Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied contract is signed on a Houghton Bay rental property, all Healthy Homes compliance work have to be done inside of 90 days.

The person who is liable for this fine is the person who is listed on the tenancy agreement as being the person who is letting the property, so it could be the name of the landlord, or the company that manages the property.

All the information on the Compliance Statement needs to be accurate before the tenancy agreement can be signed. It should be kept updated throughout the duration of the tenancy when any necessary work related to it’s finished.

It’s also important to remember that landlords who have multiple rental properties may receive greater penalties for non-compliance. The highest penalties are given only for serious violations. Those who have at least six rental properties could be fined as high as $50,000 and as high as $100,000 for hearing claims.

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory in all Houghton Bay and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records that demonstrate compliance with each Healthy Homes Standards that apply or will be in force to their rental properties.

From July 1st 2021

  • Property managers and private landlords are required to make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a new, renewed , or altered Tenancy.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All homes rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Heating Houghton Bay

Houghton Bay rental properties should have a permanent source of heat that can heat the main or largest living room to at least 18 degrees Celsius, even on the coldest days of the year.
