Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on a Grenada North rental property, all Healthy Homes compliance tasks need to be done inside of 90 days.

Beginning on July 1st, 2021, if a new or renewed Tenancy is signed for a Grenada North rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with one of the Healthy Homes Standards within the deadlines can result in penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or amended tenancy agreement there may be an additional fine or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or the property manager doesn’t supply the necessary information within 21 days of getting the notice, the tenant could be issued an infringement notice and be fined upto $750.

In addition, there is also a fine of as much as $900 for landlords or property managers that provide false or incorrect Healthy Homes Compliance Statement or any other information. The person who is liable for this fine is the person who is listed on the tenancy contract as the person who is letting the property and it could be the name of the landlord, or the company that manages the property.

All the information on the Statement of Compliance requirements to be up-to-date at the time that the tenancy agreement is signed. It should be kept updated throughout the tenancy as any associated work has been completed.

It’s also important to be aware that a landlord who manage multiple rental properties may receive more severe penalties for not complying. The highest penalties are given for serious violations. Those who have more than six properties could be fined up to $50,000, or as high as $100,000 for hearing claims.

Grenada North Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory in all Grenada North and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the conformance to any Healthy Homes Standards that apply or will be applicable to an apartment rental.

From 1 July 2021

  • All households rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of when the tenancy first began.

Heating Grenada North

Rental properties in Grenada North must have a fixed heating source which can warm the main or largest living room to at least 18degC, even during the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

However, in certain instances like apartments with small spaces an electric, fixed heater might be enough.

If your main living space already has a permanent heating source, such as the heat pump, it could need some additional energy to ensure it meets the requirements. Underfloor and ceiling insulation is mandatory on all rental houses from 1 July 2019. All landlords and property managers are required to ensure that the insulation is up to the new quality.
