Fines for Failing to Comply

When Do I need to be in compliance with The Healthy Homes Standards?

Karaka Bays Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is required for all Karaka Bays and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records that prove the compliance with each Healthy Homes Standards that apply or will be in force throughout the tenancy period of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers should make sure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenancy.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All homes which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Karaka Bays

Karaka Bays rental properties need to have a stable heating source which can warm the largest or main living space to a minimum of 18degC, even on the coldest winter days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat requirements that it be permanently fixed (i.e. not portable), at least 1.5 kW of heating capacity, and must meet the minimum required heating capacity to heat the living space in general. For most homes, larger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters are required. However, in certain instances such as small apartments, a smaller fixed electric heater might be enough.

If your living space already has a permanent heating source such as the heat pump, it could need an upgrade in order to comply with the standards. Certain types of heaters cannot be used to comply with the quality as they are either expensive, inefficient and/or unhealthy to run.

Ventilation Karaka Bays
