Fines for Failing to Comply
Beginning on July 1st, 2021, if a new or renewed contract is signed on a Karori rental property, all Healthy Homes compliance tasks have to be finished within 90 days.
Since the 1st July of 2021, if a new, renewed or varied lease is entered into on the Karori rental property, all Healthy Homes compliance work must be done within 90 days.
Failure to comply with all of the Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy agreement there may be an additional fine or infringement fee.
Any tenant can ask for information about the Healthy Homes Standard and how they relate to the building they reside in. If the the property manager doesn’t provide the necessary information within 21 days of receiving the request, they will receive an infringement notification and be fined upto $750.
In addition, there is an additional fine of approximately $900 for property owners or property managers who offer a false or false Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is whoever is named on the tenancy contract as the person renting the property It could also be the landlord’s name or the property management company.
All information in the Compliance Statement requirements to be up-to-date when the tenancy contract is signed, and ideally it should be kept updated throughout the duration of the tenancy when any necessary work related to it is finished.
It is crucial to keep in mind that a landlord with multiple rental properties may receive additional fines for non-compliance. The most severe penalties are reserved for serious violations, and landlords who own six or more properties could be penalised up to $50,000, and as much as $100,000 in hearing claims.
