Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed for a Manor Park rental property, all Healthy Homes compliance items have to be done inside of 90 days.

The person who is responsible for this fine is the person who is named on the tenancy agreement as the person who is leasing the property out which could be the landlord’s name or the company that manages the property.

All information in the Statement of Compliance requirements to be current at the time that the tenancy agreement is signed, and ideally it should be maintained throughout the duration of the tenancy when any associated work has been completed.

It is also important to be aware that a landlord who manage several rental properties can face more severe penalties for not complying. The harshest penalties are handed down for the most serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000 and as high as $100,000 in the case of hearing claims.

Manor Park Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is required to all Manor Park and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records that demonstrate the compliance with any Healthy Homes Standards that apply or will apply during the tenancy of the rental property.

Starting 1 July 2021

  • Property managers and private landlords should make sure their rental properties conform with the Healthy Homes Standards within 90 days of a renewal, new or a change in tenant.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Heating Manor Park

Manor Park rental properties should have a permanent heating source which can warm the living room to at least 18 degrees Celsius, even on the winter coldest days. Some types of heaters can’t be used to achieve the standard since they’re either inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Manor Park
