Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed tenancy is signed for a Te Marua rental property, all Healthy Homes compliance tasks have to be completed by the end of 90 days.

Beginning on July 1st, 2021, once a new or renewed lease is entered into on a Te Marua rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

The harshest penalties are handed down for severe violations, and landlords who own more than six properties could be penalised up to $50,000, or as high as $100,000 in the case of hearing claims.

Te Marua Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is compulsory to all Te Marua and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records to demonstrate compliance with any Healthy Homes Standards that apply or will be in force throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties comply in accordance with Healthy Homes Standards within 90 days of a new, renewed or varied tenant.
  • All boarder households (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must adhere to the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All households rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts are a major cause of less temperature in homes. A humid house is more expensive to heat, which results in wasting energy and resulting in higher bills.
