Fines for Failing to Comply

Linden Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory for all Linden and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the conformance to each Healthy Homes Standards that apply or will apply during the tenure of their rental properties.

Beginning 1 July 2021

If a draught is felt from unreasonable gaps or holes, it needs to be sealed.

What are unreasonable gaps and holes?

If you are able to feel external air coming in or an unobstructed draught coming from a gap or hole or crack, then it’s likely to be a gap or hole that needs sealing in some way. Large gaps and cracks should be stopped permanently. Cracks that are greater than 3mm and allow air in or out within your house require sealing. For example, if an open fireplace isn’t used it may cause draughts and must be sealed off. Landlords and property managers are responsible for making sure that such draughts are squelched as far as possible.

You don’t need to cover up gaps or holes in the construction. For example, tiny gaps around windows and doors could be necessary to allow for the movement of the building when the household heats and cools, so that they are able to be shut and opened, rather than being stuck. Heating Linden

Linden rental properties need to have a stable source of heating that is able to heat the principal or the biggest living space to at least 18degC even on the winter coldest days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source needs to be fixed (i.e., not portable), at least 1.5 kW in heating capacity, and must meet the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool could be used to check if your current permanent heater(s) are adequate or if you’ll require to "top-up" with a new heater. Unflued combustion and open fire heaters like the portable LPG bottle heaters aren’t considered to be suitable heating options for the Healthy Homes Standard.

If the heating that you provide is an electric heater or heat source, it should have a thermostat. This will help make your heating more consistent and efficient. For most homes, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In some instances, like apartments with small spaces, a smaller fixed electric heater might be enough.

If the main living room already has a fixed heating source, such as an air conditioner, it might just require an upgrade to be able to meet the standards. Some types of heaters can’t be used to comply with the quality as they are either expensive, inefficient and/or unsafe to run.
