Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for a Porirua rental property, all Healthy Homes compliance tasks need to be finished by the end of 90 days.

Since the 1st July of 2021, once a new, renewed or varied Tenancy is signed for the Porirua rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to adhere to one of the Healthy Homes Standards by the end of the anticipated timeframe could result in the possibility of a fine up to $7200. In addition, if the present Healthy Homes Statement of Compliance is not incorporated in a new, renewed or revised tenancy agreement it could result in an additional fine or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager fails to supply the necessary information within 21 days of being informed of the request, they can be issued an infringement notice and be fined upto $750.

In addition, there is an additional fine of approximately $900 for property owners or property managers that provide false or false Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the person who is identified on the tenancy contract as the person renting the property which could be the name of the landlord, or the company that manages the property.

All information in the Statement of Compliance requirements to be correct at the time that the tenancy agreement is executed, and it should be kept updated during the entire tenancy, as related work is completed.

It’s also important to remember that landlords who have multiple rental properties may receive greater penalties for non-compliance. The most severe penalties are reserved for the most serious breaches, and landlords with at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 in hearings.

Healthy homes are important

What are the reasons why Healthy Homes Compliance so Important?

A majority of households rent in New Zealand and Porirua, and research shows us that these rental homes are more likely to be older, colder, have less effective heating, and generally tend to be of poorer standard than those owned by owners.

Damp, mouldy and cold homes are linked to negative health results, specifically for illnesses like colds, flu, asthma and cardiovascular conditions. Furthermore, people who have reported at least four major house quality problems often experience lower levels of satisfaction with life and a decrease in well-being.

Improving the standard of Porirua rental property will help tenants experience improved mental and physical health as well as lessen disturbance to learning, work and daily life because of illnesses. Your investment will be secured from mildew, mould and damp-related damage, which completed jobs in lower maintenance costs in the long run.

The Healthy Homes Standards are a list of the specific and minimum requirements for heating, insulation Ventilation and Ventilation and Drainage, as well as Draught-stopping on Porirua rental properties.

Unreasonable Gaps & Holes

Draught Stopping Porirua

Draughts may lead to lower temperatures in houses. A damp house will cost more to heat, which results in wasting energy and increased bills.

If a draught could be felt from unreasonable gaps or holes the area requirements to be sealed.

What are unjustifiable gaps or holes?

If you can feel external air flowing in or the air is clear from a crack or a gap that is, it’s probably a gap or crack that needs sealing in the way you can. Large cracks and gaps should be permanently stopped. Cracks that are greater than 3mm and let air in or out of your home need to be sealed. For instance, if an open fireplace isn’t being used, it can create draughts. This should be shut off. Property managers and landlords are responsible for ensuring that such draughts are squelched in the maximum extent possible.

You don’t require to block up intentional gaps or holes that are part of the construction. For example, tiny gaps around windows and doors may be required to allow movement of the structure as the household heats and cools, to allow them to be closed and opened instead of than sticking. We will inspect all windows and doors during our Healthy Homes assessment of your rental property.

The proper heating equipment is important to ensure healthy homes

Heating Porirua

Porirua rental properties must have a fixed heating source that can warm the main or largest living room to at least 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat requirements to be fixed (i.e., not portable), at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum requirement for heat capacity in the living area. A Heating Assessment Tool can be used to determine whether the current fixed heater(s) are sufficient or if you’ll require to top up with an additional heater. Fires that are open and unflued heaters, such as the portable LPG bottle heaters are not considered to be safe heating options in the Healthy Homes Standard.

If the heating that you provide is an electric heater or heat pump then it must include the thermostat. This will help make your heating more consistent and efficient. For most properties, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are needed. However, in some cases like apartments with small spaces, a smaller fixed electric heater may suffice.

If your main living space already has a permanent heating source like a heat pump, then it might need an upgrade to make sure it meets the requirements. Certain kinds of heaters aren’t able to be used to achieve the standard as they are either not efficient, cost prohibitive to operate and/or unhealthy to run.

Ventilation Porirua

Every living space in the rental property should have at least one opening window or exterior door to offer natural ventilation. Furthermore, moist areas such as kitchens or bathrooms should be equipped with an externally vented extractor fan to eliminate moisture.

A ventilation quality is all about acknowledging how the dry atmosphere is less difficult to heat and an apartment that is well-ventilated is less likely to grow mould and damp.

Bedrooms, living rooms kitchens, and dining areas are all considered living spaces. Spaces that connect, such as the hallway aren’t liveable and do not need an opening window or door.

Each door, window or the skylight requirements to be able open to the outside, but remain set in an opening position to allow to circulate fresh air as well as ventilation.

Bathrooms, kitchens, and any other room in your home with a bath, shower and cooktop or another moisture generating item will require proper extractor fan systems that vent out to the outside. Our Healthy Homes Assessment service will check that there is adequate ventilation in each livable space and will also check for the proper extractor fans in high moisture areas.

Insulation Porirua

Insulation for underfloor and ceilings is a requirement on all rental homes since 1 July 2019. All landlords and property managers must make sure the insulation meets standards that are in line with the latest standard. In some cases, old ceiling insulation as well as insulation within the subfloor space might need to be filled with or replaced.

A properly insulated home will reduce the risk of condensation and lower the chance of mould and dampness, and will also make much easier for the home to hold the heat.

Insulation requirements to be in compliance with the R-values of your area.

The "R" signifies thermal resistance and is a measure of how well the insulation is able to resist heat flow. The greater the R-value, the more effective the insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9, underfloor R 1.3
  • Zone 2 – the rest area of North Island except Taupo and the Central Plateau – ceiling R 2.9 and floor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 and underfloor R 1.3

Porirua Moisture Ingress & Drainage

Making sure your rental property is protected from dampness isn’t just about the interior of the building It’s about having to make sure there is somewhere for surface or ground water, and stop it from coming into the building. When it is about damp and water, it is often not apparent that it can cause a lot of trouble that can cause the property to suffer and harming the tenant’s well-being.

Rental properties require to be equipped with efficient drainage for the removal of storm water, surface water and ground water, including the proper outfall or runoff. Making sure that water has a place to go, and that it doesn’t get sucked into buildings is an essential part of maintaining your property’s dry.

In addition to a drainage system to avoid water ingress, if the rental is enclosed between your floor and the soil, a ground-water barrier must be installed if it is reasonably practicable to do so.

The ground-moisture barrier typically an insulating sheet of polythene laid over the ground to prevent any moisture present in the ground from entering the property. It also helps prevent moisture damage to the underfloor insulation.
