Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed for a Kenepuru rental property, all Healthy Homes compliance work have to be done by the end of 90 days.

The person responsible for this fine is the person who is named on the lease contract as the person leasing the property out and it could be the landlord’s name or the property management company.

All the information on the Compliance Statement needs to be correct when the tenancy agreement is completed, and is updated through the tenancy period as relevant work gets completed.

It’s crucial to remember that landlords who have several rental properties can face greater penalties for non-compliance. The most severe penalties are given for serious violations. Those who have more than six properties could receive fines of up to $50,000, and even as high as $100,000 in hearing claims.

Kenepuru Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement throughout Kenepuru and New Zealand rental homes where it’s reasonably practicable to install.

Kenepuru rental properties must have a fixed source of heat that is able to heat the living space to at least 18 degrees Celsius, even on the winter coldest days.
