Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied contract is signed on a Grenada North rental property, all Healthy Homes compliance work need to be taken care of by the end of 90 days.

From the 1st of July in 2021, once a new, renewed or varied contract is signed on a Grenada North rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to meet all of the Healthy Homes Standards inside of the deadlines can result in the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or amended tenancy agreement there may be an additional fine or violation fee.

Anyone can request details about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager does not supply the necessary information within 21 days of being informed of the request, they may receive an infringement letter and be fined upto $750.

In addition, there is also a fine of approximately $900 for property owners or property managers providing a false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is liable to pay this fine is the one who is identified on the tenancy agreement as being the person leasing the property out which could be the landlord’s name or the property management company.

All information in the Compliance Statement needs to be correct when the tenancy contract is completed, and must be updated through the tenancy period as relevant work gets completed.

It’s crucial to note that landlords who own multiple rental properties may face greater penalties for non-compliance. The harshest penalties are reserved for the most serious breaches. Landlords with more than six properties could receive fines of up to $50,000, and as much as $100,000 in hearing claims.

When should I require to meet The Healthy Homes Standards?

Grenada North Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement in all Grenada North and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate compliance with all Healthy Homes Standard that apply or will be in force to their rental properties.

Beginning 1 July 2021

  • All rental homes must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.

For instance, if an open fireplace isn’t used it could cause draughts, and should be sealed from. Property managers and landlords are responsible for making sure that such draughts are squelched as far as possible.

Heating Grenada North

Rental properties in Grenada North need to have a stable heating source that can warm the principal or the biggest living space to at least 18degC, even during the coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements to remain fixed (i.e. not portable) with at minimum 1.5 kW in heating capacity, and meet the minimum required heating capacity in the living area. A Heating Assessment Tool could be used to determine whether the permanent heater(s) are adequate or whether you will require to "top up" with an additional heater. If the heating that you offer is an electric heater or heat pump it should include the thermostat. This will help make the heating more consistent and effective. In most houses, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in some cases such as small apartments the smaller fixed electric heater could be enough.

If the main living room already has a permanent heating source such as an air conditioner, it may require a top up to ensure it meets the requirements. Certain types of heaters cannot be used to meet the quality because they’re not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Grenada North

Every living space of the rental property should contain at minimum one open window or exterior door to offer natural ventilation. Furthermore, moist spaces like kitchens and bathrooms should have an externally vented extractor to remove moisture.

It is the ventilation quality is all about acknowledging the fact that dry air is easier to heat and an apartment that is well-ventilated is less likely to grow damp and mould.

Insulation Grenada North

Underfloor and ceiling insulation is mandatory for all rent houses from 1 July 2019. All landlords and property managers must ensure the insulation meets this new quality. In some instances, existing ceiling insulation or insulation in the subfloor space might require to be replaced or replaced.
