Fines for Failing to Comply

As of 1st July 2021, if a new or renewed tenancy is signed on a Karori rental property, all Healthy Homes compliance tasks have to be completed inside of 90 days.

Beginning on July 1st, 2021, when a brand new or renewed lease is entered into on a Karori rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards within the deadlines can result in an amount of $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t incorporated within an updated, renewed, or revised tenancy agreement, it could result in an additional fine or infringement fee.

It is also crucial to be aware that landlords with several rental properties can face more severe penalties for not complying. The highest penalties are reserved only for serious breaches. Landlords with more than six properties could receive fines of up to $50,000, and even as high as $100,000 in hearings.

Karori Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory in all Karori and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records that prove compliance with the Healthy Homes Standard that apply or will be applied throughout the tenancy period of their rental properties.

From July 1st 2021

  • Private landlords and property managers are required to make sure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of any new, renewed , or altered lease.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All houses rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of when the tenancy first began.

If you are able to feel external air coming in or a clear draught from a hole or gap that is, it is likely to be a gap or an opening that needs sealing in the way you can. Cracks or gaps with large gaps must be permanently stopped. Any gaps greater than 3mm that let air into or out from the home need sealing. For example, if an open fireplace isn’t in use it may cause draughts and should be shut from. Property managers and landlords are responsible for making sure that such draughts are squelched as far as possible.

There is no require to block up intentional holes or gaps that are part of the building. Heating Karori

Rental properties in Karori must have a fixed source of heat which can warm the largest or main living room to at least 18 degrees Celsius, even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat requirements to be fixed (i.e. not portable) and at least 1.5 Kilowatts in heating capacity, and meet the minimum requirement for heat capacity for the main living room. Insulation Karori

Ceiling and underfloor insulation is mandatory for all rent houses since 1 July 2019. Property managers and landlords have to ensure that the insulation is in line with current standard. In certain situations, the an existing insulation on the ceiling or in the sub floor space may need to be added or replaced.
