Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed on a Thorndon rental property, all Healthy Homes compliance items must be taken care of inside of 90 days.

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Thorndon rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to adhere to all of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. All information in the Statement of Compliance requirements to be accurate when the tenancy contract is signed, and ideally it should be maintained throughout the duration of the tenancy when any related work is completed.

It is crucial to note that a landlord with multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are handed down for the most serious violations, and landlords who own more than six properties could be fined up to $50,000, and as much as $100,000 in the case of hearing claims.

What time Do I need to be in compliance with requirements of the Healthy Homes Standards?

Thorndon Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement in all Thorndon and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the conformance to the Healthy Homes Standard that apply or will apply to an apartment rental.

From 1 July 2021

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Heating Thorndon

Rental properties in Thorndon need to have a stable source of heating which can warm the largest or main living space to a minimum of 18degC even on the most coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental well-being.

In some instances, like small apartments, a smaller fixed electric heater might be enough.

If the main living room is already equipped with a fixed heating source such as an air conditioner, it could require some additional energy to make sure it meets the requirements. Certain kinds of heaters cannot be used to meet the standard since they’re either not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Thorndon
