Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied contract is signed on a Houghton Bay rental property, all Healthy Homes compliance tasks have to be completed inside of 90 days.

From the 1st of July in 2021, when a new or renewed tenancy is signed on a Houghton Bay rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or revised tenancy agreement there may be an additional penalty or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they are living in. If the property manager is unable to supply the required information within 21 days of having received the inquiry, they can be issued an infringement notice and could be fined up to $750.

In addition, there is also a penalty approximately $900 for landlords or property managers who have provided a false or misleading Healthy Homes Compliance Statement or information. The person who is liable for this fine is the one who is named on the lease agreement as being the person who is letting the property which could be the name of the landlord, or the company that manages the property.

The information contained in the Statement of Compliance needs to be accurate before the tenancy agreement can be completed, and is updated throughout the duration of the tenancy when any associated work has been completed.

It’s crucial to note that landlords who manage multiple rental properties could face more severe penalties for not complying. The harshest penalties are reserved for severe violations, and landlords who own six or more properties could be fined as high as $50,000, and even as high as $100,000 in hearing claims.

Houghton Bay Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory to all Houghton Bay and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate compliance with the Healthy Homes Standard that apply or will apply during the tenure of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied lease.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All houses let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Adequate heaters are crucial for healthy homes

Heating Houghton Bay

Rental properties in Houghton Bay should have a permanent source of heating which can warm the principal or the biggest living space to a minimum of 18degC, even during the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source needs to be fixed (i.e., not portable), at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum heating capacity needed to heat the living space in general. For most properties, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. In certain situations, like small apartment buildings an electric, fixed heater may be sufficient.

If your living space already has a fixed heating source, like an air conditioner, it may require an upgrade to meet the standards. Certain kinds of heaters cannot be used to meet the quality as they are either costly, not cost-effective to run, and/or unsafe to run.

Ventilation Houghton Bay
