Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied contract is signed on a Pauatahanui rental property, all Healthy Homes compliance work need to be done inside of 90 days.

Since the 1st July of 2021, once a new or renewed Tenancy is signed for a Pauatahanui rental property, all Healthy Homes compliance work must be done by the end of 90 days.

The person who is responsible for this fine is the person who is identified on the tenancy agreement as the one who is letting the property out, so it could be the landlord’s name or the property management company.

The information contained in the Statement of Compliance needs to be up-to-date when the tenancy contract is signed. It should be kept updated throughout the duration of the tenancy when any relevant work gets completed.

It is also crucial to note that landlords who manage multiple rental properties may receive more severe penalties for not complying. The most severe penalties are reserved for severe breaches, and landlords with more than six properties could be penalised up to $50,000 and as high as $100,000 in hearings.

Tenancies that were signed from 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory to all Pauatahanui and New Zealand rental homes where it’s reasonably practicable to install.
