Fines for Failing to Comply
From the 1st of July in 2021, once a new, renewed or varied tenancy is signed for a Normandale rental property, all Healthy Homes compliance items must be taken care of by the end of 90 days.
Beginning on July 1st, 2021, once a new, renewed or varied lease is entered into on the Normandale rental property, all Healthy Homes compliance work must be finished within 90 days.
Failure to comply with one of the Healthy Homes Standards within the deadlines can result in the possibility of a fine up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy agreement it could result in an additional fine or infringement fee.
Anyone can request details about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager is unable to provide the required information within 21 days from being informed of the request, they could receive an infringement notice and be fined up to $750.
Additionally, there is also a penalty of as much as $900 for landlords and property managers who have provided a false or false Healthy Homes Compliance Statement or any other information. The person who is responsible to pay this fine is the one who is listed on the tenancy agreement as being the person who is letting the property, so it could be the landlord’s name or the property management company.
All information in the Compliance Statement requirements to be accurate at the time that the tenancy agreement is signed, and ideally it must be updated throughout the tenancy as any relevant work gets completed.
It’s also crucial to note that landlords who own multiple rental properties could face additional fines for non-compliance. The most severe penalties are reserved for serious violations. Those who have at least six rental properties could be fined as high as $50,000, and even as high as $100,000 in the case of hearing claims.
