Fines for Failing to Comply

As of 1st July 2021, when a new or renewed contract is signed on a Linden rental property, all Healthy Homes compliance tasks must be done inside of 90 days.

As of 1st July 2021, if a new, renewed or varied Tenancy is signed for a Linden rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Linden Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory throughout Linden and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the conformance to the Healthy Homes Standards that apply or will be in force to the rental property.

From 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties conform with the Healthy Homes Standards within 90 days of a new, renewed , or altered tenant.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Ventilation Linden
