Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied contract is signed on a Seaview rental property, all Healthy Homes compliance tasks must be completed by the end of 90 days.

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on a Seaview rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to adhere to any of the Healthy Homes Standards within the anticipated timeframe could result in a fine of up to $7200. The person who is liable for this fine is the person who is named on the tenancy agreement as the person who is letting the property out, so it could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance needs to be current before the tenancy agreement can be completed, and should be maintained throughout the tenancy as any related work is completed.

It’s also important to keep in mind that a landlord with multiple rental properties may receive more severe penalties for not complying. The highest penalties are reserved for severe violations. Those who have six or more properties could be fined as high as $50,000, and even as high as $100,000 for hearing claims.

Seaview Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory for all Seaview and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
