Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed contract is signed on a Manor Park rental property, all Healthy Homes compliance items must be completed within 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied contract is signed on the Manor Park rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet one of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. Additionally, if the most present Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy agreement, there may be additional penalties or an infringement fee.

It is important to keep in mind that landlords who manage multiple rental properties may receive additional fines for non-compliance. The most severe penalties are handed down for severe breaches. Landlords with at least six rental properties could be fined as high as $50,000, or as high as $100,000 in hearings.

Manor Park Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory throughout Manor Park and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that prove compliance with the Healthy Homes Standards that apply or will apply to your rental home.

From July 1st 2021

  • Property managers and private landlords are required to make sure their rental properties conform with the Healthy Homes Standard within 90 days of a new, renewed , or altered tenancy.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must meet the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All households rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy first began.

Manor Park rental properties must have a fixed source of heating which can warm the principal or the biggest living space to a minimum of 18degC, even during the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

For the majority of homes, bigger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in certain instances like small apartments small apartments, a smaller electric fixed heater might be enough.

If the main living room already has a central heating source, such as the heat pump, it might need a top up to ensure it meets the requirements. Certain types of heaters cannot be used to achieve the quality as they are either inefficient, unaffordable to operate or unsafe to operate.
