Fines for Failing to Comply
Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on a Normandale rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.
From the 1st of July in 2021, when a brand new or renewed Tenancy is signed for the Normandale rental property, all Healthy Homes compliance work must be finished by the end of 90 days.
Failure to adhere to any of the Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement there could be an additional fine or violation fee.
Anyone can request information about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager is unable to supply the information requested within 21 days of receiving the request, they could be issued an infringement notice and could be fined up to $750.
In addition, there’s also a penalty of up to $900 for landlords or property managers that provide false or incorrect Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the one who is named on the tenancy agreement as the person who is letting the property out, so it could be the name of the landlord as well as the property management company.
All information in the Statement of Compliance needs to be correct before the tenancy agreement can be signed, and ideally it should be maintained during the entire tenancy, as necessary work related to it’s finished.
It is important to be aware that a landlord who manage multiple rental properties may receive more severe penalties for not complying. The most severe penalties are given only for serious violations, and landlords who own six or more properties could be fined as high as $50,000, or as high as $100,000 in hearing claims.
