Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Paremata rental property, all Healthy Homes compliance tasks have to be done inside of 90 days.

As of 1st July 2021, if a new or renewed Tenancy is signed for the Paremata rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet each of Healthy Homes Standards within the deadlines can result in a fine of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy contract, there could be an additional penalty or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they live in. If the landlord or the property manager doesn’t supply the required information within 21 days of having received the inquiry, they can receive an infringement notification and be fined upto $750.

In addition, there’s also a fine of as much as $900 for landlords and property managers that provide false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the one who is identified on the tenancy agreement as being the person leasing the property out which could be the name of the landlord or the property management company.

All the information on the Statement of Compliance needs to be accurate before the tenancy agreement can be signed, and ideally it must be updated throughout the tenancy as any related work is completed.

It is important to keep in mind that a landlord who have multiple rental properties may receive more severe penalties for not complying. The harshest penalties are given for serious breaches. Landlords with at least six rental properties could be fined as high as $50,000, or as high as $100,000 for hearing claims.

Paremata Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is mandatory for all Paremata and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records of their the conformance to the Healthy Homes Standard that apply or will be applied during the tenure of your rental home.

From 1 July 2021

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Paremata

Paremata rental properties must have a fixed source of heat that can warm the living space to a minimum of 18degC, even during the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements to remain fixed (i.e., not portable) with at least 1.5 kW of heating capacity and have the minimum requirement for heat capacity for the main living room. A Heating Assessment Tool could be used to determine whether the permanent heater(s) are sufficient or if you’ll require to "top up" by adding a second heater. Open fires and unflued combustion heaters like small portable LPG bottle heaters aren’t considered acceptable heating options for the Healthy Homes Standard.

If the heating that you provide is an electric heater or heat pump, it should include a thermostat. This will make the heating more reliable and effective. For most houses, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters will be required. In certain situations, like apartments with small spaces an electric, fixed heater might be enough.

If the main living room already has a permanent heating source like the heat pump, it could need a top up to be able to meet the standards. Certain kinds of heaters aren’t able to be used to comply with the standard as they are either not effective, cost prohibitive to operate and/or unhealthy to run.

Insulation Paremata

The insulation of the ceiling and underfloor is mandatory for all rent homes from 1 July 2019. Property managers and landlords have to make sure that the insulation meets current standard. In some cases, current ceiling insulation, or the insulation of the subfloor space may require to be replaced or replaced.

A well-insulated house can help control condensation and lower the chance of mould and damp, and it will make it easier to allow the house to keep warmth.
