Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed for a Kenepuru rental property, all Healthy Homes compliance items need to be done within 90 days.

Additionally, there is an additional fine of as much as $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person liable for this fine is whoever is named on the lease agreement as the one who is who is letting the property and it could be the landlord’s name or the property management company.

All information in the Statement of Compliance needs to be correct when the tenancy agreement is executed, and it is updated throughout the tenancy as any related work is completed.

It’s important to note that a landlord with multiple rental properties may receive additional fines for non-compliance. The most severe penalties are given only for serious violations. Those who have at least six rental properties could receive fines of up to $50,000, and as much as $100,000 for hearing claims.

Kenepuru Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is a requirement for all Kenepuru and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records that demonstrate the compliance with each Healthy Homes Standards that apply or will apply to the rental property.

From 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a renewal, new or a change in Tenancy.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All homes rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.
