Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed for a Thorndon rental property, all Healthy Homes compliance items have to be completed within 90 days.

From the 1st of July in 2021, if a new or renewed Tenancy is signed for the Thorndon rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet all of the Healthy Homes Standards within the deadlines can result in penalties of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or revised tenancy agreement there may be additional penalties or an infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they live in. If the property manager is unable to provide the information requested within 21 days of being informed of the request, they could receive an infringement notification and be fined up to $750.

In addition, there’s also a penalty approximately $900 for property owners or property managers providing a false or incorrect Healthy Homes Compliance Statement or any other information. The person responsible for this fine is the one who is named on the lease agreement as the person who is renting the property which could be the name of the landlord or the company that manages the property.

The information contained in the Compliance Statement needs to be accurate at the time that the tenancy agreement is completed, and should be kept updated during the entire tenancy, as necessary work related to it’s finished.

It’s crucial to note that landlords who manage several rental properties can face more severe penalties for not complying. The harshest penalties are reserved for severe breaches, and landlords with more than six properties could be fined as high as $50,000, or as high as $100,000 for hearing claims.

When do I need to be in compliance with the Healthy Homes Standards?

Thorndon Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is required throughout Thorndon and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate conformance with the Healthy Homes Standard that apply or will be applicable throughout the tenancy period of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords should ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All homes which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Rental properties in Thorndon need to have a stable source of heat that is able to heat the living area to at minimum 18 degrees Celsius, even on the winter coldest days. Ventilation Thorndon

Insulation for underfloor and ceilings is required for all rent houses since July 1, 2019. Property managers and landlords are required to ensure that the insulation is up to this new standard.
