As of 1st July 2021, when a brand new, renewed or varied Tenancy is signed for a Strathmore Park rental property, all Healthy Homes compliance work must be completed within 90 days.
Failure to comply with any of the Healthy Homes Standards inside of the anticipated timeframe could result in an amount of $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement, it could result in additional penalties or an infringement fee.
Any tenant may request information regarding the Healthy Homes Standard and how they relate to the home they live in. If the landlord or the property manager doesn’t provide the required information within 21 days of being informed of the request, they will receive an infringement notice and be fined up to $750.
In addition, there is also a fine of approximately $900 for landlords and property managers who have provided a false or misleading Healthy Homes Compliance Statement or any other information. The person responsible for this fine is the one who is identified on the tenancy agreement as being the person who is letting the property which could be the name of the landlord or the company that manages the property.
The information contained in the Statement of Compliance requirements to be correct when the tenancy agreement is executed, and it is updated through the tenancy period as necessary work related to it is finished.
It is also crucial to remember that landlords with several rental properties can face even higher fines for non-compliance. The highest penalties are reserved for the most serious breaches, and landlords with six or more properties can be fined as high as $50,000, and even as high as $100,000 in the case of hearing claims.
