Fines for Failing to Comply
Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed for a Ngauranga rental property, all Healthy Homes compliance tasks must be taken care of within 90 days.
From the 1st of July in 2021, if a new or renewed tenancy is signed on a Ngauranga rental property, all Healthy Homes compliance work must be done within 90 days.
Failure to adhere to each of Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement, there may be an additional penalty or infringement fee.
Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the building they are living in. If the property manager is unable to supply the information requested within 21 days from being informed of the request, they may be issued an infringement notice and be fined upto $750.
Furthermore, there’s also a penalty up to $900 for property owners or property managers who offer a false or incorrect Healthy Homes Compliance Statement or other information. The person responsible to pay this fine is the one who is named on the tenancy agreement as being the person leasing the property out, so it could be the name of the landlord or the company that manages the property.
All the information on the Statement of Compliance requirements to be up-to-date at the time that the tenancy agreement is signed, and ideally it should be kept updated throughout the tenancy as any associated work has been completed.
It’s also crucial to note that landlords who own multiple rental properties could face even higher fines for non-compliance. The most severe penalties are reserved for the most serious breaches, and landlords with at least six rental properties could be penalised up to $50,000, and as much as $100,000 in hearing claims.
