Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Strathmore Park rental property, all Healthy Homes compliance tasks need to be taken care of within 90 days.

All information in the Compliance Statement needs to be accurate when the tenancy contract is signed, and ideally it must be updated during the entire tenancy, as necessary work related to it’s finished.

It is also crucial to be aware that landlords who have multiple rental properties could face more severe penalties for not complying. The most severe penalties are given for severe breaches, and landlords with more than six properties could be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

Strathmore Park Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory to all Strathmore Park and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate compliance with the Healthy Homes Standards that apply or will be applied during the tenancy of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers should make sure their rental properties conform to the Healthy Homes Standards within 90 days of any new, renewed or varied tenant.

Heating Strathmore Park

Rental properties in Strathmore Park must have a fixed source of heat that can heat the principal or the biggest living space to a minimum of 18degC, even during the coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source needs to be fixed (i.e., not portable) that is, at least 1.5 Kilowatts in heating capacity and have the minimum requirement for heat capacity in the living area. In most homes, larger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In certain situations, like apartments with small spaces an electric, fixed heater could be enough.

If your living space already has a fixed heating source such as a heat pump, then it may need an update to be able to meet the standards. Certain types of heaters cannot be used to meet the standard because they’re costly, not cost-effective to run, or unsafe to operate.

Ventilation Strathmore Park

Insulation Strathmore Park

Underfloor and ceiling insulation is required on all rental homes since 1 July 2019. Property managers and landlords must ensure that the insulation meets current quality. In some instances, existing ceiling insulation or insulation in the subfloor space may need to be filled with or replaced.

A well-insulated property will reduce the risk of condensation and reduce the chances of mould and damp, and also makes it easier to the household to retain the heat.
