Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed for a Moera rental property, all Healthy Homes compliance tasks have to be completed within 90 days.

From the 1st of July in 2021, once a new or renewed contract is signed on a Moera rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Inability to adhere to each of Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or revised tenancy agreement there could be additional penalties or an infringement fee.

All information in the Compliance Statement needs to be accurate before the tenancy agreement can be signed. It should be maintained throughout the duration of the tenancy when any necessary work related to it is finished.

It’s also important to note that a landlord who own multiple rental properties could face even higher fines for non-compliance. The most severe penalties are reserved for the most serious violations, and landlords who own six or more properties could receive fines of up to $50,000, and even as high as $100,000 in hearings.

Moera Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is mandatory to all Moera and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records of their compliance with each Healthy Homes Standard that apply or will apply during the tenure of their rental properties.

From 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any new, renewed , or altered Tenancy.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Heating Moera

Moera rental properties should have a permanent heating source that is able to heat the largest or main living room to at least 18degC, even during the coldest winter days. Ventilation Moera
