The person who is responsible for this fine is whoever is named on the tenancy agreement as the person who is who is letting the property which could be the landlord’s name or the property management company.

All information in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is signed. It must be updated through the tenancy period as relevant work gets completed.

It is important to be aware that landlords who manage several rental properties can face even higher fines for non-compliance. The most severe penalties are reserved for the most serious violations. Those who have six or more properties can receive fines of up to $50,000 and as high as $100,000 for hearing claims.

Tenancies signed beginning on 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory to all Pauatahanui and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or modified tenancy agreement.

  • All homes let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of when the tenancy first began.
