Fines for Failing to Comply
As of 1st July 2021, when a new, renewed or varied tenancy is signed for a Strathmore Park rental property, all Healthy Homes compliance work have to be taken care of within 90 days.
From the 1st of July in 2021, when a brand new, renewed or varied Tenancy is signed for the Strathmore Park rental property, all Healthy Homes compliance work must be completed by the end of 90 days.
Failure to comply with any of the Healthy Homes Standards inside of the period of time expected can lead to the possibility of a fine up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy contract, there may be an additional penalty or infringement fee.
Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the building they are living in. If the the property manager doesn’t provide the necessary information within 21 days from having received the inquiry, they could receive an infringement notification and be fined upto $750.
In addition, there is an additional fine of approximately $900 for landlords or property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is responsible to pay this fine is the one who is named on the lease contract as the person letting the property out and it could be the landlord’s name or the company that manages the property.
The information contained in the Statement of Compliance needs to be accurate before the tenancy agreement can be signed. It should be kept updated during the entire tenancy, as related work is completed.
It is also important to note that landlords who own multiple rental properties could face additional fines for non-compliance. The harshest penalties are handed down for the most serious breaches. Landlords with six or more properties can be fined as high as $50,000, and even as high as $100,000 in hearing claims.
