Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed for a Manor Park rental property, all Healthy Homes compliance items have to be done by the end of 90 days.

Since the 1st July of 2021, when a brand new or renewed lease is entered into on a Manor Park rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet each of Healthy Homes Standards within the expected timeframe can result in the possibility of a fine up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy agreement it could result in an additional fine or infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the property they live in. If the the property manager doesn’t provide the information requested within 21 days from being informed of the request, they may receive an infringement notification and be fined up to $750.

Additionally, there is an additional fine of as much as $900 for landlords or property managers that provide false or false Healthy Homes Compliance Statement or information. The person responsible to pay this fine is the one who is listed on the tenancy contract as the person who is letting the property, so it could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement needs to be current when the tenancy agreement is executed, and it should be maintained throughout the duration of the tenancy when any associated work has been completed.

It’s also important to remember that landlords who own multiple rental properties could face even higher fines for non-compliance. The harshest penalties are handed down only for serious violations. Those who have at least six rental properties could be fined as high as $50,000 and as high as $100,000 for hearing claims.

Manor Park Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory for all Manor Park and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records that prove the conformance to the Healthy Homes Standards that apply or will be in force to the rental property.

Starting 1 July 2021

  • Private landlords and property managers must ensure their rental properties comply according to Healthy Homes Standards within 90 days of any new, renewed or varied tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Heating Manor Park

Rental properties in Manor Park need to have a stable heating source that can warm the principal or the biggest living room to at least 18 degrees Celsius, even on the winter coldest days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heating needs to remain fixed (i.e. not portable) that is, at minimum 1.5 kW in heating capacity, and must meet the minimum capacity for heating required for the main living room. Ventilation Manor Park

The insulation of the ceiling and underfloor is required in all rental homes from 1 July 2019. All landlords and property managers should make sure that the insulation meets the new quality.
