Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed contract is signed on a Linden rental property, all Healthy Homes compliance work have to be completed within 90 days.

Since the 1st July of 2021, if a new, renewed or varied Tenancy is signed for a Linden rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to meet any of the Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy agreement it could result in an additional fine or violation fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the building they live in. If the property manager fails to supply the necessary information within 21 days of being informed of the request, they will be issued an infringement notice and be fined as high as $750.

Furthermore, there’s an additional fine of approximately $900 for landlords and property managers providing a false or incorrect Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the one who is listed on the tenancy contract as the person renting the property and it could be the landlord’s name or the property management company.

All the information on the Statement of Compliance requirements to be current at the time that the tenancy agreement is executed, and it must be updated during the entire tenancy, as relevant work gets completed.

It is also crucial to note that landlords who own multiple rental properties may face additional fines for non-compliance. The most severe penalties are given for the most serious violations. Those who have six or more properties can be fined as high as $50,000, and even as high as $100,000 in hearing claims.

Linden Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory to all Linden and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords must keep records of their the conformance to all Healthy Homes Standard that apply or will be applied during the tenancy of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers must make sure their rental properties comply to the Healthy Homes Standard within 90 days of any new, renewed or varied lease.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All homes let through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.

Draughts can lead to lower temperatures in homes. A humid house costs more to heat, which means wasting energy and increased bills.

What are the most unreasonable gaps or holes?

If you are able to feel external air flowing in or the sound of a clear draught emanating from a crack or a gap that is, it is probably a gap or an opening that needs sealing in somehow. Large gaps and cracks should be sealed permanently. Any gaps greater than 3mm that allow air in or out within the home need sealing. For instance, if an open fireplace isn’t being used, it may cause draughts and should be shut from. Landlords and property managers are accountable for making sure that these draughts are stopped as much as imaginable.

You don’t need to block off gaps or holes in the construction. For instance, small gaps around windows and doors may be required to allow for movement within the structure as the house gets warmer and cooler, to allow them to be shut and opened, rather instead of being stuck. Proper heating is crucial for healthy homes

Heating Linden

Linden rental properties should have a permanent source of heating that can warm the largest or main living room to at least 18degC, even during the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating needs to be fixed (i.e. not portable), at minimum 1.5 kW of heating capacity, and must meet the minimum capacity for heating required to heat the living space in general. A Heating Assessment Tool could be used to determine if the permanent heater(s) are adequate or whether you will require to "top-up" with a new heater. Unflued combustion and open fire heaters such as portable LPG bottle heaters aren’t considered to be acceptable heating options under the Healthy Homes Standard.

If the heating you provide is an electric heater (or heat pump), it needs to be equipped with the thermostat. This will make the heating more reliable and efficient. For most homes, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters will be required. In some instances, like apartments with small spaces the smaller fixed electric heater may suffice.

If your living space already has a fixed heating source, like a heat pump, then it may require a top up to ensure it meets the requirements. Some types of heaters can’t be used to comply with the quality since they’re either costly, not affordable to run, and/or unhealthy to run.

Ventilation Linden

Each liveable space in a rental property must have at least one openable doors or windows to provide natural ventilation. Furthermore, moist areas such as kitchens or bathrooms must have a suitable externally vented extractor to eliminate moisture.

The ventilation standard is all about acknowledging how the dry atmosphere is easier to heat and the property that is properly ventilated will be less prone to developing mould and damp.

Bedrooms, living spaces, kitchens, and dining areas are considered to be liveable spaces. Connecting spaces such as the hallways are not liveable and therefore do not require an opening window or door.

Each window, door or Skylight needs to have the ability to open up to the outside while remaining fixed in an open position, allowing ventilation and fresh air ventilation.

Bathrooms, kitchens, as well as any other space in your property with shower, bath, cooktop or other high humidity-generating items will require appropriate extractor fans that can be vented towards the outside. Insulation Linden

In some instances, current ceiling insulation, or the insulation of the sub floor space may require to be filled with or replaced.

Linden Moisture Ingress & Drainage
