Did you know that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords are now required to ensure their Grenada North rental properties meet the minimum Healthy Homes Standards within 90 days of any new or renewed tenancy, and all private rental properties are required to be fully certified by 1 July 2024.

Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed for a Grenada North rental property, all Healthy Homes compliance items have to be taken care of within 90 days.

As of 1st July 2021, when a new, renewed or varied contract is signed on a Grenada North rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to adhere to any of the Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or amended tenancy agreement there could be an additional penalty or infringement fee.

Anyone can request details regarding the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager is unable to supply the required information within 21 days of receiving the request, they will receive an infringement notification and be fined upto $750.

Furthermore, there’s an additional fine of up to $900 for property owners or property managers providing a false or misleading Healthy Homes Statement of Compliance or other information. The person responsible to pay this fine is the one who is named on the tenancy contract as the person who is letting the property, so it could be the landlord’s name or the property management company.

All the information on the Compliance Statement needs to be accurate before the tenancy agreement can be signed. It is updated through the tenancy period as related work is completed.

It’s also important to remember that landlords with multiple rental properties could face greater penalties for non-compliance. The harshest penalties are given for serious violations. Those who have more than six properties could be fined as high as $50,000, and even as high as $100,000 for hearing claims.

When do I require to be in compliance with The Healthy Homes Standards?

Grenada North Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is mandatory to all Grenada North and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Landlords and property managers must keep records that prove the conformance to each Healthy Homes Standards that apply or will be applicable during the tenure of the rental property.

From July 1st 2021

  • Private landlords and property managers must ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must meet the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Grenada North

Draughts are a major cause of low temperatures inside houses. A damp home will cost more to heat, which results in wasting energy and incurring higher costs.

If a draught could be felt through gaps that are too large or holes or holes, it needs to be sealed.

Heating Grenada North

Grenada North rental properties should have a permanent source of heating that can warm the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat needs to remain fixed (i.e. not portable) that is, at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum required heating capacity for the main living space. A Heating Assessment Tool may be used to check if the existing permanent heater(s) are adequate or whether you will require to ‘top up’ with an additional heater. Fires that are open and unflued heaters such as mobile LPG bottle heaters are not considered to be acceptable heating options in The Healthy Homes Standard.

If the heating that you provide is an electric heater or heat pump, it must be equipped with a thermostat. This will make the heating more reliable and effective. For the majority of houses, bigger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are required. In certain situations, like small apartments an electric, fixed heater may suffice.

If the living area is already equipped with a fixed heating source, such as the heat pump, it might just require an update in order to comply with the standards. Certain kinds of heaters cannot be used to achieve the standard because they’re expensive, inefficient or unsafe to operate.

Ventilation Grenada North

The insulation of the ceiling and underfloor has been compulsory to all rental homes since July 1, 2019. All landlords and property managers have to make sure that the insulation meets standards that are in line with the latest quality. In certain situations, the an existing insulation on the ceiling or in the subfloor space may need to be replaced or replaced.
