Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed contract is signed on a Kenepuru rental property, all Healthy Homes compliance tasks must be finished within 90 days.

If the property manager does not provide the necessary information within 21 days of being informed of the request, they will receive an infringement notification and could be fined up to $750.

In addition, there’s an additional fine of as much as $900 for landlords or property managers that provide false or misleading Healthy Homes Compliance Statement or information. The person who is responsible for this fine is whoever is named on the lease agreement as being the person renting the property It could also be the name of the landlord, or the property management company.

All information in the Statement of Compliance needs to be current when the tenancy agreement is executed, and it must be updated through the tenancy period as associated work has been completed.

It is important to note that a landlord who own multiple rental properties may face more severe penalties for not complying. The harshest penalties are given for serious violations, and landlords who own more than six properties could be fined up to $50,000, and as much as $100,000 for hearing claims.

Kenepuru Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is required for all Kenepuru and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords are required to keep records of their the conformance to any Healthy Homes Standards that apply or will be applied during the tenancy of the rental property.

From 1 July 2021

  • Private landlords and property managers must make sure their rental properties conform with the Healthy Homes Standards within 90 days of a new, renewed or varied tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Kenepuru rental properties must have a fixed source of heat which can warm the{ main or largest|| largest or main| principal or the biggest} living space to a minimum of 18 degrees Celsius, even on the coldest winter days.
