Did you know that the Healthy Homes Standards came into effect on the 1st July 2021? The landlords are now required to ensure their Naenae rental properties meet the minimum Healthy Homes Standards within 90 days of any new or renewed tenancy, and all private rental properties must be fully conforming by the 1st July 2024.

Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed on a Naenae rental property, all Healthy Homes compliance tasks have to be finished within 90 days.

Beginning on July 1st, 2021, when a brand new or renewed contract is signed on a Naenae rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet each of Healthy Homes Standards within the deadlines can result in a fine of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy agreement, there may be an additional fine or violation fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the property they are living in. If the property manager is unable to provide the required information within 21 days of receiving the request, they could receive an infringement notice and could be fined up to $750.

In addition, there’s also a fine of up to $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Compliance Statement or other information. The person liable for this fine is whoever is named on the lease agreement as the person who is leasing the property out which could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement requirements to be accurate when the tenancy agreement is executed, and it should be maintained throughout the duration of the tenancy when any related work is completed.

It is crucial to be aware that landlords with several rental properties can face greater penalties for non-compliance. The most severe penalties are given for serious breaches. Landlords with six or more properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

Naenae Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is a requirement to all Naenae and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records that prove conformance with all Healthy Homes Standards that apply or will be applied during the tenancy of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers have to ensure their rental properties comply according to Healthy Homes Standards within 90 days of any new, renewed , or altered lease.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All households which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Draughts increase the likelihood of low temperatures inside households. A humid home costs more to heat, which results in wasting energy and increased bills.

If a draught can be noticed from gaps that are not adequate or holes or holes, it requirements to be sealed.

Heating Naenae

Rental properties in Naenae should have a permanent heating source that is able to heat the main or largest living area to at minimum 18degC, even on the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source needs for it to be permanent (i.e. not portable) with at minimum 1.5 kW of heating capacity, and must meet the minimum required heating capacity to heat the living space in general. The Heating Assessment Tool can be used to check if your current permanent heater(s) are adequate or if you’ll need to top up with an additional heater. Fires that are open and unflued heaters, such as small portable LPG bottle heaters are not considered acceptable heating options under the Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump it must include a thermostat. This will help make your heating more consistent and effective. In most homes, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in certain instances like small apartment buildings the smaller fixed electric heater might be enough.

If the living area already has a fixed heating source such as an air conditioner, it may need a top up to be able to meet the standards. Certain kinds of heaters cannot be used to meet the quality as they are either costly, not cost-effective to run, or are unsafe to operate.

Ventilation Naenae

Insulation for underfloor and ceilings is mandatory in all rental houses from 1 July 2019. Property managers and landlords should ensure that the insulation is in line with this new standard. In some instances, current ceiling insulation, or the insulation of the sub floor space may need to be added or replaced.

A house that is well-insulated can help control condensation, and decrease the risk of mould and dampness, and it will make it easier to the house to retain heat.

A ground moisture barrier is generally made of polythene and is laid on top of the ground to stop any moisture in the ground from entering the home. It also helps in preventing moisture damage to the underfloor insulation.
