Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed contract is signed on a Karori rental property, all Healthy Homes compliance tasks must be finished by the end of 90 days.

Since the 1st July of 2021, if a new or renewed contract is signed on a Karori rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to comply with each of Healthy Homes Standards by the end of the anticipated timeframe could result in an amount of $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy agreement, there may be an additional fine or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the home they live in. If the property manager fails to provide the necessary information within 21 days from getting the notice, the tenant will receive an infringement notice and could be fined up to $750.

In addition, there’s an additional fine of up to $900 for property owners or property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the person who is identified on the tenancy agreement as the one who is renting the property It could also be the name of the landlord as well as the company that manages the property.

What time should I need to be in compliance with the Healthy Homes Standards?

Karori Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is required for all Karori and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records of their compliance with each Healthy Homes Standard that apply or will be applicable during the tenancy of an apartment rental.

From 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties conform according to Healthy Homes Standards within 90 days of any renewal, new or a change in lease.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All homes let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Heating Karori

Karori rental properties must have a fixed source of heat that can warm the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the most coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat requirements to remain fixed (i.e., not portable), at minimum 1.5 kW of heating capacity and have the minimum capacity for heating required for the main living space. A Heating Assessment Tool could be used to determine whether the current permanent heater(s) are sufficient or whether you will need to top up with an additional heater. Fires that are open and unflued heaters, such as portable LPG bottle heaters aren’t considered to be safe heating options in those following the Healthy Homes Standard.

If the heating you offer is an electric heater or heat source, it must be equipped with the thermostat. This will make the heating more uniform and effective. For most properties, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in certain instances like small apartment buildings an electric, fixed heater may suffice.

If the living area already has a fixed heating source, such as a heat pump, then it might require an upgrade in order to comply with the standards. Certain types of heaters cannot be used to achieve the quality since they’re either costly, not affordable to run, and/or unsafe to run.

Ventilation Karori

Insulation Karori

Ceiling and underfloor insulation is a requirement for all rent homes from 1 July 2019. All landlords and property managers are required to ensure that the insulation is up to the new standard. In certain situations, the existing ceiling insulation or insulation in the sub floor space might need to be added or replaced.
