Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed on a Highbury rental property, all Healthy Homes compliance items have to be completed within 90 days.

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed on the Highbury rental property, all Healthy Homes compliance work must be completed within 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the expected timeframe can result in penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy agreement there may be an additional penalty or infringement fee.

Additionally, there is also a fine of approximately $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Compliance Statement or information. The person liable for this fine is the one who is named on the lease agreement as the person who is letting the property out, so it could be the name of the landlord as well as the property management company.

It’s also important to note that landlords who own multiple rental properties could face more severe penalties for not complying. Tenancies that were signed beginning on 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement to all Highbury and New Zealand rental houses where it’s reasonably practicable to install.

Highbury rental properties must have a fixed source of heating that can warm the largest or main living space to a minimum of 18 degrees Celsius, even on the winter coldest days.
