Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed for a Houghton Bay rental property, all Healthy Homes compliance items need to be taken care of inside of 90 days.

Additionally, there is also a fine of up to $900 for landlords or property managers who have provided a false or false Healthy Homes Statement of Compliance or information. The person who is liable for this fine is whoever is named on the lease agreement as being the person leasing the property out which could be the landlord’s name or the company that manages the property.

All information in the Compliance Statement needs to be current at the time that the tenancy agreement is executed, and it should be maintained during the entire tenancy, as associated work has been completed.

It’s also crucial to be aware that a landlord who manage multiple rental properties may face greater penalties for non-compliance. The harshest penalties are given for serious violations. Those who have six or more properties could be penalised up to $50,000, or as high as $100,000 in hearings.

Houghton Bay Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement to all Houghton Bay and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the compliance with all Healthy Homes Standard that apply or will apply during the tenure of your rental home.

Beginning 1 July 2021

From 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.
