Did you know that the Healthy Homes Standards came into effective on July 1st, 2021? Landlords are now required to ensure that their Highbury rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any renewal or new tenancy and all private rental properties must be fully compliant by 1 July 2024.

Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed tenancy is signed on a Highbury rental property, all Healthy Homes compliance items must be taken care of within 90 days.

Since the 1st July of 2021, when a new or renewed lease is entered into on a Highbury rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to meet all of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t incorporated within an updated, renewed, or revised tenancy agreement, it could result in additional penalties or an infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the building they reside in. If the property manager does not supply the required information within 21 days of being informed of the request, they could be issued an infringement notice and be fined as high as $750.

Furthermore, there’s also a penalty approximately $900 for landlords or property managers who have provided a false or incorrect Healthy Homes Compliance Statement or other information. The person responsible for this fine is the person who is listed on the tenancy agreement as the one who is who is letting the property and it could be the name of the landlord, or the company that manages the property.

All information in the Compliance Statement requirements to be accurate when the tenancy contract is signed. It must be updated throughout the duration of the tenancy when any associated work has been completed.

It is important to keep in mind that a landlord who manage multiple rental properties could face even higher fines for non-compliance. The harshest penalties are handed down only for serious violations, and landlords who own more than six properties could be penalised up to $50,000, or as high as $100,000 in hearing claims.

When Do I require to be in compliance with my Healthy Homes Standards?

Highbury Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory throughout Highbury and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the compliance with all Healthy Homes Standards that apply or will be applicable throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers have to make sure their rental properties comply in accordance with Healthy Homes Standards within 90 days of any new, renewed , or altered Tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All homes which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts increase the likelihood of less temperature in houses. A cold home will cost more to heat, which means wasting energy and increased bills.

What are unreasonable gaps and holes?

If you are able to feel external air getting in, or see the sound of a clear draught emanating from a crack or a gap or crack, then it’s likely a crack or hole which requirements sealing in somehow. Cracks or gaps with large gaps must be stopped permanently. Any gaps greater than 3mm that let air in or out of the house need seals. For example, if an open fireplace isn’t used it may cause draughts and should be shut off. There is no need to block holes or gaps in the building. For example, tiny gaps around doors and windows may be required to allow for the movement of the structure as the home is heated and cools so that they can still be closed and opened rather than securing. A good heating system is crucial for well-being homes

Heating Highbury

Rental properties in Highbury must have a fixed heating source that is able to heat the living room to at least 18degC even on the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source requirements for it to be permanent (i.e. not portable) that is, at least 1.5 Kilowatts in heating capacity, and must meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool could be used to determine if the fixed heater(s) are sufficient or if you’ll need to ‘top up’ by adding a second heater. Open fires as well as unflued combustion heaters, such as small portable LPG bottle heaters aren’t considered acceptable heating options in the Healthy Homes Standard.

If the heating that you provide is an electric heater (or heat pump), it needs to include the thermostat. This makes the heating more reliable and effective. For the majority of houses, bigger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters will be required. In some instances, like apartments with small spaces the smaller fixed electric heater might be enough.

If the main living room already has a fixed heating source, like the heat pump, it might just need some additional energy to ensure it meets the requirements. Certain types of heaters cannot be used to meet the quality because they’re inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Highbury

Each liveable space in the rental property should have at least one opening windows or an exterior door to provide natural airflow. Furthermore, moist areas such as kitchens and bathrooms should have an externally vented extractor to take moisture away.

The ventilation quality is all about recognising how the dry atmosphere is easier to heat, and that a well ventilated rental property is less likely to be a victim of damp and mould.

Bedrooms, living rooms, kitchens and dining rooms are considered to be liveable spaces. Connecting spaces like the hallway are not considered living spaces and therefore do not need an opening door or window.

Each window, door , or Skylight needs to be able open to the outside, but remain at an open angle to allow for fresh air circulation and ventilation.

The bathrooms in all kitchens and any other room in your home with a bath, shower cooker or any other moisture generating item will need suitable extractor fans that can be vented to the outside. Insulation Highbury

The insulation of the ceiling and underfloor has been compulsory in all rental homes since 1 July 2019. All landlords and property managers are required to make sure that the insulation is up to the new standard. In some instances, an existing insulation on the ceiling or in the subfloor space might need to be topped up or replaced.

A properly insulated home can help control condensation and lower the chance of mould and dampness, and will also make it easier to the household to keep heat.
