Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied contract is signed on a Linden rental property, all Healthy Homes compliance tasks need to be done within 90 days.

Furthermore, there’s an additional fine of as much as $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the person who is named on the tenancy contract as the person letting the property out, so it could be the name of the landlord as well as the property management company.

The information contained in the Statement of Compliance requirements to be accurate when the tenancy agreement is executed, and it must be updated throughout the tenancy as any related work is completed.

It is important to keep in mind that a landlord with multiple rental properties may receive even higher fines for non-compliance. Linden Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is required in all Linden and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records that demonstrate compliance with any Healthy Homes Standard that apply or will be applied throughout the tenancy period of your rental home.

From 1 July 2021

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of when the tenancy began.

Heating Linden

Rental properties in Linden must have a fixed source of heating that can warm the largest or main living space to at least 18degC, even on the coldest winter days.
