Fines for Failing to Comply

The information contained in the Compliance Statement needs to be correct when the tenancy agreement is signed, and ideally it is updated throughout the duration of the tenancy when any associated work has been completed.

It’s also crucial to be aware that a landlord who own multiple rental properties may face more severe penalties for not complying. The most severe penalties are reserved for the most serious breaches. Landlords with six or more properties could be fined up to $50,000 and as high as $100,000 for hearing claims.

Karaka Bays Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is required to all Karaka Bays and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the compliance with the Healthy Homes Standards that apply or will be applied to their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a new, renewed or varied lease.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of when the tenancy began.

Heating Karaka Bays

Karaka Bays rental properties must have a fixed heating source that can heat the living area to at minimum 18degC even on the winter coldest days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The insulation of the ceiling and underfloor is a requirement in all rental homes since 1 July 2019. All landlords and property managers must ensure that the insulation is up to the new standard. In some instances, current ceiling insulation, or the insulation of the sub floor space may require to be added or replaced.
