Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied contract is signed on a Karori rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

As of 1st July 2021, if a new or renewed contract is signed on a Karori rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included within a new, renewed or amended tenancy agreement it could result in an additional fine or violation fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager is unable to supply the information requested within 21 days from getting the notice, the tenant could receive an infringement notification and be fined as high as $750.

Additionally, there is also a penalty of approximately $900 for landlords or property managers providing a false or incorrect Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the person who is named on the tenancy agreement as the one who is who is letting the property and it could be the name of the landlord as well as the company that manages the property.

All information in the Statement of Compliance requirements to be accurate at the time that the tenancy agreement is signed, and ideally it should be kept updated throughout the duration of the tenancy when any associated work has been completed.

It is also crucial to keep in mind that a landlord who have multiple rental properties may face more severe penalties for not complying. The most severe penalties are reserved for serious breaches. Landlords with at least six rental properties could be fined up to $50,000 and as high as $100,000 in hearing claims.

When Do I need to meet the Healthy Homes Standards?

Karori Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is a requirement throughout Karori and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records of their compliance with any Healthy Homes Standard that apply or will be applied during the tenancy of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All households rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

Draughts increase the likelihood of lower temperatures in homes. A draughty home costs more to heat, meaning wasting energy and increased bills.

What are the most unreasonable gaps or holes?

If you are able to feel external air flowing in or the air is clear from a crack or a gap, then it’s likely a crack or hole that needs sealing in any way. Cracks and gaps that are large should be stopped permanently. The gaps that exceed 3mm that allow air to enter or exit from your house require to be sealed. For example, if the open fireplace isn’t being used, it can create draughts. This should be shut from. Property managers and landlords are accountable for ensuring that draughts from the fireplace are removed in the maximum extent possible.

You don’t require to block holes or gaps that are part of the building. For instance, small gaps around windows and doors could be required to allow for movement within the structure when the home heats and cools, in order to let them be opened and closed rather instead of being stuck. Heating Karori

Karori rental properties should have a permanent source of heating which can warm the principal or the biggest living space to at least 18 degrees Celsius, even on the coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source needs to be fixed (i.e., not portable) that is, at least 1.5 kW in heating capacity, and must meet the minimum capacity for heating required for the main living space. The Heating Assessment Tool can be used to check if the fixed heater(s) are sufficient or whether you will need to "top-up" by adding a second heater. Fires that are open and unflued heaters, such as mobile LPG bottle heaters are not considered to be safe heating options in The Healthy Homes Standard.

If the heating you provide is electric heating (or heat pump), it must be equipped with the thermostat. This will make the heating more reliable and efficient. In most homes, larger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in some cases like apartments with small spaces small apartments, a smaller electric fixed heater may suffice.

If the main living room is already equipped with a fixed heating source, such as heat pumps, it may need an upgrade in order to comply with the standards. Certain kinds of heaters aren’t able to be used to meet the standard as they are either costly, not affordable to run, and/or unhealthy to run.

Ventilation Karori

Every living space of a rental property has to contain at minimum one open door or window to offer natural ventilation. Furthermore, moist areas such as kitchens or bathrooms should be equipped with an venting fan outside to take moisture away.

This ventilation standard is all about recognising it is that dry air is easier to heat and heat, and a well ventilated rental property is less likely to develop mould and damp.

Bedrooms, living rooms, kitchens and dining rooms are considered liveable areas. Spaces that connect, such as the hallways are not living spaces and therefore are not need an opening door or window.

Every window, door or the skylight needs at least open to the outside, but remain at an open angle, allowing ventilation and fresh air ventilation.

Insulation Karori

Ceiling and underfloor insulation is a requirement for all rent houses as of July 1st, 2019. All landlords and property managers have to ensure that the insulation is in line with the new quality. In some instances, old ceiling insulation as well as insulation within the subfloor space may need to be topped up or replaced.

Karori Moisture Ingress & Drainage
