Fines for Failing to Comply

Those who have at least six rental properties could receive fines of up to $50,000 and as high as $100,000 in the case of hearing claims.

Tenancies commenced in the period between July 1st 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory for all Karaka Bays and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the conformance to all Healthy Homes Standard that apply or will be applicable during the tenancy of your rental home.

From 1 July 2021

  • Property managers and private landlords must make sure their rental properties conform to the Healthy Homes Standards within 90 days of any newly renewed, extended or changed Tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of when the tenancy first began.

Heating Karaka Bays

Karaka Bays rental properties must have a fixed source of heat that is able to heat the principal or the biggest living space to a minimum of 18degC, even on the coldest winter days. In most homes, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters will be required. In some instances, like apartments with small spaces the smaller fixed electric heater could be enough.

If your main living space already has a permanent heating source such as heat pumps, it could require an upgrade to make sure it meets the requirements. Some types of heaters can’t be used to achieve the standard as they are either not efficient, cost prohibitive to operate or unsafe to operate.

Ventilation Karaka Bays

Each living space within a rental property must have at least one opening window or exterior door to provide natural airflow. In addition, humid areas like kitchens and bathrooms should have an externally vented extractor fan to remove moisture.
