Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Seaview rental property, all Healthy Homes compliance work need to be finished by the end of 90 days.

Tenancies signed between 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory in all Seaview and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the conformance to any Healthy Homes Standards that apply or will be applicable throughout the tenancy period of the rental property.

From July 1st 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied lease.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider boarder household tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All homes let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Seaview

Rental properties in Seaview must have a fixed heating source that is able to heat the largest or main living room to at least 18degC, even during the coldest days of the year. If the living area already has a fixed heating source, such as a heat pump, then it may need a top up in order to comply with the standards. Certain types of heaters cannot be used to meet the quality because they’re costly, not cost-effective to run, or unsafe to operate.

Ventilation Seaview
