Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied contract is signed on a Kenepuru rental property, all Healthy Homes compliance items must be completed by the end of 90 days.

It’s also crucial to remember that landlords who manage multiple rental properties could face more severe penalties for not complying. The most severe penalties are handed down only for serious breaches. Landlords with more than six properties could be fined up to $50,000 and as high as $100,000 for hearing claims.

Tenancies established beginning on 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is required to all Kenepuru and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords must keep records of their the conformance to any Healthy Homes Standard that apply or will be applicable during the tenure of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers should ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All houses let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.
