Fines for Failing to Comply
Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Paremata rental property, all Healthy Homes compliance tasks need to be taken care of inside of 90 days.
From the 1st of July in 2021, once a new or renewed contract is signed on a Paremata rental property, all Healthy Homes compliance work must be done within 90 days.
Failure to comply with all of the Healthy Homes Standards inside of the expected timeframe can result in penalties of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance is not incorporated within the new, renewed or amended tenancy agreement there may be additional penalties or an infringement fee.
Anyone can request information about the Healthy Homes Standard and how they are related to the house they are living in. If the property manager does not provide the information requested within 21 days of receiving the request, they will receive an infringement notification and could be fined up to $750.
In addition, there is also a fine of approximately $900 for landlords and property managers who have provided a false or misleading Healthy Homes Statement of Compliance or information. The person responsible for this fine is the person who is identified on the tenancy agreement as being the person leasing the property out and it could be the name of the landlord or the company that manages the property.
All the information on the Compliance Statement needs to be correct before the tenancy agreement can be completed, and should be maintained during the entire tenancy, as associated work has been completed.
It is also crucial to note that landlords who manage several rental properties can face greater penalties for non-compliance. The most severe penalties are given for serious breaches. Landlords with more than six properties could be fined up to $50,000, and as much as $100,000 for hearing claims.
