Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Karori rental property, all Healthy Homes compliance tasks have to be taken care of by the end of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on a Karori rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards inside of the expected timeframe can result in penalties of up to $7200. In addition, if the present Healthy Homes Statement of Compliance is not incorporated in the new, renewed or revised tenancy contract, it could result in additional penalties or an infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager is unable to provide the required information within 21 days from receiving the request, they could receive an infringement notice and could be fined up to $750.

In addition, there is an additional fine of as much as $900 for property owners or property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person who is liable to pay this fine is the one who is identified on the tenancy contract as the person leasing the property out and it could be the name of the landlord or the company that manages the property.

All information in the Compliance Statement needs to be current when the tenancy agreement is signed. It should be kept updated through the tenancy period as associated work has been completed.

It’s also important to remember that landlords who manage several rental properties can face greater penalties for non-compliance. The harshest penalties are handed down only for serious violations, and landlords who own six or more properties could receive fines of up to $50,000, or as high as $100,000 in the case of hearing claims.

Karori Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory for all Karori and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate compliance with each Healthy Homes Standard that apply or will be applied throughout the tenancy period of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a new, renewed or varied tenancy.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All households rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts increase the likelihood of less temperature in homes. A cold house will cost more to heat, resulting in wasted energy and incurring higher costs.

What are unreasonable gaps or holes?

If you are able to feel external air flowing in or the sound of a clear draught emanating from a crack or a gap that is, it’s likely to be a gap or hole that needs sealing in somehow. Large gaps and cracks should be sealed permanently. The gaps that exceed 3mm that let air in or out from the house need to be sealed. For example, if an open fireplace is not in use, it can create draughts. This should be sealed off. Landlords and property managers are accountable for ensuring that these draughts are stopped in the maximum extent possible.

You don’t require to block gaps or holes which are part of the building. For instance, small gaps around windows and doors could be necessary to allow for movement of the building as the home warms and cools so that they are able to be opened and closed rather than being stuck. Heating Karori

Karori rental properties need to have a stable heating source which can warm the largest or main living area to at minimum 18degC, even during the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements to be fixed (i.e., not portable) that is, at least 1.5 kW of heating capacity and have the minimum requirement for heat capacity to heat the living space in general. The Heating Assessment Tool can be used to determine if the existing fix heater(s) are adequate or if you’ll need to "top-up" with an additional heater. Unflued combustion and open fire heaters such as portable LPG bottle heaters aren’t considered to be suitable heating options in Healthy Homes Standard. Healthy Homes Standard.

If the heating system you offer is electric heating or heat source, it must have the thermostat. This will make the heating more uniform and effective. For most properties, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are required. However, in some cases like small apartment buildings, a smaller fixed electric heater could be enough.

If your living space already has a fixed heating source like a heat pump, then it might need an update to ensure it meets the requirements. Some types of heaters can’t be used to meet the standard as they are either expensive, inefficient or are unsafe to operate.

Ventilation Karori

Each living space within a rental property has to include at least one open windows or an exterior door to provide natural airflow. Furthermore, moist areas such as kitchens and bathrooms need to have an externally vented extractor fan that can eliminate moisture.

Insulation Karori

Ceiling and underfloor insulation is required in all rental houses since July 1, 2019. All landlords and property managers must make sure the insulation meets this new standard. In certain situations, the an existing insulation on the ceiling or in the sub floor space might require to be replaced or replaced.
