Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed contract is signed on a Heretaunga rental property, all Healthy Homes compliance items need to be taken care of within 90 days.

As of 1st July 2021, once a new or renewed tenancy is signed on the Heretaunga rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet one of the Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. The information contained in the Compliance Statement needs to be accurate when the tenancy contract is signed, and ideally it must be updated throughout the tenancy as any necessary work related to it is finished.

It’s crucial to note that landlords with multiple rental properties could face greater penalties for non-compliance. The most severe penalties are handed down for the most serious breaches, and landlords with at least six rental properties could be fined as high as $50,000, and even as high as $100,000 in the case of hearing claims.

When do I require to meet the Healthy Homes Standards?

Heretaunga Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement in all Heretaunga and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the compliance with each Healthy Homes Standards that apply or will be in force during the tenure of their rental properties.

From July 1st 2021

  • Property managers and private landlords have to ensure their rental properties conform with the Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Heating Heretaunga

Heretaunga rental properties need to have a stable source of heat that is able to heat the main or largest living space to a minimum of 18 degrees Celsius, even on the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating needs to remain fixed (i.e., not portable) and at minimum 1.5 Kilowatts in heating capacity and have the minimum requirement for heat capacity for the main living space. A Heating Assessment Tool can be used to check if the current permanent heater(s) are adequate or whether you will need to "top-up" with a new heater. Fires that are open and unflued heaters such as small portable LPG bottle heaters aren’t considered acceptable heating options for the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat pump it must be equipped with an thermostat. This will make the heating more consistent and effective. For most houses, larger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In some instances, like apartments with small spaces, a smaller fixed electric heater may be sufficient.

If your living space already has a fixed heating source like the heat pump, it might require an upgrade to meet the standards. Certain types of heaters cannot be utilised to meet the quality since they’re either costly, not cost-effective to run, and/or unsafe to run.
