Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied contract is signed on a Haywards rental property, all Healthy Homes compliance items need to be finished within 90 days.

From the 1st of July in 2021, if a new, renewed or varied lease is entered into on the Haywards rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to comply with any of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. All the information on the Compliance Statement needs to be up-to-date before the tenancy agreement can be completed, and is updated throughout the duration of the tenancy when any associated work has been completed.

It’s also important to keep in mind that a landlord with several rental properties can face even higher fines for non-compliance. The most severe penalties are given for severe breaches. Landlords with more than six properties could be penalised up to $50,000 and as high as $100,000 in hearing claims.

Tenancies commenced from 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is a requirement in all Haywards and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords must keep records that prove compliance with any Healthy Homes Standard that apply or will be applicable during the tenure of an apartment rental.

From 1 July 2021

  • Property managers and private landlords should make sure their rental properties conform in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied tenancy.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All households which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of when the tenancy began.
