Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed contract is signed on a Thorndon rental property, all Healthy Homes compliance tasks have to be finished within 90 days.

As of 1st July 2021, once a new or renewed Tenancy is signed for a Thorndon rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with any of the Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement there could be additional penalties or an infringement fee.

Anyone can request details regarding the Healthy Homes Standard and how they are related to the house they reside in. If the the property manager doesn’t supply the information requested within 21 days of having received the inquiry, they can be issued an infringement notice and be fined as high as $750.

Furthermore, there’s also a penalty of up to $900 for property owners or property managers who have provided a false or misleading Healthy Homes Compliance Statement or any other information. The person liable for this fine is the one who is named on the tenancy agreement as the person who is renting the property and it could be the name of the landlord or the property management company.

The information contained in the Statement of Compliance requirements to be correct when the tenancy contract is signed. It is updated through the tenancy period as associated work has been completed.

It is important to note that a landlord who manage several rental properties can face more severe penalties for not complying. The highest penalties are given only for serious breaches, and landlords with six or more properties can receive fines of up to $50,000, and as much as $100,000 in hearing claims.

When do I require to meet the Healthy Homes Standards?

Thorndon Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is mandatory for all Thorndon and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included with any renewed, new or amended tenancy agreement.
  • Landlords and property managers must keep records that prove the conformance to each Healthy Homes Standard that apply or will be applied during the tenancy of your rental home.

Starting 1 July 2021

  • Property managers and private landlords have to ensure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must meet the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Adequate heaters are important for healthy houses

Heating Thorndon

Thorndon rental properties should have a permanent heating source which can warm the main or largest living room to at least 18degC even on the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source requirements to be fixed (i.e., not portable), at minimum 1.5 horsepower in capacity, and it must have the minimum capacity for heating required for the main living space. A Heating Assessment Tool could be used to check if the installed heater(s) are adequate or if you’ll need to top up with an additional heater. Unflued combustion and open fire heaters, such as the portable LPG bottle heaters aren’t considered acceptable heating options for The Healthy Homes Standard.

If the heating that you offer is electric heating or heat pump then it must include a thermostat. This makes the heating more uniform and efficient. For the majority of houses, bigger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. However, in certain instances like apartments with small spaces small apartments, a smaller electric fixed heater may be sufficient.

If your living space already has a permanent heating source like heat pumps, it could need an update to be able to meet the standards. Some types of heaters can’t be utilised to meet the quality since they’re either inefficient, unaffordable to operate and/or unhealthy to run.
