Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on a Ngauranga rental property, all Healthy Homes compliance items need to be done inside of 90 days.

From the 1st of July in 2021, when a brand new or renewed contract is signed on the Ngauranga rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to comply with each of Healthy Homes Standards inside of the period of time expected can lead to penalties of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy agreement, there may be additional penalties or an infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager is unable to supply the required information within 21 days from being informed of the request, they may receive an infringement notification and be fined as high as $750.

Furthermore, there’s also a fine of up to $900 for landlords or property managers who offer a false or incorrect Healthy Homes Statement of Compliance or other information. The person responsible to pay this fine is the one who is named on the lease agreement as the one who is leasing the property out, so it could be the name of the landlord, or the property management company.

All information in the Compliance Statement needs to be current when the tenancy contract is signed. It should be maintained throughout the tenancy as any necessary work related to it is finished.

It is also important to note that landlords with several rental properties can face more severe penalties for not complying. The harshest penalties are reserved for serious breaches, and landlords with six or more properties can be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

Tenancies signed in the period between July 1st 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is required throughout Ngauranga and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the compliance with any Healthy Homes Standard that apply or will be applied to an apartment rental.

From 1 July 2021

Beginning 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Ngauranga

Rental properties in Ngauranga require a reliable source of heat that can warm the largest or main living room to at least 18 degrees Celsius, even on the coldest winter days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental outlook.

The source of heating needs to be fixed (i.e. not portable) with at minimum 1.5 horsepower in capacity, and must meet the minimum required heating capacity for the main living space. For the majority of homes, bigger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters will be required. If your living space is already equipped with a fixed heating source, like an air conditioner, it may need a top up to be able to meet the standards.
