Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed for a Maupuia rental property, all Healthy Homes compliance items have to be completed by the end of 90 days.

As of 1st July 2021, once a new or renewed contract is signed on a Maupuia rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet one of the Healthy Homes Standards within the deadlines can result in a fine of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy agreement there may be an additional penalty or infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager fails to provide the necessary information within 21 days of having received the inquiry, they could receive an infringement notice and be fined as high as $750.

In addition, there is also a penalty of as much as $900 for landlords or property managers that provide false or inaccurate Healthy Homes Compliance Statement or other information. The person who is liable to pay this fine is the one who is named on the lease agreement as the person who is letting the property out which could be the name of the landlord as well as the company that manages the property.

Maupuia Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement to all Maupuia and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records of their conformance with the Healthy Homes Standard that apply or will be applied to an apartment rental.

Beginning 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of any renewal, new or a change in lease.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts can lead to dropping temperatures within houses. A draughty home will cost more to heat, which completed jobs in wasting energy and resulting in higher bills.

If a draught could be noticed from gaps that are not adequate or holes the area needs to be sealed.

What are unreasonable gaps or holes?

If you can feel external air coming in or the sound of a clear draught emanating from a crack or a gap or crack, then it is likely to be a gap or hole that needs sealing in the way you can. Cracks or gaps with large gaps must be sealed permanently. The gaps that exceed 3mm that allow air in or out of the home require seals. For example, if the open fireplace isn’t being used, it may cause draughts and should be shut from. Landlords and property managers are responsible for ensuring such draughts are eliminated as much as imaginable.

There is no need to block up intentional holes or gaps which are part of the building. For instance, small gaps around doors and windows could be required to allow for movement within the building as the house warms and cools so that they can still be closed and opened rather than securing. Adequate heaters are crucial to ensure well-being houses

Heating Maupuia

Rental properties in Maupuia must have a fixed heating source that can heat the living room to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source needs that it be permanently fixed (i.e., not portable) and at minimum 1.5 horsepower in capacity and have the minimum required heating capacity in the living area. If your main living space already has a fixed heating source, such as an air conditioner, it might require some additional energy in order to comply with the standards. Certain kinds of heaters aren’t able to be used to meet the standard since they’re either costly, not cost-effective to run, and/or unhealthy to run.

Insulation for underfloor and ceilings has been compulsory for all rent homes from 1 July 2019. All landlords and property managers must ensure that the insulation is in line with this new standard. In some cases, current ceiling insulation, or the insulation of the sub floor space might require to be topped up or replaced.
