Did you not know that Healthy Homes Standards came into in force on July 1, 2021? Landlords must make sure that their Naenae rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rental properties must be completely conforming by the 1st July 2024.

Failure to comply with the requirements to comply with the Healthy Homes Standards is a breach under the Residential Tenancies Act 1986, and landlords who are not in compliance could face fines of up to $7,200 plus additional healthy homes relevant fines.

Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Naenae rental property, all Healthy Homes compliance work have to be finished within 90 days.

From the 1st of July in 2021, if a new or renewed tenancy is signed on the Naenae rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to each of Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. In addition, if the current Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy contract, there could be an additional penalty or infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager fails to provide the required information within 21 days of being informed of the request, they may receive an infringement notice and be fined as high as $750.

In addition, there’s also a fine of as much as $900 for landlords and property managers providing a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is responsible for this fine is the person who is named on the lease agreement as being the person leasing the property out and it could be the landlord’s name or the property management company.

All the information on the Compliance Statement requirements to be up-to-date when the tenancy contract is signed. It should be maintained throughout the tenancy as any associated work has been completed.

It’s also important to remember that a landlord who have multiple rental properties could face more severe penalties for not complying. The harshest penalties are reserved for serious breaches. Landlords with more than six properties could be fined up to $50,000, or as high as $100,000 for hearing claims.

Naenae Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory for all Naenae and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate the compliance with any Healthy Homes Standards that apply or will be in force to their rental properties.

From July 1st 2021

  • Property managers and private landlords must make sure their rental properties comply to the Healthy Homes Standard within 90 days of any new, renewed , or altered lease.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Naenae

Draughts can lead to less temperature in houses. A humid home will cost more to heat, meaning wasting energy and incurring higher costs.

If a draught is noticed from gaps that are not adequate or holes the area needs to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air coming in or a clear draught from a gap or hole, then it’s likely a crack or hole which needs sealing in the way you can. Cracks or gaps with large gaps must be fixed permanently. The gaps that exceed 3mm that allow air to enter or exit into the house need to be sealed. For instance, if an open fireplace isn’t being used, it could cause draughts, and should be blocked from. Property managers and landlords are accountable for ensuring that these draughts are stopped whenever possible.

There is no need to cover up gaps or holes that are part of the construction. For example, tiny gaps around doors and windows could be required to allow for movement within the building as the home gets warmer and cooler, so that they can still be shut and opened, rather than securing. Adequate heaters are important to ensure healthy houses

Heating Naenae

Naenae rental properties require a reliable source of heat that is able to heat the largest or main living room to at least 18degC, even on the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source needs to remain fixed (i.e., not portable) and at minimum 1.5 horsepower in capacity, and it must have the minimum requirement for heat capacity in the living area. A Heating Assessment Tool may be used to determine if the current fixed heater(s) are adequate or if you’ll require to "top up" with a new heater. Fires that are open and unflued heaters, such as mobile LPG bottle heaters are not considered to be suitable heating options for those following the Healthy Homes Standard.

If the heating that you offer is an electric heater (or heat pump), then it must include a thermostat. This makes the heating more consistent and effective. In most houses, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in certain instances such as small apartments the smaller fixed electric heater might be enough.

If your main living space is already equipped with a fixed heating source, such as an air conditioner, it could need an upgrade in order to comply with the standards. Certain kinds of heaters aren’t able to be used to comply with the standard as they are either costly, not cost-effective to run, and/or unhealthy to run.

Ventilation Naenae

Every living space in the rental property should include at least one open window or exterior door to offer natural ventilation. In addition, humid spaces like kitchens and bathrooms need to have an venting fan outside to remove moisture.

Insulation Naenae

Insulation for underfloor and ceilings is mandatory on all rental houses since July 1, 2019. Property managers and landlords should make sure that the insulation is in line with the new quality. In certain situations, the old ceiling insulation as well as insulation within the subfloor space may require to be filled with or replaced.
