Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed for a Kingsley Heights rental property, all Healthy Homes compliance tasks must be completed by the end of 90 days.

Beginning on July 1st, 2021, if a new or renewed contract is signed on the Kingsley Heights rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to adhere to any of the Healthy Homes Standards by the end of the anticipated timeframe could result in an amount of $7200. All information in the Statement of Compliance requirements to be correct at the time that the tenancy agreement is completed, and should be maintained during the entire tenancy, as relevant work gets completed.

It is also important to be aware that a landlord with multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are given only for serious violations, and landlords who own six or more properties can receive fines of up to $50,000, and even as high as $100,000 for hearing claims.

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is mandatory for all Kingsley Heights and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate the compliance with each Healthy Homes Standard that apply or will be applicable during the tenure of the rental property.

From July 1st 2021

  • Property managers and private landlords are required to make sure their rental properties comply with the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All boarder households (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.

If you can feel external air flowing in or an unobstructed draught coming from a gap or hole, then it’s probably a gap or crack that requirements sealing in some way. Large cracks and gaps should be sealed permanently. Gaps greater than 3mm that let air in or out of the home need seals. For example, if an open fireplace isn’t being used, it could cause draughts, and should be blocked off. Property managers and landlords are responsible for ensuring such draughts are eliminated in the maximum extent possible.

You don’t require to block up intentional gaps or holes in the construction. For example, tiny gaps around windows and doors may be required to allow movement of the structure when the household heats and cools, so that they can still be closed and opened rather than securing. Heating Kingsley Heights

Rental properties in Kingsley Heights must have a fixed heating source that is able to heat the living space to a minimum of 18degC, even during the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

The heating source needs to remain fixed (i.e. not portable) that is, at minimum 1.5 kW of heating capacity and have the minimum requirement for heat capacity for the main living space. A Heating Assessment Tool could be used to check if your current fix heater(s) are sufficient or if you’ll need to "top up" with a new heater. Open fires and unflued combustion heaters like the portable LPG bottle heaters are not considered to be acceptable heating options for the Healthy Homes Standard.

If the heating system you provide is an electric heater or heat source, it must have a thermostat. This makes the heating more consistent and efficient. For the majority of houses, bigger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. In some instances, such as small apartments an electric, fixed heater may be sufficient.

If the living area is already equipped with a fixed heating source, like the heat pump, it may require a top up to meet the standards. Some types of heaters can’t be used to meet the quality as they are either not efficient, cost prohibitive to operate and/or unhealthy to run.

Ventilation Kingsley Heights

Each living space within a rental property has to have at least one opening door or window to provide natural ventilation. Additionally, areas with high moisture areas such as kitchens and bathrooms should have an externally vented extractor to get rid of moisture.

The ventilation quality is all about acknowledging that dry air will be less difficult to heat, and that a well ventilated rental property is less likely to grow damp and mould.

In some cases, current ceiling insulation, or the insulation of the sub floor space might require to be filled with or replaced.
