Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed on a Kilbirnie rental property, all Healthy Homes compliance tasks have to be taken care of inside of 90 days.

The most severe penalties are reserved for serious violations, and landlords who own six or more properties can be fined as high as $50,000, and as much as $100,000 in hearing claims.

Kilbirnie Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement throughout Kilbirnie and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the compliance with the Healthy Homes Standard that apply or will be applied throughout the tenancy period of your rental home.

From 1 July 2021

  • Private landlords and property managers must ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied Tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All homes let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy first began.

Heating Kilbirnie

Rental properties in Kilbirnie require a reliable heating source that is able to heat the largest or main living room to at least 18 degrees Celsius, even on the coldest winter days.
