Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Karaka Bays rental property, all Healthy Homes compliance items need to be finished inside of 90 days.

From the 1st of July in 2021, when a new, renewed or varied Tenancy is signed for the Karaka Bays rental property, all Healthy Homes compliance work must be done inside of 90 days.

It’s important to keep in mind that landlords who have multiple rental properties could face more severe penalties for not complying. The highest penalties are given for the most serious violations. Those who have six or more properties could be penalised up to $50,000, or as high as $100,000 for hearing claims.

Karaka Bays Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory throughout Karaka Bays and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records that prove conformance with any Healthy Homes Standards that apply or will be applicable during the tenancy of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords have to make sure their rental properties conform to the Healthy Homes Standards within 90 days of a renewal, new or a change in tenant.
  • All boarding households (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All homes which are rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Rental properties in Karaka Bays need to have a stable heating source that can warm the largest or main living space to a minimum of 18degC even on the most coldest days of the year.
