Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed on a Highbury rental property, all Healthy Homes compliance items must be taken care of by the end of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed on the Highbury rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards within the deadlines can result in an amount of $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy agreement, it could result in an additional fine or infringement fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager is unable to provide the information requested within 21 days from having received the inquiry, they may receive an infringement notice and be fined upto $750.

Additionally, there is also a penalty up to $900 for landlords or property managers that provide false or incorrect Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the person who is listed on the tenancy agreement as the one who is who is letting the property and it could be the landlord’s name or the property management company.

All information in the Statement of Compliance requirements to be up-to-date at the time that the tenancy agreement is signed. It should be maintained through the tenancy period as necessary work related to it’s finished.

It’s also crucial to be aware that a landlord who manage multiple rental properties may receive more severe penalties for not complying. The highest penalties are handed down for severe breaches. Landlords with six or more properties can be fined up to $50,000, or as high as $100,000 in hearings.

Highbury Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is required to all Highbury and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the conformance to each Healthy Homes Standards that apply or will apply during the tenancy of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any new, renewed or varied tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Highbury rental properties should have a permanent heating source which can warm the living room to at least 18degC even on the winter coldest days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat needs to be fixed (i.e. not portable) with at minimum 1.5 kW of heating capacity, and must meet the minimum heating capacity needed in the living area. In most houses, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are required.
