Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Paremata rental property, all Healthy Homes compliance tasks must be taken care of by the end of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on a Paremata rental property, all Healthy Homes compliance work must be completed within 90 days.

Inability to adhere to any of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or amended tenancy agreement it could result in an additional penalty or infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the property they live in. If the landlord or property manager is unable to provide the information requested within 21 days of getting the notice, the tenant will receive an infringement notice and be fined upto $750.

In addition, there is also a penalty of as much as $900 for landlords or property managers who provide a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is responsible for this fine is the one who is named on the lease agreement as the one who is leasing the property out, so it could be the name of the landlord, or the property management company.

All the information on the Statement of Compliance needs to be current when the tenancy contract is signed. It should be maintained throughout the tenancy as any associated work has been completed.

It is crucial to be aware that a landlord who manage multiple rental properties may receive even higher fines for non-compliance. The highest penalties are reserved only for serious violations, and landlords who own six or more properties could be penalised up to $50,000, and as much as $100,000 for hearing claims.

Paremata Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is required to all Paremata and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords must keep records that prove conformance with each Healthy Homes Standard that apply or will be in force to your rental home.

Beginning 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Paremata

Draughts increase the likelihood of less temperature in homes. A draughty home is more expensive to heat, resulting in wasted money and energy.

If a draught could be perceived as a result of gaps or holes, it needs to be sealed.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or the sound of a clear draught emanating out of a hole or gap or crack, then it’s most likely a gap or crack that requirements sealing in somehow. Large cracks and gaps should be stopped permanently. Cracks that are greater than 3mm and let air in or out within your house need seals. In the case of an open fireplace is not in use, it could cause draughts, and should be blocked off. Property managers and landlords are responsible for ensuring such draughts are eliminated whenever possible.

You don’t need to block up intentional gaps or holes in the building. For example, tiny gaps around windows and doors may be required to allow for movement of the structure as the house warms and cools in order to let them be shut and opened, rather instead of being stuck. Adequate heaters are important to ensure well-being houses

Heating Paremata

Paremata rental properties need to have a stable heating source that is able to heat the living room to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat requirements to remain fixed (i.e., not portable), at minimum 1.5 kW of heating capacity, and it must have the minimum heating capacity needed in the living area. A Heating Assessment Tool could be used to determine if the permanent heater(s) are sufficient or whether you will need to "top-up" with an additional heater. Open fires and unflued combustion heaters, such as portable LPG bottle heaters aren’t considered to be safe heating options for the Healthy Homes Standard.

If the heating that you offer is electric heating or heat pump, it should be equipped with a thermostat. This will help make your heating more consistent and efficient. For most houses, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in some cases like small apartments small apartments, a smaller electric fixed heater might be enough.

If your living space already has a fixed heating source such as the heat pump, it might just require a top up to ensure it meets the requirements. Certain kinds of heaters cannot be used to meet the standard as they are either not effective, cost prohibitive to operate and/or unhealthy to run.

Ventilation Paremata

Every living space in a rental home must have at least one opening doors or windows to provide natural ventilation. Additionally, areas with high moisture areas like kitchens and bathrooms should have an externally vented extractor fan that can remove moisture.

Property managers and landlords are required to make sure the insulation meets standards that are in line with the latest standard.
