Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed on a Highbury rental property, all Healthy Homes compliance items must be done within 90 days.

From the 1st of July in 2021, when a new, renewed or varied Tenancy is signed for the Highbury rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to adhere to each of Healthy Homes Standards by the end of the anticipated timeframe could result in an amount of $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy agreement there may be an additional fine or infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the property they reside in. If the property manager is unable to supply the necessary information within 21 days from receiving the request, they can receive an infringement notification and be fined up to $750.

Furthermore, there’s also a penalty approximately $900 for landlords and property managers that provide false or incorrect Healthy Homes Compliance Statement or other information. The person responsible for this fine is whoever is identified on the tenancy agreement as the one who is letting the property out which could be the name of the landlord or the company that manages the property.

It’s also crucial to be aware that a landlord who own several rental properties can face greater penalties for non-compliance. Highbury Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory for all Highbury and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate conformance with the Healthy Homes Standards that apply or will be applied throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of any new, renewed , or altered tenant.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Highbury

Rental properties in Highbury must have a fixed heating source which can warm the main or largest living area to at minimum 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating requirements to remain fixed (i.e. not portable) that is, at least 1.5 kW of heating capacity, and it must have the minimum capacity for heating required for the main living space. For most properties, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are required. In certain situations, such as small apartments, a smaller fixed electric heater may be sufficient.

If the main living room already has a central heating source, such as a heat pump, then it might require some additional energy to meet the standards. Some types of heaters can’t be used to comply with the quality as they are either costly, not affordable to run, and/or unsafe to run.

Ventilation Highbury
