Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords now have to make sure that their Mount Victoria rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any renewal or new tenancy and all private rental properties are required to be fully compliant by 1 July 2024.

Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed on a Mount Victoria rental property, all Healthy Homes compliance items must be completed within 90 days.

From the 1st of July in 2021, when a new or renewed Tenancy is signed for the Mount Victoria rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with any of the Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. Furthermore, if a existing Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy contract, it could result in an additional fine or infringement fee.

Anyone can request details about the Healthy Homes Standard and how they relate to the building they are living in. If the property manager is unable to supply the necessary information within 21 days of having received the inquiry, they could receive an infringement notification and be fined up to $750.

It’s important to note that landlords who own several rental properties can face additional fines for non-compliance. The highest penalties are reserved for severe violations, and landlords who own more than six properties could be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.

Mount Victoria Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is compulsory throughout Mount Victoria and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records of their conformance with all Healthy Homes Standards that apply or will be applicable during the tenure of the rental property.

Starting 1 July 2021

  • Property managers and private landlords must ensure their rental properties conform to the Healthy Homes Standards within 90 days of a new, renewed or varied tenant.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draughts can lead to less temperature in households. A cold home will cost more to heat, which results in wasting energy and incurring higher costs.

If a draught is felt through gaps that are too large or holes the area needs to be closed.

What are unreasonable gaps and holes?

If you are able to feel external air entering or an unobstructed draught coming from a crack or a gap, then it is probably a gap or crack that requirements sealing in some way. Cracks or gaps with large gaps must be fixed permanently. Gaps greater than 3mm that let air into or out within the home require to be sealed. For example, if an open fireplace isn’t in use it may cause draughts and should be blocked off. Property managers and landlords are accountable for ensuring that these draughts are stopped in the maximum extent imaginable.

There is no require to block off holes or gaps which are part of the construction. For example, tiny gaps around windows and doors could be required to allow for movement within the structure when the home warms and cools in order to let them be closed and opened rather than being stuck. Heating Mount Victoria

Rental properties in Mount Victoria need to have a stable heating source which can warm the largest or main living space to at least 18degC, even on the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating needs to remain fixed (i.e. not portable) and at minimum 1.5 kW of heating capacity and have the minimum requirement for heat capacity to heat the living space in general. A Heating Assessment Tool may be used to check if your current fix heater(s) are sufficient or if you’ll require to ‘top up’ by adding a second heater. Fires that are open and unflued heaters, such as small portable LPG bottle heaters are not considered to be suitable heating options under the Healthy Homes Standard.

If the heating that you provide is electric heating or heat source, it should be equipped with a thermostat. This will help make the heating more reliable and efficient. For most homes, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in some cases such as small apartments the smaller fixed electric heater could be enough.

If the main living room already has a central heating source, such as heat pumps, it may require a top up to meet the standards. Certain kinds of heaters cannot be used to comply with the quality because they’re expensive, inefficient and/or unhealthy to run.

Ventilation Mount Victoria

Every living space of a rental house must include at least one open windows or an exterior door to provide natural airflow. Additionally, areas with high moisture areas such as kitchens or bathrooms need to have an venting fan outside to get rid of moisture.

Insulation for underfloor and ceilings has been compulsory for all rent houses since July 1, 2019. Property managers and landlords are required to ensure that the insulation meets this new standard. In some cases, an existing insulation on the ceiling or in the subfloor space might need to be added or replaced.

A well-insulated house will reduce the risk of condensation and reduce the chances of mould and dampness and it will make an easier task to the house to keep the heat.
