Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for a Karaka Bays rental property, all Healthy Homes compliance items need to be completed within 90 days.

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed on a Karaka Bays rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to adhere to any of the Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or revised tenancy agreement it could result in an additional penalty or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager is unable to provide the information requested within 21 days of receiving the request, they will receive an infringement letter and be fined up to $750.

Additionally, there is an additional fine of approximately $900 for landlords and property managers who have provided a false or misleading Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is the person who is listed on the tenancy contract as the person letting the property out which could be the name of the landlord, or the company that manages the property.

All the information on the Statement of Compliance requirements to be current when the tenancy contract is signed, and ideally it should be maintained during the entire tenancy, as associated work has been completed.

It is also crucial to be aware that a landlord who have multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are reserved only for serious breaches. Landlords with six or more properties can receive fines of up to $50,000, or as high as $100,000 in the case of hearing claims.

Karaka Bays Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory to all Karaka Bays and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records of their conformance with any Healthy Homes Standards that apply or will apply during the tenancy of their rental properties.

Draughts can lead to dropping temperatures within homes. A damp home will cost more to heat, which means wasting energy and incurring higher costs.

If a draught is noticed from gaps that are not adequate or holes, it requirements to be sealed.

What are unreasonable gaps and holes?

If you can feel external air getting in, or see a clear draught from a crack or a gap or crack, then it’s likely to be a gap or hole which requirements sealing in the way you can. Adequate heaters are important to ensure healthy homes

Heating Karaka Bays

Rental properties in Karaka Bays need to have a stable heating source that is able to heat the principal or the biggest living area to at minimum 18degC, even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat needs to remain fixed (i.e., not portable) and at least 1.5 Kilowatts in heating capacity, and must meet the minimum required heating capacity in the living area. A Heating Assessment Tool can be used to check if your current fixed heater(s) are adequate or whether you will need to top up by adding a second heater. Fires that are open and unflued heaters such as the portable LPG bottle heaters are not considered to be acceptable heating options under The Healthy Homes Standard.

If the heating system you offer is an electric heater or heat source, it should be equipped with the thermostat. This will help make the heating more uniform and efficient. In most homes, larger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. However, in some cases like apartments with small spaces an electric, fixed heater might be enough.

If the living area already has a permanent heating source such as the heat pump, it might need a top up in order to comply with the standards. Certain kinds of heaters aren’t able to be used to meet the standard because they’re not effective, cost prohibitive to operate or are unsafe to operate.
