Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed for a Khandallah rental property, all Healthy Homes compliance items must be finished within 90 days.

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on the Khandallah rental property, all Healthy Homes compliance work must be done by the end of 90 days.

The person liable to pay this fine is the one who is identified on the tenancy agreement as the person who is who is letting the property, so it could be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement needs to be correct when the tenancy contract is signed. It is updated through the tenancy period as relevant work gets completed.

It is important to remember that a landlord who own multiple rental properties may face additional fines for non-compliance. The highest penalties are given only for serious violations, and landlords who own at least six rental properties could be fined as high as $50,000, and as much as $100,000 in the case of hearing claims.

Tenancies that were signed from 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory throughout Khandallah and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords must keep records to demonstrate compliance with each Healthy Homes Standards that apply or will be applied to your rental home.

Beginning 1 July 2021

  • Private landlords and property managers should ensure their rental properties conform according to Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

A good heating system is important for healthy houses

Heating Khandallah

Khandallah rental properties must have a fixed heating source that can warm the living space to a minimum of 18degC, even during the winter coldest days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating needs to be fixed (i.e. not portable), at least 1.5 horsepower in capacity, and it must have the minimum required heating capacity for the main living space. In most houses, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are needed. In certain situations, like small apartments, a smaller fixed electric heater might be enough.

If your living space is already equipped with a fixed heating source such as heat pumps, it might require some additional energy to meet the standards.
