Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied contract is signed on a Highbury rental property, all Healthy Homes compliance items need to be finished inside of 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied lease is entered into on a Highbury rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Highbury Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is required in all Highbury and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords have to keep records of their compliance with all Healthy Homes Standard that apply or will apply during the tenancy of your rental home.

From 1 July 2021

  • Property managers and private landlords should ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of a newly renewed, extended or changed lease.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy began.

However, in some cases like small apartments, a smaller fixed electric heater may be sufficient.

If the main living room already has a fixed heating source, like the heat pump, it may require an upgrade to ensure it meets the requirements. Some types of heaters can’t be used to achieve the standard because they’re inefficient, unaffordable to operate or unsafe to operate.

Ventilation Highbury
