Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed for a Silverstream rental property, all Healthy Homes compliance work need to be done within 90 days.

Silverstream Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is mandatory to all Silverstream and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the conformance to any Healthy Homes Standard that apply or will be applied during the tenure of your rental home.

From July 1st 2021

  • Private landlords and property managers should make sure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a renewal, new or a change in tenant.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

In some instances, like small apartments, a smaller fixed electric heater could be enough.
