Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed for a Linden rental property, all Healthy Homes compliance items need to be finished by the end of 90 days.

Since the 1st July of 2021, once a new, renewed or varied contract is signed on a Linden rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to adhere to each of Healthy Homes Standards within the deadlines can result in the possibility of a fine up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy agreement, there could be additional penalties or an infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager is unable to supply the necessary information within 21 days from being informed of the request, they may receive an infringement notification and could be fined up to $750.

Additionally, there is an additional fine of approximately $900 for property owners or property managers that provide false or incorrect Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the person who is named on the tenancy contract as the person leasing the property out which could be the name of the landlord, or the property management company.

All information in the Statement of Compliance needs to be correct when the tenancy contract is signed, and ideally it must be updated throughout the duration of the tenancy when any associated work has been completed.

It is important to note that landlords with multiple rental properties may receive more severe penalties for not complying. The highest penalties are given for the most serious breaches, and landlords with at least six rental properties could be penalised up to $50,000 and as high as $100,000 in hearings.

Linden Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and 30 June 2021

  • Ceiling and underfloor insulation is compulsory throughout Linden and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records of their the conformance to all Healthy Homes Standard that apply or will apply during the tenure of their rental properties.

From 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenant.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All homes that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Linden

Draughts may lead to low temperatures inside homes. A draughty house will cost more to heat, meaning wasting money and energy.

If a draught can be noticed from gaps that are not adequate or holes the area requirements to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air entering or an unobstructed draught coming from a hole or gap or crack, then it is probably a gap or crack that requirements sealing in any way. Large gaps and cracks should be fixed permanently. The gaps that exceed 3mm that let air in or out from the home need the sealing. For example, if an open fireplace isn’t in use it can cause draughts and should be shut from. Landlords and property managers are responsible for making sure that these draughts are stopped as much as imaginable.

There is no need to block gaps or holes that are part of the building. For instance, small gaps around windows and doors could be required to allow for movement within the structure when the household gets warmer and cooler, to allow them to be closed and opened instead of than securing. Proper heating is crucial for well-being homes

Heating Linden

Linden rental properties must have a fixed source of heat which can warm the principal or the biggest living area to at minimum 18 degrees Celsius, even on the most coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating requirements to remain fixed (i.e., not portable) with at minimum 1.5 kW in heating capacity, and must meet the minimum capacity for heating required for the main living space. The Heating Assessment Tool can be used to determine whether your current fix heater(s) are sufficient or whether you will need to top up with an additional heater. Open fires as well as unflued combustion heaters like portable LPG bottle heaters are not considered to be acceptable heating options in Healthy Homes Standard. Healthy Homes Standard.

If the heating you provide is electric heating or heat pump, then it must be equipped with the thermostat. This makes the heating more uniform and effective. In most homes, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. However, in some cases such as small apartments an electric, fixed heater may suffice.

If the main living room already has a permanent heating source, such as a heat pump, then it could require some additional energy to meet the standards. Certain kinds of heaters aren’t able to be used to meet the standard because they’re expensive, inefficient and/or unsafe to run.

Ventilation Linden

Each liveable space in a rental property has to have at least one openable doors or windows to provide natural ventilation. In addition, humid spaces like kitchens and bathrooms must have a suitable externally vented extractor fan that can eliminate moisture.

Insulation Linden

Underfloor and ceiling insulation is required in all rental homes since 1 July 2019. Property managers and landlords have to ensure that the insulation meets the new quality. In some instances, an existing insulation on the ceiling or in the sub floor space may require to be added or replaced.

A well-insulated property can help control condensation and reduce the chances of mould and dampness and will also make more easy to the home to retain heat.

The "R" is a symbol for thermal resistance, and is a measure of how well insulation can withstand heat flow. The more R-value is higher, the more effective the insulation.

Alongside a drainage system to prevent moisture ingress, if your rental is enclosed between your floor and the soil, a ground-water barrier must be installed if it is reasonably practicable to install it.

A ground moisture barrier is typically a polythene sheet laid over the ground, in order to block any moisture in the ground from entering the property. It also helps to prevent moisture damage to the underfloor insulation.
