Fines for Failing to Comply
Since the 1st July of 2021, when a new, renewed or varied tenancy is signed for a Houghton Bay rental property, all Healthy Homes compliance tasks need to be taken care of by the end of 90 days.

Failure to meet any of the Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy contract, there may be an additional fine or violation fee.
Any tenant may request information regarding the Healthy Homes Standard and how they relate to the building they are living in. If the property manager does not provide the required information within 21 days of getting the notice, the tenant will receive an infringement notification and could be fined up to $750.
Furthermore, there’s also a fine of up to $900 for landlords or property managers who offer a false or misleading Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the one who is listed on the tenancy contract as the person letting the property out and it could be the landlord’s name or the company that manages the property.
All information in the Compliance Statement needs to be current at the time that the tenancy agreement is signed, and ideally it is updated through the tenancy period as associated work has been completed.
It is crucial to keep in mind that a landlord who manage several rental properties can face even higher fines for non-compliance. The most severe penalties are reserved for the most serious violations. Those who have at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 in hearings.
