Did you not know that Healthy Homes Standards came into effective on July 1st, 2021? Landlords are now required to ensure that their Strathmore Park rental properties meet the minimum Healthy Homes Standards within 90 days of any renewed or new tenancy and all private rental properties are required to be fully conforming by the 1st July 2024.

Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed on a Strathmore Park rental property, all Healthy Homes compliance items have to be completed within 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied lease is entered into on the Strathmore Park rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Inability to adhere to all of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not incorporated within an updated, renewed, or revised tenancy contract, there may be an additional penalty or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager is unable to provide the necessary information within 21 days of having received the inquiry, they could receive an infringement letter and could be fined up to $750.

Additionally, there is also a penalty of as much as $900 for landlords and property managers that provide false or misleading Healthy Homes Compliance Statement or any other information. The person who is responsible to pay this fine is the one who is named on the lease contract as the person letting the property out, so it could be the landlord’s name or the property management company.

All information in the Compliance Statement requirements to be accurate before the tenancy agreement can be signed. It is updated through the tenancy period as relevant work gets completed.

It is crucial to keep in mind that a landlord who own multiple rental properties may face greater penalties for non-compliance. The highest penalties are given for severe violations. Those who have at least six rental properties could be fined up to $50,000 and as high as $100,000 for hearing claims.

Strathmore Park Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is required throughout Strathmore Park and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the conformance to each Healthy Homes Standard that apply or will be applied during the tenancy of an apartment rental.

From July 1st 2021

  • Property managers and private landlords must ensure their rental properties conform to the Healthy Homes Standards within 90 days of a new, renewed or varied tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Draughts can lead to lower temperatures in homes. A draughty house is more expensive to heat, which means wasting money and energy.

What are unreasonable gaps and holes?

If you are able to feel external air coming in or the air is clear out of a hole or gap that is, it’s likely to be a gap or hole which needs sealing in the way you can. Cracks or gaps with large gaps must be permanently stopped. Any gaps greater than 3mm that let air into or out of the home need sealing. For example, if the open fireplace is not in use, it can create draughts. This should be sealed from. Property managers and landlords are accountable for ensuring that such draughts are squelched whenever possible.

You don’t need to block off holes or gaps in the building. For example, tiny gaps around doors and windows might be necessary to allow for movement within the structure when the home is heated and cools so that they are able to be opened and closed rather instead of being stuck. Heating Strathmore Park

Rental properties in Strathmore Park should have a permanent source of heat that can heat the living area to at minimum 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating requirements to be fixed (i.e., not portable) that is, at minimum 1.5 Kilowatts in heating capacity, and meet the minimum required heating capacity for the main living space. For most homes, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in certain instances like apartments with small spaces small apartments, a smaller electric fixed heater might be enough.

If your main living space already has a fixed heating source like heat pumps, it may need some additional energy to make sure it meets the requirements. Certain kinds of heaters cannot be used to meet the standard because they’re not effective, cost prohibitive to operate or unsafe to operate.

Ventilation Strathmore Park

Each liveable space in the rental property should have at least one openable window or exterior door to provide natural airflow. Furthermore, moist areas such as kitchens and bathrooms should be equipped with an venting fan outside to eliminate moisture.

The insulation of the ceiling and underfloor is required on all rental homes from 1 July 2019. Property managers and landlords must ensure that the insulation is up to standards that are in line with the latest quality. In certain situations, the existing ceiling insulation or insulation in the sub floor space might need to be filled with or replaced.
