Fines for Failing to Comply
As of 1st July 2021, if a new, renewed or varied contract is signed on a Manor Park rental property, all Healthy Homes compliance items need to be completed by the end of 90 days.
Beginning on July 1st, 2021, when a brand new, renewed or varied Tenancy is signed for a Manor Park rental property, all Healthy Homes compliance work must be done by the end of 90 days.
Failure to meet any of the Healthy Homes Standards inside of the expected timeframe can result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or revised tenancy contract, it could result in an additional penalty or infringement fee.
Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the property they live in. If the property manager fails to provide the information requested within 21 days of having received the inquiry, they will receive an infringement letter and be fined up to $750.
In addition, there’s also a penalty of as much as $900 for landlords and property managers who have provided a false or false Healthy Homes Statement of Compliance or information. The person who is liable to pay this fine is the one who is identified on the tenancy agreement as the person who is leasing the property out which could be the name of the landlord, or the property management company.
The information contained in the Statement of Compliance requirements to be correct before the tenancy agreement can be completed, and must be updated throughout the duration of the tenancy when any necessary work related to it is finished.
It is also crucial to note that a landlord who own several rental properties can face more severe penalties for not complying. The most severe penalties are handed down for severe violations, and landlords who own six or more properties can be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.
