Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Maupuia rental property, all Healthy Homes compliance items need to be finished inside of 90 days.

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed on the Maupuia rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Maupuia Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory throughout Maupuia and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records that prove the compliance with any Healthy Homes Standard that apply or will be applied to their rental properties.

Starting 1 July 2021

  • Property managers and private landlords have to ensure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of a newly renewed, extended or changed lease.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must adhere to the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Heating Maupuia

Maupuia rental properties need to have a stable source of heat that can heat the living area to at minimum 18 degrees Celsius, even on the winter coldest days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating requirements to remain fixed (i.e., not portable) that is, at minimum 1.5 kW in heating capacity, and meet the minimum requirement for heat capacity for the main living space.
