Fines for Failing to Comply
Beginning on July 1st, 2021, when a new or renewed tenancy is signed on a Porirua rental property, all Healthy Homes compliance tasks must be done within 90 days.
As of 1st July 2021, when a new, renewed or varied tenancy is signed on the Porirua rental property, all Healthy Homes compliance work must be finished inside of 90 days.
Failure to comply with any of the Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement it could result in an additional penalty or infringement fee.
Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager fails to provide the information requested within 21 days of having received the inquiry, they may receive an infringement notification and be fined up to $750.
Additionally, there is also a penalty up to $900 for landlords or property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or information. The person liable for this fine is the person who is listed on the tenancy agreement as being the person leasing the property out, so it could be the name of the landlord, or the property management company.
The information contained in the Statement of Compliance requirements to be correct before the tenancy agreement can be signed, and ideally it must be updated throughout the tenancy as any necessary work related to it’s finished.
It is important to remember that landlords who manage multiple rental properties could face more severe penalties for not complying. The most severe penalties are handed down for the most serious breaches, and landlords with six or more properties can be penalised up to $50,000, and even as high as $100,000 in hearings.
