Fines for Failing to Comply
From the 1st of July in 2021, once a new, renewed or varied tenancy is signed for a Miramar rental property, all Healthy Homes compliance items must be finished inside of 90 days.
As of 1st July 2021, when a new or renewed lease is entered into on the Miramar rental property, all Healthy Homes compliance work must be done within 90 days.
Failure to comply with all of the Healthy Homes Standards inside of the deadlines can result in a fine of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t incorporated within an updated, renewed, or revised tenancy agreement there may be an additional fine or infringement fee.
Any tenant may request information regarding the Healthy Homes Standard and how they relate to the property they reside in. If the property manager is unable to provide the necessary information within 21 days of having received the inquiry, they will receive an infringement letter and could be fined up to $750.
Furthermore, there’s also a fine of as much as $900 for landlords or property managers who provide a false or inaccurate Healthy Homes Compliance Statement or information. The person who is responsible for this fine is the one who is named on the lease contract as the person who is letting the property, so it could be the landlord’s name or the company that manages the property.
All information in the Compliance Statement requirements to be accurate before the tenancy agreement can be signed, and ideally it should be maintained throughout the duration of the tenancy when any related work is completed.
It is crucial to remember that a landlord with multiple rental properties may face additional fines for non-compliance. The harshest penalties are handed down for severe violations, and landlords who own six or more properties could be fined as high as $50,000 and as high as $100,000 in hearings.
