Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed on a Khandallah rental property, all Healthy Homes compliance tasks have to be done inside of 90 days.

Since the 1st July of 2021, if a new or renewed tenancy is signed on the Khandallah rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to adhere to one of the Healthy Homes Standards inside of the deadlines can result in an amount of $7200. Additionally, if a existing Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy agreement there may be additional penalties or an infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager is unable to provide the information requested within 21 days from getting the notice, the tenant can receive an infringement notice and be fined as high as $750.

Additionally, there is an additional fine of approximately $900 for landlords or property managers who offer a false or misleading Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the person who is named on the lease contract as the person who is letting the property and it could be the name of the landlord or the company that manages the property.

All information in the Statement of Compliance requirements to be correct before the tenancy agreement can be signed, and ideally it should be kept updated throughout the duration of the tenancy when any associated work has been completed.

It is important to note that landlords who manage several rental properties can face greater penalties for non-compliance. The highest penalties are handed down only for serious violations, and landlords who own more than six properties could be penalised up to $50,000, or as high as $100,000 in hearing claims.

In the end, a failure to comply with the Healthy Homes requirements can hit your pocket hard, and result in huge fines, in addition to still having to meet compliance. Don’t risk your rental property, contact us today and ask us to conduct a house inspection performed for your rental property.

Healthy homes are important

What are the reasons why Healthy Homes Compliance so Important?

A majority of households from New Zealand and Khandallah, and research shows us that these rental homes are most likely to be older, colder, have less efficient heating and are of lower quality than the houses of owners.

Damp, mouldy and cold homes can have negative well-being outcomes, particularly illnesses such as colds and flu, asthma and heart diseases. Unreasonable Gaps & Holes

Draught Stopping Khandallah

Draughts can lead to dropping temperatures within households. A damp house costs more to heat, which means wasting energy and incurring higher costs.

If a draught could be felt through gaps that are too large or holes, it needs to be closed.

What are the most unreasonable gaps or holes?

If you are able to feel external air flowing in or an unobstructed draught coming from a crack or a gap, then it is most likely a gap or hole that needs sealing in any way. Cracks or gaps with large gaps must be stopped permanently. The gaps that exceed 3mm that allow air to enter or exit from your home require to be sealed. For instance, if an open fireplace isn’t used it could cause draughts, and should be sealed from. Landlords and property managers are accountable for ensuring such draughts are eliminated as much as possible.

There is no require to block up intentional holes or gaps which are part of the building. For instance, small gaps around doors and windows might be necessary to allow for the movement of the structure as the home heats and cools, so that they are able to be shut and opened, rather than sticking. We will inspect the windows and doors during an Healthy Homes assessment of your rental property.

Heating Khandallah

Khandallah rental properties must have a fixed heating source that is able to heat the principal or the biggest living room to at least 18degC, even during the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heating needs to remain fixed (i.e., not portable) and at least 1.5 Kilowatts in heating capacity, and must meet the minimum capacity for heating required for the main living space. The Heating Assessment Tool can be used to determine if the existing permanent heater(s) are adequate or whether you will require to "top up" with a new heater. Open fires and unflued combustion heaters, such as the portable LPG bottle heaters aren’t considered to be suitable heating options under Healthy Homes Standard. Healthy Homes Standard.

If the heating system you provide is electric heating or heat source, it must include a thermostat. This will make your heating more consistent and efficient. For most properties, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in some cases such as small apartments, a smaller fixed electric heater may be sufficient.

If your living space already has a central heating source like a heat pump, then it might require an upgrade to ensure it meets the requirements. Certain kinds of heaters cannot be used to meet the quality since they’re either costly, not affordable to run, or are unsafe to operate.

Ventilation Khandallah

Each living space within a rental property has to have at least one opening doors or windows to provide natural airflow. In addition, humid areas such as kitchens and bathrooms must have a suitable externally vented extractor fan to get rid of moisture.

The ventilation quality is all about recognising the fact that dry air will be less difficult to heat and a well ventilated rental property is less likely to be a victim of damp and mould.

Living rooms, bedrooms, kitchens and dining rooms are considered liveable spaces. Connecting spaces such as the hallways are not liveable and therefore are not need an opening door or window.

Each window, door , or skylight requirements at least of opening to the outside, and stay closed in order to allow to circulate fresh air as well as ventilation.

Bathrooms, kitchens, and any other area in your home with shower, bath, cooktop or other high humidity-generating items will need proper extractor fan systems that can be vented to the outside. The Healthy Homes Assessment service will ensure that there is sufficient ventilation in every living space and will also check for the proper extractor fans for areas that are high in moisture.

Insulation Khandallah

Ceiling and underfloor insulation is required to all rental homes as of July 1st, 2019. All landlords and property managers are required to ensure that the insulation meets standards that are in line with the latest quality. In certain situations, the old ceiling insulation as well as insulation within the subfloor space may need to be added or replaced.

A house that is well-insulated will reduce the risk of condensation and lower the chance of mould and dampness and it will make more easy for the home to hold the heat.

Insulation needs to meet the R-values for your area

The "R" stands for thermal resistance, and it is a measurement of how well the insulation can withstand heat flow. The more R-value is higher, the more effective the insulation.

  • Zone 1 Zone 1 Auckland & Northland - ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – all area of North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3, underfloor R 1.3

Khandallah Moisture Ingress & Drainage

Keeping your rental property safe from dampness isn’t just about the inside of the building; you have to ensure there is somewhere to allow surface, rain and ground water to go, and prevent it from getting inside. When it concerns damp and moisture it is typically not apparent that it can cause a lot of trouble, causing damage to your investment as well as harming your tenant’s health.

Rental properties must have effective drainage to eliminate floodwaters, surface water and ground water, which includes an appropriate outfall or runoff. Making sure that water has a location to go, and also that it isn’t allowed to remain beneath structures is a crucial aspect of maintaining your property’s dry.

Alongside a drainage system to avoid moisture ingress, if your rental has an enclosed gap between your flooring and the ground, a ground water barrier must be put in place when it is reasonably practicable to do so.

The ground-moisture barrier typically an insulating sheet of polythene laid over the ground, to block any moisture from the ground from rising into the home. It also helps in preventing from causing damage to the flooring insulation.
