Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed for a Porirua rental property, all Healthy Homes compliance items must be completed within 90 days.

From the 1st of July in 2021, if a new or renewed tenancy is signed on a Porirua rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the deadlines can result in an amount of $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy agreement there may be additional penalties or an infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the property they live in. If the landlord or property manager does not supply the necessary information within 21 days of receiving the request, they will receive an infringement notification and could be fined up to $750.

Additionally, there is also a penalty as much as $900 for landlords or property managers who have provided a false or incorrect Healthy Homes Compliance Statement or any other information. The person liable for this fine is the person who is identified on the tenancy contract as the person leasing the property out which could be the name of the landlord, or the company that manages the property.

The information contained in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is executed, and it should be maintained throughout the duration of the tenancy when any necessary work related to it’s finished.

It’s important to keep in mind that landlords who have multiple rental properties may receive more severe penalties for not complying. The highest penalties are reserved for the most serious violations, and landlords who own six or more properties can receive fines of up to $50,000, and even as high as $100,000 in hearing claims.

Porirua Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is required to all Porirua and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate compliance with each Healthy Homes Standard that apply or will be applied to the rental property.

From July 1st 2021

  • Property managers and private landlords must make sure their rental properties conform according to Healthy Homes Standards within 90 days of any newly renewed, extended or changed lease.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All households let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Rental properties in Porirua must have a fixed heating source which can warm the largest or main living area to at minimum 18degC even on the coldest winter days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating needs that it be permanently fixed (i.e. not portable), at minimum 1.5 horsepower in capacity, and it must have the minimum capacity for heating required for the main living room. A Heating Assessment Tool could be used to determine whether the fix heater(s) are adequate or if you’ll require to top up with an additional heater. Open fires and unflued combustion heaters like small portable LPG bottle heaters are not considered to be suitable heating options in those following the Healthy Homes Standard.

If the heating you provide is electric heating (or heat pump), then it must have a thermostat. This will make the heating more reliable and effective. For most properties, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters will be required. However, in certain instances such as small apartments, a smaller fixed electric heater may suffice.

If your main living space is already equipped with a fixed heating source, like the heat pump, it might just require some additional energy to be able to meet the standards. All landlords and property managers must ensure that the insulation meets standards that are in line with the latest standard.
