Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed for a Silverstream rental property, all Healthy Homes compliance items need to be taken care of inside of 90 days.

Since the 1st July of 2021, when a new or renewed Tenancy is signed for a Silverstream rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to adhere to each of Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. It’s also important to note that a landlord with several rental properties can face additional fines for non-compliance. The highest penalties are reserved for the most serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

Silverstream Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is required throughout Silverstream and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records to demonstrate the conformance to each Healthy Homes Standard that apply or will be in force throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Property managers and private landlords should ensure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of any renewal, new or a change in Tenancy.

Starting 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Silverstream

Silverstream rental properties need to have a stable heating source that can heat the living area to at minimum 18degC, even on the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heating requirements for it to be permanent (i.e. not portable) and at minimum 1.5 horsepower in capacity and have the minimum heating capacity needed to heat the living space in general. For most properties, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters will be required. However, in certain instances such as small apartments an electric, fixed heater may be sufficient.

If the main living room already has a permanent heating source like heat pumps, it might just need some additional energy to be able to meet the standards. Some types of heaters can’t be used to achieve the standard since they’re either expensive, inefficient or unsafe to operate.
