Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied contract is signed on a Porirua rental property, all Healthy Homes compliance work have to be taken care of within 90 days.

Since the 1st July of 2021, if a new, renewed or varied Tenancy is signed for the Porirua rental property, all Healthy Homes compliance work must be done by the end of 90 days.

In addition, there is an additional fine of up to $900 for property owners or property managers providing a false or inaccurate Healthy Homes Compliance Statement or any other information. The person liable to pay this fine is the one who is listed on the tenancy agreement as the person who is who is letting the property which could be the name of the landlord or the property management company.

All the information on the Statement of Compliance requirements to be up-to-date at the time that the tenancy agreement is completed, and should be maintained during the entire tenancy, as necessary work related to it is finished.

Tenancies signed between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement in all Porirua and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
