Fines for Failing to Comply

As of 1st July 2021, if a new or renewed tenancy is signed on a Kelburn rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

From the 1st of July in 2021, once a new or renewed tenancy is signed on a Kelburn rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Kelburn Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory for all Kelburn and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records of their the conformance to each Healthy Homes Standard that apply or will apply to your rental home.

From July 1st 2021

  • Private landlords and property managers must ensure their rental properties comply to the Healthy Homes Standards within 90 days of a new, renewed or varied Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

If your living space already has a permanent heating source, such as heat pumps, it may require a top up in order to comply with the standards.
