Did you have any idea that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords are now required to ensure their Paremata rental properties meet the minimum Healthy Homes Standards within 90 days of any new or renewed tenancy and all private rentals must be completely conforming by the 1st July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed for a Paremata rental property, all Healthy Homes compliance items must be done by the end of 90 days.

Beginning on July 1st, 2021, when a new or renewed Tenancy is signed for the Paremata rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Inability to adhere to all of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy agreement it could result in an additional penalty or infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the building they live in. If the the property manager doesn’t provide the required information within 21 days from being informed of the request, they could receive an infringement notification and be fined upto $750.

In addition, there’s an additional fine of up to $900 for landlords or property managers who provide a false or incorrect Healthy Homes Compliance Statement or any other information. The person responsible to pay this fine is the one who is named on the tenancy agreement as being the person leasing the property out which could be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement needs to be current at the time that the tenancy agreement is signed, and ideally it must be updated throughout the tenancy as any relevant work gets completed.

It is important to remember that landlords who manage multiple rental properties may receive additional fines for non-compliance. The highest penalties are reserved for severe breaches, and landlords with more than six properties could be penalised up to $50,000, and as much as $100,000 in hearing claims.

Paremata Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is required in all Paremata and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate compliance with each Healthy Homes Standards that apply or will apply throughout the tenancy period of your rental home.

From 1 July 2021

  • Property managers and private landlords have to make sure their rental properties comply to the Healthy Homes Standard within 90 days of any renewal, new or a change in tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All houses that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Paremata

Draughts are a major cause of less temperature in homes. A cold house is more expensive to heat, resulting in wasted energy and incurring higher costs.

If a draught could be felt from unreasonable gaps or holes or holes, it requirements to be closed.

Heating Paremata

Paremata rental properties should have a permanent source of heat that can heat the living area to at minimum 18degC, even during the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat needs to remain fixed (i.e., not portable) and at minimum 1.5 kW of heating capacity, and must meet the minimum required heating capacity to heat the living space in general. The Heating Assessment Tool can be used to determine whether the existing fixed heater(s) are adequate or whether you will require to "top up" with a new heater. If the heating you offer is electric heating or heat pump, it must have the thermostat. This will make the heating more reliable and effective. Some types of heaters can’t be used to achieve the standard since they’re either inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Paremata

Every living space in the rental property should have at least one opening window or exterior door to offer natural ventilation. Furthermore, moist areas such as kitchens or bathrooms must have a suitable externally vented extractor fan to eliminate moisture.

Property managers and landlords have to ensure the insulation meets standards that are in line with the latest quality.
