Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied contract is signed on a Kenepuru rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

As of 1st July 2021, if a new or renewed Tenancy is signed for a Kenepuru rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Inability to adhere to each of Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy agreement it could result in additional penalties or an infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they are related to the house they reside in. If the the property manager doesn’t supply the required information within 21 days from being informed of the request, they may receive an infringement notice and be fined up to $750.

In addition, there’s also a fine of as much as $900 for landlords and property managers who have provided a false or misleading Healthy Homes Compliance Statement or information. The person liable to pay this fine is the one who is named on the lease agreement as the one who is leasing the property out and it could be the name of the landlord as well as the property management company.

All the information on the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is signed. It should be maintained during the entire tenancy, as necessary work related to it’s finished.

It is important to keep in mind that landlords who manage multiple rental properties may face even higher fines for non-compliance. The highest penalties are given for the most serious breaches. Landlords with more than six properties could be penalised up to $50,000, or as high as $100,000 in hearing claims.

Kenepuru Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory throughout Kenepuru and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records of their conformance with all Healthy Homes Standard that apply or will be applicable during the tenancy of the rental property.

From 1 July 2021

  • Private landlords and property managers must ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of any new, renewed or varied lease.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarding household tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or the sound of a clear draught emanating from a gap or hole that is, it is likely to be a gap or hole that needs sealing in any way. Cracks and gaps that are large should be fixed permanently. Any gaps greater than 3mm that let air in or out into your home need seals. In the case of an open fireplace is not in use, it can cause draughts and should be sealed off. Landlords and property managers are accountable for making sure such draughts are eliminated as much as imaginable.

There is no need to block up intentional holes or gaps that are part of the building. For example, tiny gaps around windows and doors may be required to allow for movement of the building when the house heats and cools, in order to let them be opened and closed rather instead of being stuck. Adequate heaters are important to ensure healthy homes

Heating Kenepuru

Rental properties in Kenepuru should have a permanent heating source that can heat the main or largest living space to a minimum of 18 degrees Celsius, even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating needs that it be permanently fixed (i.e. not portable) with at minimum 1.5 kW of heating capacity, and meet the minimum capacity for heating required for the main living space. The Heating Assessment Tool can be used to determine if your current fixed heater(s) are sufficient or if you’ll need to "top-up" with a new heater. Fires that are open and unflued heaters such as small portable LPG bottle heaters are not considered to be acceptable heating options in those following the Healthy Homes Standard.

If the heating you provide is electric heating or heat pump, it requirements to include a thermostat. This will help make the heating more consistent and effective. For most properties, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are necessary. However, in certain instances such as small apartments the smaller fixed electric heater could be enough.

If your main living space already has a permanent heating source like an air conditioner, it might require an update to be able to meet the standards. Certain kinds of heaters cannot be used to comply with the quality as they are either inefficient, unaffordable to operate and/or unhealthy to run.

Insulation Kenepuru

Underfloor and ceiling insulation is a requirement for all rent houses from 1 July 2019. Property managers and landlords are required to make sure that the insulation is in line with current standard.
