Fines for Failing to Comply
Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed for a Grenada North rental property, all Healthy Homes compliance items must be finished inside of 90 days.
Since the 1st July of 2021, once a new, renewed or varied contract is signed on the Grenada North rental property, all Healthy Homes compliance work must be taken care of within 90 days.
Failure to meet all of the Healthy Homes Standards within the period of time expected can lead to an amount of $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy contract, there may be an additional penalty or infringement fee.
Anyone can request information regarding the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager fails to provide the necessary information within 21 days of receiving the request, they could receive an infringement letter and be fined upto $750.
In addition, there is also a fine of up to $900 for landlords and property managers who offer a false or inaccurate Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the one who is named on the lease agreement as the one who is leasing the property out and it could be the name of the landlord as well as the company that manages the property.
All information in the Compliance Statement needs to be correct when the tenancy agreement is signed, and ideally it must be updated during the entire tenancy, as associated work has been completed.
It’s also important to note that a landlord who have multiple rental properties may receive more severe penalties for not complying. The highest penalties are given for the most serious violations, and landlords who own six or more properties can be fined up to $50,000, and as much as $100,000 for hearing claims.
