Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Paremata rental property, all Healthy Homes compliance items need to be done by the end of 90 days.

Since the 1st July of 2021, when a new, renewed or varied Tenancy is signed for the Paremata rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to comply with all of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance is not incorporated in a new, renewed or amended tenancy agreement it could result in an additional fine or infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the property they live in. If the landlord or the property manager doesn’t provide the information requested within 21 days from receiving the request, they can receive an infringement notice and be fined as high as $750.

In addition, there is also a penalty approximately $900 for landlords and property managers providing a false or incorrect Healthy Homes Statement of Compliance or information. The person who is liable to pay this fine is the one who is listed on the tenancy agreement as the person who is leasing the property out and it could be the landlord’s name or the property management company.

All information in the Statement of Compliance requirements to be correct when the tenancy agreement is signed. It must be updated during the entire tenancy, as associated work has been completed.

It’s important to remember that landlords who manage multiple rental properties may face even higher fines for non-compliance. The highest penalties are reserved for serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000, or as high as $100,000 in hearing claims.

Paremata Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory throughout Paremata and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records that prove compliance with all Healthy Homes Standards that apply or will be in force during the tenure of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers should make sure their rental properties comply to the Healthy Homes Standard within 90 days of any new, renewed , or altered lease.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All households rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Paremata

Rental properties in Paremata must have a fixed heating source which can warm the living area to at minimum 18 degrees Celsius, even on the most coldest days of the year.
