Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Kingsley Heights rental property, all Healthy Homes compliance items must be completed by the end of 90 days.

As of 1st July 2021, when a new or renewed lease is entered into on the Kingsley Heights rental property, all Healthy Homes compliance work must be finished within 90 days.

Inability to adhere to one of the Healthy Homes Standards within the deadlines can result in a fine of up to $7200. The information contained in the Statement of Compliance requirements to be correct at the time that the tenancy agreement is completed, and is updated throughout the duration of the tenancy when any necessary work related to it is finished.

It’s also crucial to note that landlords with multiple rental properties could face additional fines for non-compliance. The harshest penalties are reserved for serious violations, and landlords who own six or more properties can receive fines of up to $50,000 and as high as $100,000 in the case of hearing claims.

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory to all Kingsley Heights and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records that prove the conformance to the Healthy Homes Standard that apply or will be applicable throughout the tenancy period of the rental property.

From 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied tenancy.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All households rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
