Fines for Failing to Comply

When Do I require to be in compliance with the Healthy Homes Standards?

Linden Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is compulsory for all Linden and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the compliance with any Healthy Homes Standards that apply or will be applied during the tenancy of an apartment rental.

From July 1st 2021

  • Property managers and private landlords are required to make sure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of any new, renewed , or altered Tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Linden

Draughts can lead to less temperature in homes. A cold house is more expensive to heat, resulting in wasted energy and increased bills.

If a draught can be felt through gaps that are too large or holes or holes, it needs to be closed.

Adequate heaters are crucial for healthy homes

Heating Linden

Linden rental properties should have a permanent source of heating which can warm the principal or the biggest living area to at minimum 18degC, even during the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source needs that it be permanently fixed (i.e., not portable) that is, at minimum 1.5 kW in heating capacity, and must meet the minimum capacity for heating required for the main living space. For most properties, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters will be required. In some instances, like small apartment buildings, a smaller fixed electric heater may be sufficient.

If your living space already has a permanent heating source, such as heat pumps, it could need an upgrade to meet the standards. Some types of heaters can’t be used to meet the standard as they are either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Linden

Every living space of a rental property has to include at least one open doors or windows to provide natural ventilation. In addition, humid spaces like kitchens and bathrooms should have an venting fan outside to eliminate moisture.
