Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied contract is signed on a Karaka Bays rental property, all Healthy Homes compliance items need to be completed by the end of 90 days.

Beginning on July 1st, 2021, once a new or renewed Tenancy is signed for the Karaka Bays rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy contract, there may be an additional penalty or infringement fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the home they are living in. If the property manager does not supply the information requested within 21 days from getting the notice, the tenant will be issued an infringement notice and be fined up to $750.

The highest penalties are given for the most serious violations, and landlords who own six or more properties can receive fines of up to $50,000, and as much as $100,000 in the case of hearing claims.

Karaka Bays Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory to all Karaka Bays and New Zealand rental homes where it’s reasonably practicable to put in.

  • All houses which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Heating Karaka Bays

Karaka Bays rental properties must have a fixed source of heat that can warm the living area to at minimum 18 degrees Celsius, even on the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source needs for it to be permanent (i.e. not portable) and at minimum 1.5 horsepower in capacity, and must meet the minimum heating capacity needed to heat the living space in general. In most homes, larger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters are needed. However, in some cases like small apartment buildings small apartments, a smaller electric fixed heater may suffice.

If the main living room already has a central heating source like the heat pump, it could need an upgrade to ensure it meets the requirements. Certain types of heaters cannot be utilised to meet the standard since they’re either costly, not cost-effective to run, and/or unhealthy to run.

Ventilation Karaka Bays
