Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied contract is signed on a Highbury rental property, all Healthy Homes compliance work have to be taken care of within 90 days.

From the 1st of July in 2021, when a new or renewed Tenancy is signed for a Highbury rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Highbury Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is required throughout Highbury and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the compliance with all Healthy Homes Standard that apply or will apply during the tenancy of the rental property.

Starting 1 July 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of a renewal, new or a change in tenant.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must adhere to the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.
