Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Linden rental property, all Healthy Homes compliance tasks must be finished by the end of 90 days.

From the 1st of July in 2021, if a new or renewed tenancy is signed on a Linden rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with all of the Healthy Homes Standards inside of the deadlines can result in an amount of $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy agreement there may be an additional penalty or infringement fee.

If the the property manager doesn’t provide the necessary information within 21 days of having received the inquiry, they can receive an infringement letter and could be fined up to $750.

The person liable for this fine is the person who is named on the lease agreement as the person who is leasing the property out It could also be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance needs to be current when the tenancy agreement is executed, and it should be maintained throughout the duration of the tenancy when any relevant work gets completed.

It is also important to remember that landlords who have several rental properties can face greater penalties for non-compliance. The most severe penalties are handed down for the most serious breaches. Landlords with at least six rental properties could be fined as high as $50,000, or as high as $100,000 in hearing claims.

Linden Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory for all Linden and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records of their the conformance to any Healthy Homes Standard that apply or will be applied during the tenure of an apartment rental.

From 1 July 2021

  • Property managers and private landlords have to ensure their rental properties conform to the Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.
  • All boarding households (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals houses must comply with the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts increase the likelihood of lower temperatures in homes. A draughty house will cost more to heat, meaning wasting energy and increased bills.

If a draught can be noticed from gaps that are not adequate or holes that it needs to be closed.

What are unjustifiable gaps or holes?

If you are able to feel external air entering or a clear draught from a hole or gap that is, it’s probably a gap or crack that needs sealing in somehow. Cracks or gaps with large gaps must be permanently stopped. The gaps that exceed 3mm that allow air to enter or exit from your house require the sealing. In the case of an open fireplace is not in use, it can cause draughts and should be blocked from. Landlords and property managers are responsible for making sure that such draughts are squelched as much as possible.

There is no need to cover up holes or gaps in the building. For example, tiny gaps around windows and doors may be required to allow for movement of the structure as the home warms and cools so that they are able to be closed and opened rather than securing. Heating Linden

Rental properties in Linden must have a fixed source of heating which can warm the main or largest living room to at least 18degC, even on the winter coldest days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating requirements that it be permanently fixed (i.e. not portable) with at least 1.5 horsepower in capacity, and it must have the minimum requirement for heat capacity to heat the living space in general. In certain situations, like apartments with small spaces an electric, fixed heater may suffice.

If your main living space already has a fixed heating source, like an air conditioner, it could need an upgrade in order to comply with the standards. Some types of heaters can’t be used to comply with the standard as they are either not efficient, cost prohibitive to operate or are unsafe to operate.

Ventilation Linden

Each liveable space in the rental property should include at least one open door or window to provide natural ventilation. Additionally, areas with high moisture areas such as kitchens or bathrooms should be equipped with an externally vented extractor fan that can get rid of moisture.

This ventilation standard is all about understanding how dry air is much easier to heat, and that an apartment that is well-ventilated is less likely to grow mould and damp.

Bedrooms, living rooms, dining rooms, and kitchens are considered to be liveable spaces. Connecting spaces like the hallway aren’t liveable and do not need an opening door or window.

Insulation Linden

Insulation for underfloor and ceilings has been compulsory to all rental homes as of July 1st, 2019. All landlords and property managers are required to ensure that the insulation is in line with current standard. In some instances, old ceiling insulation as well as insulation within the sub floor space may need to be filled with or replaced.
