Did you be aware that the Healthy Homes Standards came into effective on July 1st, 2021? Landlords now have to ensure that their Melling rental properties meet the minimum Healthy Homes Standards within 90 days of any renewal or new tenancy and all private rental properties must be completely conforming by the 1st July 2024.

Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed for a Melling rental property, all Healthy Homes compliance items need to be done within 90 days.

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on the Melling rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to adhere to any of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy agreement, there may be an additional penalty or infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the building they are living in. If the property manager is unable to supply the necessary information within 21 days of being informed of the request, they will receive an infringement letter and be fined as high as $750.

Furthermore, there’s also a penalty of approximately $900 for landlords or property managers providing a false or incorrect Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the one who is listed on the tenancy agreement as the person who is renting the property and it could be the name of the landlord as well as the company that manages the property.

All information in the Statement of Compliance requirements to be accurate at the time that the tenancy agreement is signed. It is updated throughout the tenancy as any necessary work related to it’s finished.

It is important to keep in mind that a landlord who own several rental properties can face greater penalties for non-compliance. The highest penalties are reserved for serious breaches, and landlords with at least six rental properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

Melling Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement to all Melling and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the conformance to the Healthy Homes Standards that apply or will be applied throughout the tenancy period of their rental properties.

From 1 July 2021

  • Property managers and private landlords should make sure their rental properties conform to the Healthy Homes Standard within 90 days of any renewal, new or a change in tenancy.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must adhere to the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Melling

Draughts increase the likelihood of less temperature in households. A draughty home will cost more to heat, resulting in wasted energy and incurring higher costs.

What are the most unreasonable gaps or holes?

If you are able to feel external air entering or an unobstructed draught coming from a crack or a gap and you can feel it, it is most likely a gap or hole that needs sealing in somehow. Cracks or gaps with large gaps must be stopped permanently. Any gaps greater than 3mm that let air in or out within your house require seals. For instance, if an open fireplace isn’t being used, it may cause draughts and must be sealed off. Property managers and landlords are accountable for making sure that these draughts are stopped as far as possible.

There is no need to cover up gaps or holes that are part of the construction. For instance, small gaps around doors and windows could be necessary to allow for the movement of the building when the home gets warmer and cooler, in order to let them be closed and opened rather instead of being stuck. Heating Melling

Melling rental properties must have a fixed heating source that can heat the main or largest living space to at least 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source needs to remain fixed (i.e., not portable), at least 1.5 kW of heating capacity and have the minimum heating capacity needed in the living area. A Heating Assessment Tool could be used to determine whether the current fixed heater(s) are sufficient or whether you will require to top up with an additional heater. Open fires as well as unflued combustion heaters, such as mobile LPG bottle heaters aren’t considered to be safe heating options for the Healthy Homes Standard.

Ventilation Melling

Insulation Melling

The insulation of the ceiling and underfloor is mandatory on all rental homes since 1 July 2019. Property managers and landlords must make sure the insulation meets current standard. In certain situations, the old ceiling insulation as well as insulation within the sub floor space may need to be added or replaced.
