Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed contract is signed on a Papakowhai rental property, all Healthy Homes compliance tasks have to be completed by the end of 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Papakowhai rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to adhere to any of the Healthy Homes Standards inside of the period of time expected can lead to the possibility of a fine up to $7200. Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager is unable to provide the required information within 21 days of being informed of the request, they will receive an infringement notice and be fined upto $750.

Additionally, there is also a penalty of approximately $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or information. The person responsible for this fine is the one who is named on the tenancy contract as the person who is letting the property and it could be the landlord’s name or the property management company.

All the information on the Statement of Compliance requirements to be correct when the tenancy agreement is signed, and ideally it should be maintained throughout the tenancy as any relevant work gets completed.

It’s crucial to note that a landlord with multiple rental properties may receive additional fines for non-compliance. The most severe penalties are handed down for serious violations, and landlords who own six or more properties could be penalised up to $50,000, or as high as $100,000 in the case of hearing claims.

Papakowhai Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement to all Papakowhai and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove the compliance with the Healthy Homes Standard that apply or will apply during the tenancy of your rental home.

From 1 July 2021

  • Private landlords and property managers must ensure their rental properties comply according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed lease.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of when the tenancy began.

What are unreasonable gaps or holes?

If you can feel external air flowing in or a clear draught from a gap or hole or crack, then it is probably a gap or crack that requirements sealing in somehow. Cracks and gaps that are large should be fixed permanently. Any gaps greater than 3mm that allow air in or out within your house need seals. For example, if an open fireplace isn’t used it can cause draughts and should be shut off. Landlords and property managers are accountable for ensuring that draughts from the fireplace are removed whenever imaginable.

There is no need to block up intentional gaps or holes that are part of the building. For example, tiny gaps around windows and doors might be necessary to allow movement of the structure when the house heats and cools, to allow them to be opened and closed rather than sticking. Heating Papakowhai

Papakowhai rental properties require a reliable source of heat that can warm the main or largest living space to at least 18degC, even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat needs for it to be permanent (i.e., not portable) with at least 1.5 kW in heating capacity, and must meet the minimum capacity for heating required in the living area. A Heating Assessment Tool could be used to determine whether the existing fixed heater(s) are adequate or whether you will need to "top-up" with a new heater. Unflued combustion and open fire heaters, such as mobile LPG bottle heaters aren’t considered to be safe heating options under The Healthy Homes Standard.

If the heating that you offer is electric heating or heat pump it should be equipped with the thermostat. This makes the heating more uniform and effective. For most properties, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in certain instances like small apartment buildings, a smaller fixed electric heater may suffice.

If your main living space is already equipped with a fixed heating source, such as a heat pump, then it may require an upgrade to be able to meet the standards. Certain kinds of heaters cannot be used to comply with the quality because they’re costly, not affordable to run, or are unsafe to operate.

Ventilation Papakowhai

Each living space within a rental house must include at least one open door or window to provide natural ventilation. Additionally, areas with high moisture spaces like kitchens and bathrooms should have an externally vented extractor to remove moisture.

Underfloor and ceiling insulation is a requirement in all rental homes from 1 July 2019. Property managers and landlords should make sure that the insulation is in line with the new standard. In some instances, current ceiling insulation, or the insulation of the subfloor space may need to be topped up or replaced.

A well-insulated property will help to control condensation and reduce the chances of mould and dampness, as well as making it easier to allow the home to keep the heat.

In addition to a drainage system to avoid the ingress of moisture, if your rental has an enclosed gap between floorboards and ground, a ground water barrier must be put in place when it is reasonably practicable to do so.

The ground-moisture barrier usually a sheet of polythene that is placed over the ground to prevent any moisture that is present in the ground from rising into the property. It also assists in preventing moisture damage to the underfloor insulation.
