Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed on a Houghton Bay rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Since the 1st July of 2021, if a new or renewed Tenancy is signed for a Houghton Bay rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

The person who is responsible to pay this fine is the one who is identified on the tenancy agreement as the person who is letting the property out, so it could be the name of the landlord, or the property management company.

All information in the Compliance Statement needs to be up-to-date when the tenancy contract is executed, and it is updated throughout the duration of the tenancy when any related work is completed.

It’s important to note that a landlord who own multiple rental properties may receive more severe penalties for not complying. The highest penalties are reserved only for serious violations, and landlords who own six or more properties can be fined as high as $50,000 and as high as $100,000 for hearing claims.

Tenancies established beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is mandatory to all Houghton Bay and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or altered tenancy contract.

Houghton Bay rental properties require a reliable heating source which can warm the principal or the biggest living room to at least 18degC, even during the coldest winter days.
