Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed on a Strathmore Park rental property, all Healthy Homes compliance tasks need to be finished inside of 90 days.

Beginning on July 1st, 2021, once a new or renewed lease is entered into on the Strathmore Park rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to meet one of the Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t included within a new, renewed or amended tenancy agreement it could result in an additional fine or violation fee.

All information in the Statement of Compliance requirements to be up-to-date before the tenancy agreement can be completed, and should be kept updated throughout the duration of the tenancy when any necessary work related to it is finished.

It is important to remember that landlords who own multiple rental properties could face additional fines for non-compliance. The highest penalties are handed down for severe violations, and landlords who own six or more properties can receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

When Do I need to be in compliance with The Healthy Homes Standards?

Strathmore Park Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement for all Strathmore Park and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that prove conformance with each Healthy Homes Standards that apply or will be applied to their rental properties.

Starting 1 July 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed lease.

Adequate heaters are important for healthy houses

Heating Strathmore Park

Rental properties in Strathmore Park must have a fixed source of heating which can warm the main or largest living area to at minimum 18degC, even on the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heating needs that it be permanently fixed (i.e. not portable) that is, at least 1.5 Kilowatts in heating capacity and have the minimum capacity for heating required for the main living space. In some instances, like small apartments, a smaller fixed electric heater may be sufficient.

If your living space is already equipped with a fixed heating source, like an air conditioner, it may need some additional energy to meet the standards. Certain types of heaters cannot be used to achieve the quality since they’re either expensive, inefficient or are unsafe to operate.

Ventilation Strathmore Park

Every living space in a rental property must have at least one opening door or window to offer natural ventilation. In addition, humid areas like kitchens and bathrooms need to have an externally vented extractor fan that can take moisture away.

Insulation Strathmore Park

The insulation of the ceiling and underfloor is mandatory for all rent houses since 1 July 2019. All landlords and property managers should make sure that the insulation is in line with standards that are in line with the latest quality.
