Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied contract is signed on a Highbury rental property, all Healthy Homes compliance items need to be completed by the end of 90 days.

It’s also crucial to note that a landlord who own several rental properties can face more severe penalties for not complying. The most severe penalties are given for serious breaches. Landlords with more than six properties could be penalised up to $50,000, or as high as $100,000 in hearings.

Highbury Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory in all Highbury and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords must keep records of their conformance with all Healthy Homes Standard that apply or will apply during the tenancy of your rental home.

From July 1st 2021

  • Property managers and private landlords are required to make sure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of any new, renewed or varied tenancy.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Highbury

Highbury rental properties require a reliable source of heating that is able to heat the main or largest living space to at least 18degC, even during the winter coldest days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

Ventilation Highbury
