Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Kenepuru rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on the Kenepuru rental property, all Healthy Homes compliance work must be completed within 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. It’s also important to keep in mind that landlords who manage multiple rental properties could face greater penalties for non-compliance. The highest penalties are given for serious breaches. Landlords with more than six properties could receive fines of up to $50,000 and as high as $100,000 in hearings.

Kenepuru Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is mandatory for all Kenepuru and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate compliance with any Healthy Homes Standards that apply or will be applied to your rental home.

Starting 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Heating Kenepuru

Rental properties in Kenepuru should have a permanent source of heat that can heat the largest or main living space to at least 18degC even on the coldest winter days. However, in certain instances like small apartments an electric, fixed heater might be enough.
