Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied contract is signed on a Kenepuru rental property, all Healthy Homes compliance items need to be finished by the end of 90 days.

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on the Kenepuru rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to adhere to each of Healthy Homes Standards inside of the period of time expected can lead to penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or revised tenancy agreement there may be an additional fine or violation fee.

Anyone can request details regarding the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager is unable to provide the required information within 21 days of being informed of the request, they may receive an infringement letter and be fined upto $750.

Furthermore, there’s also a fine of approximately $900 for landlords and property managers that provide false or false Healthy Homes Compliance Statement or any other information. The person liable to pay this fine is the one who is named on the tenancy agreement as being the person leasing the property out, so it could be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be up-to-date when the tenancy contract is executed, and it must be updated throughout the tenancy as any relevant work gets completed.

It’s important to keep in mind that landlords who manage multiple rental properties may receive greater penalties for non-compliance. The most severe penalties are handed down for serious violations, and landlords who own six or more properties can be fined up to $50,000, and as much as $100,000 in hearing claims.

In the end, a failure to meet compliance with Healthy Homes requirements can hit your wallet hard, and result in huge fines, in addition to still having to meet compliance. Don’t take a chance with your rental property, contact us today and request a home inspection performed on the rental property you are renting.

Healthy homes are important

What are the reasons why Healthy Homes Compliance so Important?

One in three households from New Zealand and Kenepuru, and research shows us that these rental houses are most likely to be colder, older and have less efficient heating, and generally tend to be lower quality than owner occupied properties.

Damp, mouldy and cold homes are linked to negative health outcomes, particularly illnesses such as colds and influenza, asthma, and cardiovascular issues. Furthermore, people who have reported at least four major issues with their housing often have lower levels of satisfaction with life and a decrease in mental health.

Enhancing the standard of Kenepuru rental property can allow tenants to experience better physical and mental health and minimise the disruptions to their work, education and living because of illnesses. Your investment is also safeguarded from mildew, mould and damp-related damage, which completed jobs in lower costs for maintenance in the long run.

The Healthy Homes Standards are a set of specific and minimal standards for heating, insulation, Ventilation, Moisture Ingress and Drainage, and Draught-stopping for Kenepuru rental properties.

Unreasonable Gaps & Holes

Draught Stopping Kenepuru

Draughts increase the likelihood of less temperature in homes. A cold house costs more to heat, which results in wasting energy and increased bills.

If a draught can be felt from unreasonable gaps or holes that it requirements to be closed.

What are unreasonable gaps and holes?

If you are able to feel external air coming in or an unobstructed draught coming out of a hole or gap and you are able to feel it, it is probably a gap or crack that requirements sealing in any way. Cracks or gaps with large gaps must be fixed permanently. The gaps that exceed 3mm that allow air to enter or exit of the home require the sealing. For example, if an open fireplace isn’t used it can create draughts. This should be shut off. Property managers and landlords are accountable for making sure that such draughts are squelched in the maximum extent possible.

You don’t require to cover up holes or gaps which are part of the building. For example, tiny gaps around doors and windows might be necessary to allow for movement within the building when the home gets warmer and cooler, so that they are able to be closed and opened rather instead of being stuck. We will examine the windows and doors in an Healthy Homes assessment of your rental property.

The proper heating equipment is crucial for well-being houses

Heating Kenepuru

Rental properties in Kenepuru need to have a stable source of heat that can heat the principal or the biggest living space to at least 18degC, even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat requirements for it to be permanent (i.e. not portable) and at least 1.5 kW in heating capacity, and must meet the minimum required heating capacity in the living area. The Heating Assessment Tool can be used to determine whether the existing fixed heater(s) are sufficient or if you’ll require to ‘top up’ with a new heater. Open fires as well as unflued combustion heaters such as the portable LPG bottle heaters aren’t considered to be safe heating options in those following the Healthy Homes Standard.

If the heating that you offer is an electric heater or heat pump then it must include the thermostat. This makes your heating more consistent and effective. For most properties, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. However, in certain instances like small apartment buildings, a smaller fixed electric heater could be enough.

If the living area already has a fixed heating source like heat pumps, it might just need an upgrade to be able to meet the standards. Certain types of heaters cannot be used to meet the standard as they are either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Kenepuru

Each liveable space in the rental property should contain at minimum one open window or exterior door to offer natural airflow. In addition, humid areas like kitchens and bathrooms must have a suitable externally vented extractor fan that can eliminate moisture.

A ventilation quality is all about acknowledging how dry air is easier to heat and a property that is well ventilated will be less prone to developing mould and damp.

Living rooms, bedrooms, kitchens, and dining rooms are all considered living spaces. Spaces that connect, such as the hallway aren’t liveable and therefore don’t require an opening window or door.

Each window, door or the skylight needs at least of opening to the outside, and stay fixed in an open position in order to allow the circulation of fresh air and ventilation.

All bathrooms and kitchens as well as any other space in your home with shower, bath cooker or any other moisture generating item will need suitable extractor fans that are vented to the outside. The Healthy Homes Assessment service will check that there is adequate ventilation in every living space with the right extractor fan in high moisture areas.

Insulation Kenepuru

The insulation of the ceiling and underfloor is a requirement on all rental homes as of July 1st, 2019. All landlords and property managers should make sure that the insulation is up to this new quality. In some cases, current ceiling insulation, or the insulation of the subfloor space might need to be filled with or replaced.

A well-insulated house can help control condensation, and decrease the risk of dampness and mould, and it will make it easier to the household to keep warmth.

Insulation needs to meet the R-values of your area.

The "R" refers to thermal resistance, and it is a measurement of how well the insulation is able to resist heat flow. The higher the R-value, the more effective the insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – the rest area of North Island except Taupo and the Central Plateau – ceiling R 2.9 underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 (underfloor R 1.3

Kenepuru Moisture Ingress & Drainage

Making sure your rental property is protected from the effects of moisture isn’t just a matter of what’s inside the building it is also about the outside. You must make sure there is somewhere for rain, surface and ground water to go and also stop it from getting inside. When it is damp and moisture, it is frequently not apparent that it could be a huge problem and cause damage to your investment and affecting the tenant’s health.

Properties that are rented must have effective drainage to eliminate rainwater, storm water, and groundwater, with an appropriate runoff or outfall. Making sure the water has a proper place to go and that it can’t linger underneath the buildings is a vital aspect of making sure your property is dry.

Alongside a drainage system to avoid water ingress, if the rental has an enclosed gap between your flooring and surface, a ground moisture barrier must be constructed if it’s reasonably practicable to install it.

An underground moisture barrier typically an insulating sheet of polythene laid over the ground to stop any moisture that is present in the ground from getting into the property. It also helps in preventing moisture damage to the underfloor insulation.
