Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed on a Manor Park rental property, all Healthy Homes compliance work need to be completed inside of 90 days.

From the 1st of July in 2021, when a new or renewed lease is entered into on a Manor Park rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Inability to adhere to each of Healthy Homes Standards by the end of the anticipated timeframe could result in a fine of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy agreement, there could be an additional fine or infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager is unable to supply the information requested within 21 days from being informed of the request, they will receive an infringement notice and be fined as high as $750.

Furthermore, there’s an additional fine of up to $900 for landlords and property managers who provide a false or inaccurate Healthy Homes Compliance Statement or information. The person liable for this fine is the one who is named on the lease agreement as being the person renting the property It could also be the landlord’s name or the company that manages the property.

All the information on the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is completed, and should be maintained throughout the duration of the tenancy when any relevant work gets completed.

It is important to remember that landlords who manage multiple rental properties may face greater penalties for non-compliance. The harshest penalties are handed down for severe violations, and landlords who own at least six rental properties could receive fines of up to $50,000, and as much as $100,000 for hearing claims.

Manor Park Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is compulsory throughout Manor Park and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords must keep records that prove compliance with all Healthy Homes Standards that apply or will be in force during the tenure of their rental properties.

From July 1st 2021

  • Private landlords and property managers have to ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All households let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts are a major cause of dropping temperatures within homes. A draughty home is more expensive to heat, which means wasting energy and resulting in higher bills.

For example, if an open fireplace isn’t being used, it can cause draughts and must be sealed off. Landlords and property managers are responsible for making sure that such draughts are squelched in the maximum extent possible.

There is no require to block off gaps or holes which are part of the construction. Heating Manor Park
