Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed for a Silverstream rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied lease is entered into on the Silverstream rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to any of the Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement it could result in an additional fine or violation fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager is unable to supply the required information within 21 days from having received the inquiry, they could receive an infringement letter and be fined up to $750.

In addition, there is also a penalty approximately $900 for landlords or property managers who have provided a false or false Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the one who is named on the lease agreement as being the person renting the property, so it could be the name of the landlord, or the company that manages the property.

All information in the Statement of Compliance needs to be correct before the tenancy agreement can be signed, and ideally it is updated through the tenancy period as related work is completed.

It’s important to keep in mind that a landlord who own multiple rental properties could face more severe penalties for not complying. The most severe penalties are reserved for serious breaches. Landlords with six or more properties could be fined up to $50,000, and even as high as $100,000 in hearing claims.

Silverstream Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 June 2021

  • Underfloor and ceiling insulation is compulsory to all Silverstream and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records that demonstrate the conformance to all Healthy Homes Standard that apply or will be applied during the tenancy of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers should ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any renewal, new or a change in tenant.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All homes let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Proper heating is important for well-being houses

Heating Silverstream

Rental properties in Silverstream require a reliable source of heating that can heat the main or largest living area to at minimum 18 degrees Celsius, even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

Underfloor and ceiling insulation is mandatory for all rent houses since July 1, 2019. All landlords and property managers should make sure that the insulation meets this new quality.
