Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed for a Moera rental property, all Healthy Homes compliance items need to be taken care of within 90 days.

From the 1st of July in 2021, once a new or renewed lease is entered into on the Moera rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Inability to adhere to all of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included within the new, renewed or revised tenancy contract, it could result in an additional fine or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the property they live in. If the property manager does not provide the information requested within 21 days of getting the notice, the tenant could receive an infringement notice and be fined up to $750.

In addition, there’s an additional fine of up to $900 for landlords or property managers providing a false or false Healthy Homes Compliance Statement or information. The person who is responsible for this fine is the one who is identified on the tenancy agreement as being the person renting the property which could be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement needs to be accurate when the tenancy contract is executed, and it is updated through the tenancy period as associated work has been completed.

It’s also important to keep in mind that landlords who have several rental properties can face more severe penalties for not complying. The highest penalties are reserved for serious violations. Those who have more than six properties could be fined as high as $50,000, and as much as $100,000 in hearing claims.

Moera Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory for all Moera and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords are required to keep records that prove the compliance with all Healthy Homes Standard that apply or will apply throughout the tenancy period of an apartment rental.

From July 1st 2021

  • Private landlords and property managers should make sure their rental properties comply to the Healthy Homes Standards within 90 days of a renewal, new or a change in tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All households let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of when the tenancy began.

If you are able to feel external air flowing in or a clear draught from a gap or hole, then it is most likely a gap or hole which needs sealing in any way. Cracks or gaps with large gaps must be fixed permanently. Any gaps greater than 3mm that allow air to enter or exit from your home require the sealing. In the case of an open fireplace isn’t in use it could cause draughts, and should be blocked from. Landlords and property managers are responsible for ensuring that such draughts are squelched in the maximum extent possible.

There is no need to block gaps or holes that are part of the building. For example, tiny gaps around doors and windows could be required to allow for movement within the structure as the home is heated and cools to allow them to be closed and opened rather than sticking. Proper heating is crucial for healthy houses

Heating Moera

Rental properties in Moera must have a fixed heating source that can heat the main or largest living space to a minimum of 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat requirements to be fixed (i.e., not portable) and at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum requirement for heat capacity in the living area. However, in certain instances like small apartment buildings, a smaller fixed electric heater might be enough.

If your living space is already equipped with a fixed heating source, such as an air conditioner, it might need an upgrade in order to comply with the standards. Some types of heaters can’t be used to comply with the standard because they’re inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Moera
