Fines for Failing to Comply

The information contained in the Statement of Compliance requirements to be current before the tenancy agreement can be signed, and ideally it must be updated through the tenancy period as related work is completed.

It is also crucial to keep in mind that a landlord who have several rental properties can face additional fines for non-compliance. The highest penalties are handed down for serious violations. Those who have at least six rental properties could be penalised up to $50,000, or as high as $100,000 in hearings.

Porirua Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement in all Porirua and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate conformance with the Healthy Homes Standards that apply or will apply to their rental properties.

Starting 1 July 2021

  • Property managers and private landlords have to ensure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed or varied tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All households rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.

Rental properties in Porirua require a reliable source of heating which can warm the main or largest living room to at least 18degC, even on the coldest winter days. In certain situations, such as small apartments the smaller fixed electric heater may be sufficient.

If the main living room already has a central heating source like an air conditioner, it could require a top up in order to comply with the standards. Certain kinds of heaters aren’t able to be used to comply with the standard as they are either expensive, inefficient and/or unhealthy to run.
