Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed contract is signed on a Houghton Bay rental property, all Healthy Homes compliance items need to be taken care of inside of 90 days.

Houghton Bay Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement for all Houghton Bay and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records of their the compliance with any Healthy Homes Standard that apply or will be applicable throughout the tenancy period of your rental home.

Beginning 1 July 2021

  • Private landlords and property managers should ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any renewal, new or a change in lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.
