Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed on a Paremata rental property, all Healthy Homes compliance items must be done by the end of 90 days.

Since the 1st July of 2021, if a new, renewed or varied Tenancy is signed for the Paremata rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Inability to adhere to each of Healthy Homes Standards within the deadlines can result in an amount of $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy agreement, there may be additional penalties or an infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager fails to supply the information requested within 21 days from having received the inquiry, they will receive an infringement letter and be fined upto $750.

In addition, there is an additional fine of as much as $900 for landlords and property managers that provide false or false Healthy Homes Compliance Statement or any other information. The person who is liable for this fine is the one who is identified on the tenancy agreement as being the person who is letting the property, so it could be the name of the landlord or the company that manages the property.

All information in the Statement of Compliance requirements to be correct before the tenancy agreement can be completed, and must be updated during the entire tenancy, as relevant work gets completed.

It is important to be aware that a landlord who own multiple rental properties may face additional fines for non-compliance. The most severe penalties are reserved for serious violations. Those who have more than six properties could be fined up to $50,000, and as much as $100,000 in hearings.

Paremata Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement for all Paremata and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords must keep records to demonstrate compliance with any Healthy Homes Standards that apply or will apply during the tenure of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied tenant.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Paremata

Draughts can lead to low temperatures inside houses. A damp house is more expensive to heat, which means wasting energy and resulting in higher bills.

If a draught can be noticed from gaps that are not adequate or holes that it needs to be closed.

What are unjustifiable gaps or holes?

If you can feel external air flowing in or an unobstructed draught coming from a hole or gap, then it is likely a crack or hole which needs sealing in the way you can. Cracks or gaps with large gaps must be fixed permanently. Any gaps greater than 3mm that let air into or out into the house need sealing. For example, if an open fireplace isn’t used it can create draughts. This should be sealed from. Property managers and landlords are accountable for ensuring that these draughts are stopped as far as imaginable.

You don’t require to block up intentional holes or gaps which are part of the building. For example, tiny gaps around doors and windows could be required to allow for the movement of the building as the house is heated and cools in order to let them be opened and closed rather instead of being stuck. Heating Paremata

Rental properties in Paremata should have a permanent heating source that is able to heat the living space to at least 18degC, even on the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating requirements that it be permanently fixed (i.e. not portable), at minimum 1.5 kW in heating capacity, and it must have the minimum requirement for heat capacity for the main living space. A Heating Assessment Tool could be used to determine whether the current fixed heater(s) are sufficient or whether you will need to "top up" with a new heater. If the heating system you offer is electric heating (or heat pump), then it must include the thermostat. This will help make your heating more consistent and effective. For most houses, larger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. However, in some cases like small apartment buildings an electric, fixed heater could be enough.

If your living space already has a fixed heating source, like heat pumps, it could require an upgrade in order to comply with the standards. Certain kinds of heaters cannot be used to meet the quality as they are either expensive, inefficient or are unsafe to operate.

Ventilation Paremata

Each living space within a rental property must have at least one opening doors or windows to offer natural ventilation. Furthermore, moist areas like kitchens and bathrooms must have a suitable externally vented extractor fan to remove moisture.

The ventilation standard is all about acknowledging that dry air is more easy to heat and heat, and an apartment that is well-ventilated is less likely to be a victim of damp and mould.

Living rooms, bedrooms, dining rooms, and kitchens are considered to be liveable spaces. Connecting spaces such as the hallway are not considered liveable and are not need an opening door or window.

Insulation Paremata

Insulation for underfloor and ceilings is mandatory to all rental homes since July 1, 2019. Property managers and landlords must make sure that the insulation is in line with the new standard. In certain situations, the an existing insulation on the ceiling or in the sub floor space might need to be added or replaced.
