Fines for Failing to Comply
Since the 1st July of 2021, if a new or renewed tenancy is signed for a Heretaunga rental property, all Healthy Homes compliance tasks must be done inside of 90 days.

Failure to meet any of the Healthy Homes Standards within the period of time expected can lead to penalties of up to $7200. In addition, if the present Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement there could be additional penalties or an infringement fee.
Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager is unable to supply the necessary information within 21 days from having received the inquiry, they can receive an infringement notification and be fined as high as $750.
In addition, there’s also a fine of as much as $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Compliance Statement or any other information. The person responsible for this fine is whoever is named on the lease agreement as being the person leasing the property out and it could be the name of the landlord or the company that manages the property.
The information contained in the Compliance Statement needs to be correct when the tenancy contract is signed. It must be updated during the entire tenancy, as related work is completed.
It is important to remember that landlords who manage several rental properties can face more severe penalties for not complying. The highest penalties are handed down for the most serious breaches. Landlords with at least six rental properties could receive fines of up to $50,000, and as much as $100,000 for hearing claims.
