Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Kingsley Heights rental property, all Healthy Homes compliance tasks have to be taken care of by the end of 90 days.

Since the 1st July of 2021, when a new, renewed or varied lease is entered into on the Kingsley Heights rental property, all Healthy Homes compliance work must be finished within 90 days.

Inability to adhere to any of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

Anyone can request information regarding the Healthy Homes Standard and how they relate to the property they live in. If the landlord or property manager does not supply the information requested within 21 days of receiving the request, they will be issued an infringement notice and be fined as high as $750.

The person responsible for this fine is whoever is named on the tenancy agreement as the one who is leasing the property out and it could be the landlord’s name or the property management company.

All information in the Statement of Compliance requirements to be up-to-date before the tenancy agreement can be signed, and ideally it must be updated throughout the duration of the tenancy when any necessary work related to it’s finished.

It is important to keep in mind that a landlord who own multiple rental properties may face additional fines for non-compliance. The highest penalties are handed down for the most serious breaches, and landlords with at least six rental properties could receive fines of up to $50,000, or as high as $100,000 in the case of hearing claims.

What time Do I need to meet the Healthy Homes Standards?

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory throughout Kingsley Heights and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records of their compliance with all Healthy Homes Standard that apply or will be applicable throughout the tenancy period of your rental home.

From 1 July 2021

  • Property managers and private landlords are required to ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All households rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draughts may lead to less temperature in households. A cold house will cost more to heat, which means wasting energy and resulting in higher bills.

If a draught can be felt from unreasonable gaps or holes, it needs to be sealed.

What are unreasonable gaps or holes?

If you can feel external air entering or an unobstructed draught coming out of a hole or gap or crack, then it’s likely to be a gap or crack that requirements sealing in any way. Cracks and gaps that are large should be fixed permanently. Cracks that are greater than 3mm and allow air to enter or exit of the home require to be sealed. For instance, if an open fireplace isn’t being used, it can create draughts. This must be sealed off. Property managers and landlords are responsible for ensuring that such draughts are squelched as much as imaginable.

You don’t require to block off holes or gaps in the building. For example, tiny gaps around doors and windows could be required to allow for movement of the building as the house is heated and cools so that they can still be shut and opened, rather than sticking. Heating Kingsley Heights

Kingsley Heights rental properties should have a permanent source of heat which can warm the principal or the biggest living room to at least 18 degrees Celsius, even on the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat needs to be fixed (i.e., not portable) with at minimum 1.5 kW in heating capacity, and meet the minimum heating capacity needed for the main living space. For the majority of houses, bigger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in some cases like small apartments an electric, fixed heater may suffice.

If the main living room already has a fixed heating source such as a heat pump, then it could need an update to be able to meet the standards. Certain kinds of heaters cannot be utilised to meet the quality as they are either not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Kingsley Heights

Ceiling and underfloor insulation has been compulsory on all rental houses since 1 July 2019. All landlords and property managers are required to ensure that the insulation is up to current quality. In some instances, an existing insulation on the ceiling or in the sub floor space may require to be filled with or replaced.
