Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed on a Paremata rental property, all Healthy Homes compliance tasks have to be finished by the end of 90 days.

From the 1st of July in 2021, once a new, renewed or varied lease is entered into on the Paremata rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to adhere to all of the Healthy Homes Standards inside of the deadlines can result in penalties of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included in a new, renewed or amended tenancy agreement there could be an additional penalty or infringement fee.

The person liable for this fine is whoever is named on the lease agreement as the one who is letting the property out, so it could be the name of the landlord as well as the property management company.

It is also crucial to note that a landlord who have multiple rental properties may receive more severe penalties for not complying. Paremata Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is required to all Paremata and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords have to keep records of their the conformance to the Healthy Homes Standard that apply or will be in force during the tenancy of the rental property.

From July 1st 2021

  • Private landlords and property managers should ensure their rental properties comply with the Healthy Homes Standards within 90 days of a new, renewed , or altered Tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Paremata

Draughts can lead to low temperatures inside houses. A humid home is more expensive to heat, which means wasting energy and increased bills.

If a draft can be felt through gaps that are too large or holes or holes, it needs to be sealed.

Adequate heaters are crucial to ensure healthy homes

Heating Paremata

Paremata rental properties require a reliable heating source that can heat the living room to at least 18degC, even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source needs to remain fixed (i.e., not portable) with at least 1.5 horsepower in capacity, and meet the minimum requirement for heat capacity for the main living room. The Heating Assessment Tool can be used to determine whether your current permanent heater(s) are adequate or whether you will need to top up by adding a second heater. If the heating system you offer is an electric heater or heat pump it requirements to have an thermostat. This will make the heating more reliable and effective. For most homes, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. In some instances, like small apartments an electric, fixed heater may be sufficient.

If your main living space already has a fixed heating source, such as the heat pump, it could require some additional energy in order to comply with the standards. Ventilation Paremata
