Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied contract is signed on a Strathmore Park rental property, all Healthy Homes compliance work have to be taken care of by the end of 90 days.

It is important to be aware that a landlord with multiple rental properties may face even higher fines for non-compliance. The harshest penalties are reserved for severe breaches. Landlords with more than six properties could be fined as high as $50,000, and even as high as $100,000 for hearing claims.

Strathmore Park Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory in all Strathmore Park and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove compliance with any Healthy Homes Standard that apply or will apply throughout the tenancy period of the rental property.

From July 1st 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must adhere to the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All houses let through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of when the tenancy began.

Proper heating is crucial to ensure well-being houses

Heating Strathmore Park

Rental properties in Strathmore Park need to have a stable heating source that can warm the largest or main living room to at least 18degC, even during the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental well-being.

In certain situations, like small apartment buildings the smaller fixed electric heater could be enough.

If the living area already has a fixed heating source, such as the heat pump, it might just require an update in order to comply with the standards. Certain types of heaters cannot be utilised to meet the standard because they’re expensive, inefficient or are unsafe to operate.
