Did you know that the Healthy Homes Standards came into effective on July 1st, 2021? Landlords must ensure their Karori rental properties meet the minimum Healthy Homes Standards within 90 days of a new or renewed tenancy and all private rentals are required to be fully conforming by the 1st July 2024.

Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed contract is signed on a Karori rental property, all Healthy Homes compliance work have to be taken care of within 90 days.

From the 1st of July in 2021, if a new, renewed or varied lease is entered into on a Karori rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to comply with all of the Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or amended tenancy agreement there could be an additional penalty or infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager does not provide the information requested within 21 days of being informed of the request, they will receive an infringement notification and could be fined up to $750.

Furthermore, there’s an additional fine of as much as $900 for landlords and property managers who offer a false or misleading Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the one who is listed on the tenancy contract as the person letting the property out which could be the landlord’s name or the property management company.

All information in the Statement of Compliance needs to be correct at the time that the tenancy agreement is completed, and should be maintained during the entire tenancy, as necessary work related to it’s finished.

It’s important to keep in mind that landlords who own multiple rental properties may face even higher fines for non-compliance. The most severe penalties are reserved for the most serious breaches. Landlords with at least six rental properties could be fined as high as $50,000, or as high as $100,000 in hearings.

When Do I need to be in compliance with The Healthy Homes Standards?

Karori Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory to all Karori and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords must keep records that demonstrate conformance with all Healthy Homes Standard that apply or will apply throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Property managers and private landlords have to make sure their rental properties comply to the Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must adhere to the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Karori

Draughts may lead to dropping temperatures within houses. A draughty home costs more to heat, resulting in wasted energy and resulting in higher bills.

If a draught is noticed from gaps that are not adequate or holes, it needs to be closed.

What are unreasonable gaps and holes?

If you can feel external air getting in, or see the air is clear from a gap or hole and you can feel it, it is likely to be a gap or hole that needs sealing in somehow. Large cracks and gaps should be sealed permanently. Cracks that are greater than 3mm and let air in or out into the home need seals. For example, if an open fireplace isn’t being used, it may cause draughts and should be blocked off. Property managers and landlords are responsible for ensuring that these draughts are stopped in the maximum extent imaginable.

There is no require to block holes or gaps which are part of the construction. For instance, small gaps around doors and windows might be necessary to allow for movement within the building when the household is heated and cools so that they are able to be closed and opened rather instead of being stuck. A good heating system is important for well-being homes

Heating Karori

Rental properties in Karori must have a fixed source of heat that can warm the living space to at least 18 degrees Celsius, even on the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source needs to remain fixed (i.e., not portable) that is, at least 1.5 kW of heating capacity, and meet the minimum capacity for heating required to heat the living space in general. A Heating Assessment Tool may be used to determine whether the current fix heater(s) are adequate or if you’ll need to ‘top up’ with an additional heater. Unflued combustion and open fire heaters such as mobile LPG bottle heaters are not considered acceptable heating options under The Healthy Homes Standard.

If the heating that you offer is electric heating or heat pump, it must be equipped with a thermostat. This makes the heating more reliable and effective. For most properties, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. In certain situations, like small apartment buildings an electric, fixed heater may suffice.

If your main living space already has a central heating source, such as an air conditioner, it might need some additional energy to meet the standards. Some types of heaters can’t be used to meet the standard as they are either not effective, cost prohibitive to operate or unsafe to operate.

Ventilation Karori

Each living space within a rental property must have at least one openable window or exterior door to offer natural airflow. Furthermore, moist spaces like kitchens and bathrooms should have an venting fan outside to remove moisture.

The ventilation quality is all about understanding that dry air is more easy to heat and that the property that is properly ventilated is less likely to be a victim of mould and damp.

Living rooms, bedrooms, kitchens and dining rooms are all considered living spaces. Connecting spaces such as the hallways are not liveable and therefore don’t require an opening door or window.

Every window, door or the skylight requirements for them to be in a position to open to the outside, and stay fixed in an open position in order to allow to circulate fresh air as well as ventilation.

Bathrooms, kitchens, and every other room of your property with a bath, shower, cooktop or other high water-generating appliance will require adequate extractor fans that are vented towards the outside. Insulation Karori

The insulation of the ceiling and underfloor has been compulsory to all rental homes since 1 July 2019. All landlords and property managers should make sure that the insulation is in line with standards that are in line with the latest quality. In some cases, current ceiling insulation, or the insulation of the subfloor space may need to be replaced or replaced.

Karori Moisture Ingress & Drainage

Making sure your rental property is protected from dampness isn’t just about the interior of the building but you must make sure there is somewhere for rain, surface or ground water and prevent it from getting into the building. When it is about damp and water, it is often the things you don’t notice that can become a big problem, causing damage to your investment and harming your tenant’s health.

Properties that are rented must be equipped with effective drainage to get rid of rainwater, storm water, and ground water. This includes an appropriate outfall or runoff. Making sure that the water has a proper place to go, and also that it doesn’t get sucked into structures is a crucial aspect of making sure your property is dry.

In addition to the drainage system that will prevent moisture from entering, if your property has an enclosed space between your floor and the ground, a ground moisture barrier must be installed if it’s reasonably practicable to do so.

A ground moisture barrier is usually a sheet of polythene that is placed over the ground, in order to block any moisture that is present in the ground from rising into the structure. It also assists in preventing from causing damage to the flooring insulation.
