Fines for Failing to Comply
From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Kaiwharawhara rental property, all Healthy Homes compliance work have to be taken care of by the end of 90 days.
Beginning on July 1st, 2021, when a new, renewed or varied contract is signed on the Kaiwharawhara rental property, all Healthy Homes compliance work must be completed within 90 days.
Failure to meet each of Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included within the renewal, new or amended tenancy agreement there could be an additional penalty or infringement fee.
Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager fails to supply the necessary information within 21 days from being informed of the request, they can receive an infringement letter and be fined upto $750.
In addition, there is also a fine of as much as $900 for property owners or property managers providing a false or misleading Healthy Homes Compliance Statement or information. The person who is liable for this fine is the person who is listed on the tenancy contract as the person letting the property out and it could be the name of the landlord or the company that manages the property.
All information in the Statement of Compliance requirements to be up-to-date before the tenancy agreement can be executed, and it is updated throughout the duration of the tenancy when any related work is completed.
It’s also crucial to note that a landlord who own multiple rental properties may face greater penalties for non-compliance. The harshest penalties are given for the most serious breaches, and landlords with six or more properties can be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.
