Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on a Paparangi rental property, all Healthy Homes compliance tasks have to be finished inside of 90 days.

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Paparangi rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

The person liable for this fine is the one who is listed on the tenancy agreement as being the person who is letting the property, so it could be the name of the landlord as well as the property management company.

The information contained in the Statement of Compliance requirements to be accurate before the tenancy agreement can be signed. It should be kept updated throughout the duration of the tenancy when any relevant work gets completed.

It’s important to note that a landlord who have multiple rental properties may receive greater penalties for non-compliance. The highest penalties are handed down for severe breaches. Landlords with at least six rental properties could receive fines of up to $50,000, and as much as $100,000 in the case of hearing claims.

Paparangi Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory in all Paparangi and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records that demonstrate compliance with each Healthy Homes Standard that apply or will be applicable throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Private landlords and property managers have to ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a renewal, new or a change in tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All homes let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Paparangi

Paparangi rental properties need to have a stable source of heating that is able to heat the main or largest living space to a minimum of 18degC, even during the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health as well as their mental health.

In some instances, like small apartment buildings the smaller fixed electric heater may suffice.

If your living space already has a fixed heating source such as an air conditioner, it could require an update to be able to meet the standards. Certain types of heaters cannot be used to comply with the standard because they’re not effective, cost prohibitive to operate and/or unhealthy to run.
