Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed for a Karori rental property, all Healthy Homes compliance tasks must be done by the end of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on the Karori rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to adhere to each of Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy contract, it could result in additional penalties or an infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they are related to the house they reside in. If the property manager does not supply the information requested within 21 days from being informed of the request, they could receive an infringement letter and be fined upto $750.

Additionally, there is also a fine of as much as $900 for property owners or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the one who is named on the tenancy agreement as the person who is leasing the property out It could also be the name of the landlord or the property management company.

The information contained in the Compliance Statement needs to be correct before the tenancy agreement can be executed, and it must be updated during the entire tenancy, as relevant work gets completed.

It is also important to remember that landlords with multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are given for the most serious violations, and landlords who own at least six rental properties could be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

When do I require to be in compliance with The Healthy Homes Standards?

Karori Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory throughout Karori and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the conformance to each Healthy Homes Standards that apply or will be in force to their rental properties.

From July 1st 2021

  • Property managers and private landlords must ensure their rental properties comply in accordance with Healthy Homes Standards within 90 days of a newly renewed, extended or changed Tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Karori

Draughts increase the likelihood of lower temperatures in households. A damp house costs more to heat, which results in wasting energy and increased bills.

If a draught could be noticed from gaps that are not adequate or holes or holes, it needs to be sealed.

Heating Karori

Rental properties in Karori must have a fixed source of heat that is able to heat the largest or main living area to at minimum 18 degrees Celsius, even on the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating requirements for it to be permanent (i.e. not portable) and at minimum 1.5 kW in heating capacity, and must meet the minimum requirement for heat capacity for the main living space. If the heating that you provide is electric heating or heat source, it should have a thermostat. This will help make the heating more consistent and efficient. For most homes, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are required. In some instances, like apartments with small spaces an electric, fixed heater may suffice.

If the living area is already equipped with a fixed heating source such as heat pumps, it might just require an upgrade to be able to meet the standards. Certain types of heaters cannot be used to comply with the quality as they are either expensive, inefficient or unsafe to operate.

Ventilation Karori

Insulation Karori

The insulation of the ceiling and underfloor has been compulsory in all rental houses since July 1, 2019. All landlords and property managers are required to make sure that the insulation meets standards that are in line with the latest quality. In some instances, an existing insulation on the ceiling or in the sub floor space may require to be replaced or replaced.
