Fines for Failing to Comply
From the 1st of July in 2021, if a new or renewed contract is signed on a Grenada North rental property, all Healthy Homes compliance items have to be finished within 90 days.
From the 1st of July in 2021, once a new or renewed contract is signed on a Grenada North rental property, all Healthy Homes compliance work must be completed inside of 90 days.
Failure to meet one of the Healthy Homes Standards inside of the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy agreement there could be an additional penalty or infringement fee.
Any tenant may request information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager is unable to provide the necessary information within 21 days of getting the notice, the tenant can receive an infringement letter and be fined upto $750.
In addition, there is also a fine of as much as $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the one who is listed on the tenancy agreement as the person who is leasing the property out and it could be the name of the landlord as well as the company that manages the property.
The information contained in the Statement of Compliance requirements to be current before the tenancy agreement can be executed, and it should be kept updated through the tenancy period as necessary work related to it is finished.
It’s also important to be aware that landlords who have multiple rental properties may face additional fines for non-compliance. The most severe penalties are reserved only for serious violations, and landlords who own six or more properties can be penalised up to $50,000, or as high as $100,000 in the case of hearing claims.
