Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed for a Porirua rental property, all Healthy Homes compliance tasks have to be taken care of inside of 90 days.

Beginning on July 1st, 2021, when a new or renewed tenancy is signed on the Porirua rental property, all Healthy Homes compliance work must be completed within 90 days.

Inability to adhere to any of the Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or amended tenancy agreement it could result in additional penalties or an infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager does not provide the information requested within 21 days of getting the notice, the tenant could receive an infringement notification and could be fined up to $750.

Additionally, there is also a penalty approximately $900 for landlords or property managers providing a false or misleading Healthy Homes Statement of Compliance or other information. The person liable to pay this fine is the one who is listed on the tenancy contract as the person renting the property, so it could be the name of the landlord or the property management company.

All information in the Compliance Statement requirements to be current when the tenancy contract is completed, and should be maintained during the entire tenancy, as necessary work related to it is finished.

It’s important to note that a landlord who have multiple rental properties could face even higher fines for non-compliance. The harshest penalties are reserved for severe breaches, and landlords with six or more properties could be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

Healthy homes matter

What are the reasons why Healthy Homes Compliance so Important?

About 1 in 3 households rent in New Zealand and Porirua, and research suggests that rental houses are most likely to be colder, older, are not as efficient heating and tend to be of poorer quality than owner occupied properties.

Moldy, damp and cold houses are associated with negative health outcomes, especially for illnesses like colds, asthma, as well as cardiovascular issues. Furthermore, people who have reported four or more major housing quality problems frequently have lower levels of satisfaction with life and a decrease in mental wellbeing.

Enhancing the quality of Porirua rental property will allow tenants to enjoy improved physical and mental health and minimise the disruptions to their work, education and daily life due to health issues. Your investment is also better protected from mildew, mould and damp damages, which means less maintenance costs in the long run.

The Healthy Homes Standard is a list of the specific and minimum standards for heating, insulation, Ventilation, Moisture Ingress and Drainage, and Draught Control within Porirua rental properties.

Unreasonable Gaps & Holes

Draught Stopping Porirua

Draughts are a major cause of less temperature in houses. A humid house is more expensive to heat, resulting in wasted energy and incurring higher costs.

If a draught could be noticed from gaps that are not adequate or holes that it needs to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air entering or a clear draught out of a hole or gap and you can feel it, it is most likely a gap or hole which requirements sealing in some way. Cracks or gaps with large gaps must be fixed permanently. Cracks that are greater than 3mm and allow air in or out from the home need the sealing. In the case of an open fireplace isn’t in use it may cause draughts and should be blocked from. Property managers and landlords are responsible for making sure that draughts from the fireplace are removed as far as imaginable.

There is no need to block holes or gaps in the construction. For example, tiny gaps around doors and windows could be required to allow for movement within the building when the household heats and cools, so that they are able to be closed and opened instead of than securing. We will inspect every window and door during your Healthy Homes assessment of your rental property.

Heating Porirua

Porirua rental properties should have a permanent heating source which can warm the largest or main living area to at minimum 18degC, even on the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

The heating source needs for it to be permanent (i.e. not portable) and at minimum 1.5 kW in heating capacity and have the minimum capacity for heating required in the living area. A Heating Assessment Tool could be used to check if the current fixed heater(s) are adequate or if you’ll require to "top-up" with an additional heater. Fires that are open and unflued heaters, such as portable LPG bottle heaters are not considered to be acceptable heating options for Healthy Homes Standard. Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump, it should be equipped with an thermostat. This will make the heating more reliable and effective. For the majority of houses, bigger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. In some instances, like apartments with small spaces small apartments, a smaller electric fixed heater may be sufficient.

If your living space is already equipped with a fixed heating source like an air conditioner, it might just need an update to make sure it meets the requirements. Certain kinds of heaters aren’t able to be used to meet the standard as they are either not efficient, cost prohibitive to operate or are unsafe to operate.

Ventilation Porirua

Each living space within a rental home must include at least one open door or window to offer natural ventilation. In addition, high moisture areas such as kitchens or bathrooms should have an venting fan outside to remove moisture.

The ventilation standard is all about acknowledging it is that the dry atmosphere is much easier to heat, and that an apartment that is well-ventilated will be less prone to developing mould and damp.

Bedrooms, living spaces, kitchens and dining rooms are considered liveable spaces. Connecting spaces like the hallway aren’t liveable and don’t require an opening door or window.

Each door, window or the skylight needs to have the ability to open up to the outside while remaining set in an opening position to allow to circulate fresh air as well as ventilation.

Bathrooms, kitchens, and every other room of your home with a bath, shower cooker or any other humidity-generating items will need appropriate extractor fans that are vented out to the outside. We offer a Healthy Homes Assessment service will make sure there is sufficient ventilation in each livable space with the right extractor fan in areas of high moisture.

Insulation Porirua

The insulation of the ceiling and underfloor is required in all rental houses as of July 1st, 2019. All landlords and property managers should ensure that the insulation is in line with the new quality. In some instances, old ceiling insulation as well as insulation within the subfloor space might require to be added or replaced.

A well-insulated property will help to control condensation and lower the chance of mould and dampness, and will also make it easier to the household to retain the heat.

Insulation needs to be in compliance with the R-values that are appropriate for your region.

The "R" is a symbol for thermal resistance and is a measure of how well insulation withstands heat flow. The greater the R-value, the better the insulation.

  • Zone 1 - Auckland & Northland Ceiling R 2.9 in the underfloor, 1.3
  • Zone 2 – all of the North Island except Taupo and the Central Plateau – ceiling R 2.9 and underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 (underfloor R 1.3

Porirua Moisture Ingress & Drainage

Keeping your rental property safe from water damage isn’t only about the inside of the building it’s also about the outside. You must ensure there is somewhere for surface or ground water, and prevent it from getting inside. When it comes to moisture and damp it is usually those concerns that you aren’t aware of that can cause a lot of trouble and end up causing the property to suffer and affecting the tenant’s health.

Rental properties need to have efficient drainage for the removal of storm water, surface water and groundwater, with an appropriate runoff or outfall. Making sure that water has a proper place to go, and it can’t linger underneath the buildings is a vital aspect of making sure your property is dry.

Alongside an irrigation system to stop the ingress of moisture, if your rental is enclosed between floorboards and ground, a ground water barrier must be constructed if it’s reasonably practicable to do so.

A ground moisture barrier is usually made of polythene and is laid on top of the ground, in order to block any moisture that is present in the ground from accumulating into the building. It also helps to prevent water damage to the floor insulation.
