Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed tenancy is signed on a Karori rental property, all Healthy Homes compliance work need to be finished by the end of 90 days.

From the 1st of July in 2021, once a new or renewed lease is entered into on a Karori rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Inability to adhere to each of Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance isn’t included in the new, renewed or amended tenancy agreement it could result in an additional fine or infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager does not provide the required information within 21 days from receiving the request, they can receive an infringement notice and be fined as high as $750.

Additionally, there is also a penalty of up to $900 for property owners or property managers that provide false or incorrect Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the person who is identified on the tenancy agreement as the one who is letting the property out which could be the landlord’s name or the property management company.

All information in the Compliance Statement needs to be correct when the tenancy contract is signed. It should be kept updated through the tenancy period as necessary work related to it is finished.

It is important to note that a landlord who own multiple rental properties may face more severe penalties for not complying. The highest penalties are reserved only for serious breaches. Landlords with six or more properties could be fined as high as $50,000 and as high as $100,000 for hearing claims.

Karori Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory to all Karori and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords must keep records of their the compliance with any Healthy Homes Standards that apply or will apply throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Private landlords and property managers must make sure their rental properties conform with the Healthy Homes Standards within 90 days of any newly renewed, extended or changed Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must adhere to the Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All households which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

What are the most unreasonable gaps or holes?

If you are able to feel external air getting in, or see the sound of a clear draught emanating from a hole or gap, then it’s likely to be a gap or crack that needs sealing in any way. Large cracks and gaps should be fixed permanently. Any gaps greater than 3mm that allow air in or out within your home require seals. For example, if the open fireplace isn’t used it can cause draughts and should be sealed off. Property managers and landlords are responsible for making sure that draughts from the fireplace are removed whenever imaginable.

There is no need to block off gaps or holes in the construction. For example, tiny gaps around doors and windows might be necessary to allow for movement within the structure when the home warms and cools to allow them to be closed and opened instead of than being stuck. Heating Karori

Rental properties in Karori must have a fixed source of heat that can heat the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source needs to remain fixed (i.e., not portable) that is, at minimum 1.5 horsepower in capacity, and meet the minimum required heating capacity for the main living space. A Heating Assessment Tool could be used to determine if the existing fix heater(s) are sufficient or whether you will require to top up with a new heater. If the heating you provide is electric heating or heat source, it requirements to include an thermostat. This will make the heating more consistent and efficient. For most properties, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In some instances, such as small apartments, a smaller fixed electric heater may be sufficient.

If your main living space already has a central heating source such as a heat pump, then it could need a top up to meet the standards. Certain kinds of heaters cannot be used to comply with the standard as they are either costly, not affordable to run, or unsafe to operate.

Ventilation Karori

Each living space within a rental house must have at least one openable windows or an exterior door to provide natural airflow. Additionally, areas with high moisture areas such as kitchens and bathrooms should have an externally vented extractor fan that can eliminate moisture.

Ceiling and underfloor insulation has been compulsory to all rental homes from 1 July 2019. All landlords and property managers should make sure that the insulation is up to standards that are in line with the latest standard. In some instances, an existing insulation on the ceiling or in the subfloor space might need to be added or replaced.
