Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on a Moera rental property, all Healthy Homes compliance tasks need to be done inside of 90 days.

As of 1st July 2021, if a new, renewed or varied lease is entered into on a Moera rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Inability to adhere to one of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. The person liable for this fine is the person who is identified on the tenancy agreement as the one who is renting the property which could be the name of the landlord as well as the company that manages the property.

All information in the Statement of Compliance requirements to be accurate before the tenancy agreement can be completed, and should be maintained during the entire tenancy, as associated work has been completed.

When Do I require to be in compliance with the Healthy Homes Standards?

Moera Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is mandatory in all Moera and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any new, renewed or modified tenancy agreement.

From 1 July 2021

  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must meet the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Moera rental properties need to have a stable source of heating that can heat the main or largest living space to a minimum of 18degC even on the winter coldest days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.
