Did you know that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords must ensure that their Naenae rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rentals must be fully in compliance by July 1st 2024.

Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed for a Naenae rental property, all Healthy Homes compliance work need to be taken care of inside of 90 days.

From the 1st of July in 2021, when a brand new or renewed lease is entered into on the Naenae rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to comply with each of Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included within the new, renewed or revised tenancy agreement there could be additional penalties or an infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the property they are living in. If the property manager fails to provide the information requested within 21 days from having received the inquiry, they can receive an infringement notification and could be fined up to $750.

Furthermore, there’s also a penalty of up to $900 for landlords or property managers that provide false or inaccurate Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the person who is identified on the tenancy agreement as being the person leasing the property out which could be the name of the landlord, or the company that manages the property.

All the information on the Statement of Compliance requirements to be up-to-date at the time that the tenancy agreement is completed, and should be kept updated throughout the tenancy as any related work is completed.

It is also important to keep in mind that a landlord who have multiple rental properties may face more severe penalties for not complying. The highest penalties are reserved for the most serious violations. Those who have six or more properties could be fined as high as $50,000, and even as high as $100,000 in hearing claims.

Naenae Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is mandatory for all Naenae and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate the conformance to any Healthy Homes Standards that apply or will be applied during the tenure of an apartment rental.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a new, renewed , or altered Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All homes rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Naenae

Rental properties in Naenae should have a permanent source of heating which can warm the main or largest living room to at least 18 degrees Celsius, even on the winter coldest days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat requirements to remain fixed (i.e. not portable) with at least 1.5 Kilowatts in heating capacity, and it must have the minimum heating capacity needed for the main living room. The Heating Assessment Tool can be used to determine whether the fixed heater(s) are adequate or if you’ll need to ‘top up’ by adding a second heater. If the heating that you provide is electric heating or heat source, it must be equipped with an thermostat. This will make the heating more uniform and efficient. In most houses, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in certain instances like apartments with small spaces, a smaller fixed electric heater could be enough.

Insulation Naenae

Insulation for underfloor and ceilings is mandatory to all rental houses from 1 July 2019. All landlords and property managers must ensure that the insulation is in line with this new quality. In some cases, existing ceiling insulation or insulation in the sub floor space might require to be added or replaced.
