Healthy Homes Assessment Services

Did you be aware that the Healthy Homes Standards came into in force on July 1, 2021? Landlords are now required to ensure their Kenepuru rental properties meet the minimum Healthy Homes Standards within 90 days of a new or renewed tenancy, and all private rental properties are required to be fully in compliance by July 1st 2024.

Failure to comply with the requirements of the Healthy Homes Standards is a violation under the Residential Tenancies Act 1986, and any landlord found not complying may be liable for up to $7,200 in addition to any healthy homes connected fines.

Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied contract is signed on a Kenepuru rental property, all Healthy Homes compliance items must be done inside of 90 days.

From the 1st of July in 2021, if a new or renewed contract is signed on a Kenepuru rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Inability to adhere to any of the Healthy Homes Standards by the end of the anticipated timeframe could result in an amount of $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy agreement there may be additional penalties or an infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they relate to the building they live in. If the the property manager doesn’t supply the information requested within 21 days of receiving the request, they can receive an infringement notification and be fined upto $750.

Furthermore, there’s also a penalty approximately $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or other information. The person liable for this fine is the one who is named on the tenancy agreement as the one who is who is letting the property and it could be the name of the landlord or the company that manages the property.

All information in the Compliance Statement needs to be correct when the tenancy agreement is executed, and it should be kept updated during the entire tenancy, as relevant work gets completed.

It’s crucial to be aware that landlords who manage several rental properties can face additional fines for non-compliance. The harshest penalties are given only for serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000, or as high as $100,000 in the case of hearing claims.

Kenepuru Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory in all Kenepuru and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate conformance with each Healthy Homes Standards that apply or will be applied throughout the tenancy period of an apartment rental.

From July 1st 2021

  • Private landlords and property managers must make sure their rental properties comply with the Healthy Homes Standards within 90 days of a new, renewed or varied lease.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All homes which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Draughts can lead to less temperature in houses. A draughty house costs more to heat, resulting in wasted energy and increased bills.

If a draft can be felt through gaps that are too large or holes the area needs to be sealed.

What are unreasonable gaps and holes?

If you are able to feel external air entering or the air is clear from a hole or gap that is, it is probably a gap or an opening that needs sealing in any way. Large cracks and gaps should be permanently stopped. Any gaps greater than 3mm that allow air to enter or exit of the home require seals. For example, if the open fireplace is not in use, it can create draughts. This should be sealed from. Property managers and landlords are accountable for making sure that such draughts are squelched whenever possible.

There is no require to block off gaps or holes that are part of the construction. For instance, small gaps around doors and windows may be required to allow for movement within the structure as the house warms and cools so that they can still be closed and opened instead of instead of being stuck. Heating Kenepuru

Rental properties in Kenepuru need to have a stable source of heat that can heat the principal or the biggest living room to at least 18 degrees Celsius, even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source needs that it be permanently fixed (i.e. not portable) and at minimum 1.5 kW of heating capacity, and it must have the minimum heating capacity needed for the main living room. If your main living space already has a fixed heating source, like a heat pump, then it might require an update in order to comply with the standards. Some types of heaters can’t be utilised to meet the standard since they’re either expensive, inefficient and/or unhealthy to run.

Ventilation Kenepuru

Insulation Kenepuru

Ceiling and underfloor insulation is required on all rental houses since 1 July 2019. All landlords and property managers must make sure the insulation meets standards that are in line with the latest quality. In certain situations, the current ceiling insulation, or the insulation of the subfloor space may need to be topped up or replaced.

A house that is well-insulated will reduce the risk of condensation and reduce the chances of mould and damp, and also makes an easier task to allow the house to hold warmth.

The "R" signifies thermal resistance and it is a measurement of how well the insulation resists heat flow. The more high the R-value, more effective the insulation.
