Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed on a Karori rental property, all Healthy Homes compliance items must be done by the end of 90 days.

When do I need to be in compliance with the Healthy Homes Standards?

Karori Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory to all Karori and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records that prove the compliance with any Healthy Homes Standard that apply or will be applied to their rental properties.

From 1 July 2021

  • Property managers and private landlords have to make sure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of a new, renewed or varied lease.

What are unjustifiable gaps or holes?

If you are able to feel external air getting in, or see the air is clear from a gap or hole and you are able to feel it, it’s most likely a gap or an opening that needs sealing in any way. Large cracks and gaps should be sealed permanently. Gaps greater than 3mm that allow air in or out within your home require the sealing. For example, if an open fireplace isn’t in use it can cause draughts and should be sealed off. Property managers and landlords are accountable for ensuring such draughts are eliminated in the maximum extent possible.

You don’t need to cover up holes or gaps in the construction. For instance, small gaps around windows and doors might be necessary to allow movement of the building as the house warms and cools so that they can still be closed and opened rather than sticking. A good heating system is important for healthy houses

Heating Karori

Rental properties in Karori require a reliable heating source that can warm the principal or the biggest living space to at least 18degC even on the coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating needs for it to be permanent (i.e. not portable) with at least 1.5 kW of heating capacity, and must meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool could be used to determine whether the current permanent heater(s) are sufficient or if you’ll need to ‘top up’ with a new heater. Fires that are open and unflued heaters, such as portable LPG bottle heaters are not considered to be safe heating options in the Healthy Homes Standard.

If the heating you provide is electric heating or heat pump, it must include a thermostat. This makes your heating more consistent and effective. In most homes, larger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in some cases like apartments with small spaces small apartments, a smaller electric fixed heater may suffice.

If your living space already has a fixed heating source, like an air conditioner, it could need an update to meet the standards. Certain types of heaters cannot be used to achieve the quality because they’re costly, not cost-effective to run, and/or unhealthy to run.

Ventilation Karori

Every living space of a rental property must contain at minimum one open doors or windows to offer natural airflow. Furthermore, moist areas such as kitchens and bathrooms must have a suitable externally vented extractor fan that can get rid of moisture.

In some cases, existing ceiling insulation or insulation in the sub floor space might require to be filled with or replaced.
