Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed for a Karaka Bays rental property, all Healthy Homes compliance items need to be finished by the end of 90 days.

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed on a Karaka Bays rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to meet all of the Healthy Homes Standards inside of the anticipated timeframe could result in an amount of $7200. It is important to remember that landlords who own multiple rental properties may receive even higher fines for non-compliance. The highest penalties are reserved only for serious violations. Those who have at least six rental properties could be fined as high as $50,000 and as high as $100,000 in hearing claims.

Karaka Bays Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory for all Karaka Bays and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords are required to keep records that prove the compliance with the Healthy Homes Standards that apply or will be applicable to your rental home.

From 1 July 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of any renewal, new or a change in Tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Karaka Bays

Adequate heaters are crucial for healthy homes

Heating Karaka Bays

Rental properties in Karaka Bays must have a fixed heating source that can heat the principal or the biggest living area to at minimum 18 degrees Celsius, even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating requirements that it be permanently fixed (i.e., not portable), at least 1.5 kW in heating capacity, and it must have the minimum capacity for heating required for the main living room. Unflued combustion and open fire heaters like small portable LPG bottle heaters aren’t considered to be safe heating options under the Healthy Homes Standard.

If the heating you provide is electric heating or heat pump, it should be equipped with a thermostat. This makes the heating more reliable and efficient. For most homes, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are required. In certain situations, like small apartments, a smaller fixed electric heater may be sufficient.

If your living space is already equipped with a fixed heating source like heat pumps, it might require a top up to be able to meet the standards. Certain kinds of heaters cannot be used to meet the standard because they’re costly, not cost-effective to run, or unsafe to operate.
