Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords now have to ensure that their Highbury rental properties meet the minimum Healthy Homes Standards within 90 days of any renewal or new tenancy and all private rental properties are required to be fully certified by 1 July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on a Highbury rental property, all Healthy Homes compliance items must be taken care of by the end of 90 days.

From the 1st of July in 2021, if a new, renewed or varied Tenancy is signed for a Highbury rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to comply with one of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not incorporated within the new, renewed or amended tenancy agreement there could be additional penalties or an infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager does not supply the information requested within 21 days from receiving the request, they may receive an infringement notice and be fined up to $750.

Additionally, there is also a penalty of as much as $900 for property owners or property managers who offer a false or false Healthy Homes Compliance Statement or any other information. The person liable for this fine is the person who is identified on the tenancy agreement as the one who is who is letting the property, so it could be the name of the landlord, or the property management company.

All information in the Statement of Compliance needs to be up-to-date when the tenancy contract is completed, and should be kept updated through the tenancy period as necessary work related to it is finished.

It’s important to remember that landlords who own multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are given for serious violations. Those who have at least six rental properties could be fined up to $50,000, or as high as $100,000 in hearings.

When should I need to be in compliance with the Healthy Homes Standards?

Highbury Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is required throughout Highbury and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included with any renewal, new or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove the conformance to each Healthy Homes Standards that apply or will apply during the tenancy of their rental properties.

From July 1st 2021

  • Private landlords and property managers have to ensure their rental properties conform to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All houses rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Highbury

Draughts increase the likelihood of less temperature in houses. A damp house will cost more to heat, meaning wasting energy and incurring higher costs.

If a draft can be perceived as a result of gaps or holes, it needs to be closed.

What are the most unreasonable gaps or holes?

If you are able to feel external air entering or an unobstructed draught coming out of a hole or gap and you are able to feel it, it’s likely a crack or crack that requirements sealing in somehow. Cracks or gaps with large gaps must be fixed permanently. Gaps greater than 3mm that let air into or out within the home need the sealing. For instance, if an open fireplace isn’t used it can create draughts. This should be blocked from. Property managers and landlords are responsible for making sure such draughts are eliminated in the maximum extent imaginable.

You don’t need to block up intentional holes or gaps that are part of the construction. Adequate heaters are important for well-being homes

Heating Highbury

Highbury rental properties must have a fixed source of heating that can heat the main or largest living area to at minimum 18degC even on the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating requirements for it to be permanent (i.e. not portable), at least 1.5 kW of heating capacity, and must meet the minimum heating capacity needed for the main living room. A Heating Assessment Tool may be used to determine if the existing fix heater(s) are adequate or if you’ll need to ‘top up’ with an additional heater. Open fires as well as unflued combustion heaters such as portable LPG bottle heaters aren’t considered to be suitable heating options under The Healthy Homes Standard.

If the heating that you offer is electric heating or heat source, then it must be equipped with the thermostat. This will help make your heating more consistent and effective. For most properties, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In certain situations, like small apartment buildings an electric, fixed heater could be enough.

If your living space already has a central heating source, like the heat pump, it may need an upgrade to be able to meet the standards. Certain types of heaters cannot be used to achieve the quality as they are either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Highbury
