Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed for a Porirua rental property, all Healthy Homes compliance work must be done inside of 90 days.

The information contained in the Compliance Statement needs to be up-to-date when the tenancy agreement is signed. It should be maintained throughout the duration of the tenancy when any necessary work related to it is finished.

It is also crucial to be aware that landlords with multiple rental properties could face more severe penalties for not complying. The most severe penalties are given for serious breaches. Landlords with six or more properties can be fined up to $50,000, and as much as $100,000 in the case of hearing claims.

Tenancies that were signed in the period between July 1st 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory to all Porirua and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or amended tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the conformance to any Healthy Homes Standards that apply or will apply throughout the tenancy period of an apartment rental.

  • All rental homes are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.
