Fines for Failing to Comply

Failure to comply with each of Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy agreement there could be additional penalties or an infringement fee.
Anyone can request details regarding the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager does not supply the required information within 21 days from having received the inquiry, they will receive an infringement notice and be fined up to $750.
In addition, there is also a penalty as much as $900 for property owners or property managers who have provided a false or misleading Healthy Homes Compliance Statement or information. The person who is liable for this fine is the person who is named on the lease contract as the person renting the property It could also be the name of the landlord or the company that manages the property.
All information in the Statement of Compliance needs to be correct at the time that the tenancy agreement is signed, and ideally it should be maintained through the tenancy period as necessary work related to it is finished.
It’s important to note that a landlord with multiple rental properties could face more severe penalties for not complying. The harshest penalties are handed down for severe violations. Those who have at least six rental properties could be fined as high as $50,000 and as high as $100,000 in the case of hearing claims.
