPG bottle heaters aren’t considered acceptable heating options under the Healthy Homes Standard.

If the heating you offer is an electric heater or heat pump it should have a thermostat. This will make your heating more consistent and efficient. For most properties, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters will be required. In certain situations, like small apartment buildings the smaller fixed electric heater may suffice.

If your living space already has a permanent heating source such as a heat pump, then it might need a top up to be able to meet the standards. Certain kinds of heaters cannot be used to achieve the standard because they’re expensive, inefficient and/or unsafe to run.

Ventilation Thorndon
