Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed for a Highbury rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Beginning on July 1st, 2021, when a new, renewed or varied Tenancy is signed for the Highbury rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to any of the Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not incorporated in the new, renewed or amended tenancy agreement it could result in an additional fine or infringement fee.

If the landlord or the property manager doesn’t provide the necessary information within 21 days of getting the notice, the tenant could receive an infringement letter and be fined as high as $750.

In addition, there’s an additional fine of as much as $900 for landlords or property managers that provide false or false Healthy Homes Compliance Statement or information. The person who is responsible for this fine is whoever is identified on the tenancy agreement as the person who is letting the property out and it could be the name of the landlord, or the property management company.

The information contained in the Compliance Statement requirements to be current at the time that the tenancy agreement is signed, and ideally it should be maintained during the entire tenancy, as related work is completed.

It is crucial to keep in mind that landlords who manage several rental properties can face even higher fines for non-compliance. The most severe penalties are reserved only for serious violations, and landlords who own six or more properties could be fined up to $50,000, and as much as $100,000 for hearing claims.

Highbury Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is required in all Highbury and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the compliance with all Healthy Homes Standard that apply or will apply during the tenancy of the rental property.

From 1 July 2021

  • Property managers and private landlords should ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a new, renewed or varied tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of when the tenancy began.

If you are able to feel external air coming in or the air is clear from a gap or hole and you are able to feel it, it’s likely a crack or crack that needs sealing in somehow. Cracks or gaps with large gaps must be stopped permanently. Gaps greater than 3mm that allow air in or out from the home need seals. For example, if the open fireplace isn’t in use it could cause draughts, and should be shut from. Landlords and property managers are accountable for making sure that such draughts are squelched in the maximum extent possible.

You don’t require to block holes or gaps which are part of the construction. For instance, small gaps around windows and doors may be required to allow movement of the structure when the household warms and cools so that they are able to be shut and opened, rather instead of being stuck. Adequate heaters are crucial to ensure healthy houses

Heating Highbury

Rental properties in Highbury need to have a stable heating source that can warm the main or largest living space to at least 18 degrees Celsius, even on the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating requirements that it be permanently fixed (i.e. not portable) that is, at least 1.5 kW of heating capacity, and it must have the minimum heating capacity needed in the living area. For most properties, larger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters will be required. In some instances, such as small apartments, a smaller fixed electric heater may be sufficient.

If your main living space already has a permanent heating source, such as an air conditioner, it could require an update to be able to meet the standards. Certain kinds of heaters aren’t able to be used to comply with the standard as they are either costly, not cost-effective to run, and/or unhealthy to run.
