Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed contract is signed on a Kenepuru rental property, all Healthy Homes compliance tasks must be finished within 90 days.

As of 1st July 2021, when a brand new or renewed contract is signed on the Kenepuru rental property, all Healthy Homes compliance work must be taken care of within 90 days.

The person responsible to pay this fine is the one who is identified on the tenancy agreement as being the person leasing the property out, so it could be the landlord’s name or the company that manages the property.

The information contained in the Compliance Statement needs to be correct at the time that the tenancy agreement is completed, and is updated throughout the tenancy as any associated work has been completed.

It is also important to be aware that landlords who own several rental properties can face additional fines for non-compliance. The most severe penalties are reserved only for serious violations, and landlords who own six or more properties can be fined up to $50,000, or as high as $100,000 in the case of hearing claims.

Kenepuru Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement for all Kenepuru and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that prove compliance with any Healthy Homes Standard that apply or will be applicable to your rental home.

From July 1st 2021

  • Private landlords and property managers must make sure their rental properties comply with the Healthy Homes Standard within 90 days of a new, renewed , or altered tenancy.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

What are unjustifiable gaps or holes?

If you are able to feel external air coming in or an unobstructed draught coming from a gap or hole, then it’s most likely a gap or hole that requirements sealing in somehow. Cracks and gaps that are large should be permanently stopped. Cracks that are greater than 3mm and allow air to enter or exit of the house need seals. In the case of an open fireplace isn’t used it can create draughts. This should be blocked from. Property managers and landlords are accountable for ensuring that draughts from the fireplace are removed in the maximum extent possible.

There is no need to block gaps or holes which are part of the construction. For instance, small gaps around windows and doors could be required to allow for movement of the building when the household warms and cools to allow them to be shut and opened, rather than being stuck. Adequate heaters are important for healthy homes

Heating Kenepuru

Kenepuru rental properties must have a fixed source of heat that can warm the principal or the biggest living area to at minimum 18 degrees Celsius, even on the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source requirements to remain fixed (i.e. not portable) that is, at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum capacity for heating required in the living area. In certain situations, like small apartments an electric, fixed heater may be sufficient.

If your main living space is already equipped with a fixed heating source, such as a heat pump, then it might need an upgrade in order to comply with the standards. Certain kinds of heaters cannot be used to meet the standard because they’re not efficient, cost prohibitive to operate or unsafe to operate.
