Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed for a Paremata rental property, all Healthy Homes compliance tasks must be completed inside of 90 days.

As of 1st July 2021, if a new, renewed or varied tenancy is signed on the Paremata rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Inability to adhere to any of the Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or amended tenancy agreement it could result in an additional fine or infringement fee.

In addition, there is also a penalty of approximately $900 for property owners or property managers who have provided a false or misleading Healthy Homes Compliance Statement or information. The person who is responsible for this fine is the one who is named on the tenancy agreement as the one who is leasing the property out which could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance needs to be up-to-date before the tenancy agreement can be signed, and ideally it should be maintained throughout the tenancy as any relevant work gets completed.

It’s also crucial to be aware that a landlord who own multiple rental properties could face more severe penalties for not complying. The highest penalties are reserved only for serious violations. Those who have six or more properties could be fined as high as $50,000, and even as high as $100,000 for hearing claims.

Paremata Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is a requirement in all Paremata and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the compliance with the Healthy Homes Standards that apply or will be applied during the tenure of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords must ensure their rental properties conform to the Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All homes which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Paremata

Rental properties in Paremata need to have a stable source of heat which can warm the main or largest living space to at least 18degC, even during the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating needs to remain fixed (i.e. not portable), at minimum 1.5 kW in heating capacity, and meet the minimum requirement for heat capacity for the main living room. A Heating Assessment Tool could be used to determine if your current fix heater(s) are adequate or whether you will need to ‘top up’ by adding a second heater. Unflued combustion and open fire heaters, such as mobile LPG bottle heaters aren’t considered to be acceptable heating options under The Healthy Homes Standard.

If the heating system you offer is an electric heater or heat pump, then it must include an thermostat. This makes your heating more consistent and efficient. In most houses, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in some cases like small apartment buildings, a smaller fixed electric heater may be sufficient.

If your main living space is already equipped with a fixed heating source, like an air conditioner, it may require an update to be able to meet the standards. Certain kinds of heaters aren’t able to be utilised to meet the standard because they’re costly, not cost-effective to run, and/or unhealthy to run.

Ceiling and underfloor insulation is required for all rent houses since 1 July 2019. All landlords and property managers must ensure that the insulation meets standards that are in line with the latest quality. In some cases, an existing insulation on the ceiling or in the sub floor space may need to be topped up or replaced.
