Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed tenancy is signed for a Fairfield rental property, all Healthy Homes compliance work need to be completed inside of 90 days.

As of 1st July 2021, when a brand new, renewed or varied lease is entered into on a Fairfield rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Inability to adhere to all of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. In addition, if the current Healthy Homes Statement of Compliance is not incorporated in the new, renewed or amended tenancy agreement there could be an additional penalty or infringement fee.

Anyone can request information about the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager fails to supply the required information within 21 days of receiving the request, they can receive an infringement notification and be fined upto $750.

The person responsible for this fine is the person who is named on the lease agreement as being the person who is letting the property It could also be the name of the landlord, or the company that manages the property.

The information contained in the Statement of Compliance needs to be accurate when the tenancy agreement is executed, and it must be updated throughout the duration of the tenancy when any necessary work related to it’s finished.

It’s also crucial to note that landlords who own multiple rental properties could face more severe penalties for not complying. The harshest penalties are handed down for the most serious breaches, and landlords with six or more properties can be fined as high as $50,000, and as much as $100,000 for hearing claims.

Healthy homes are important

What is the reason Healthy Homes Compliance so important?

A majority of households rent homes in New Zealand and Fairfield, and research shows us that these rental homes tend to be colder, older and have less efficient heating and are of lower standard than those owned by owners.

Cold, damp and mouldy houses are associated with negative health outcomes, especially for diseases like colds and asthma, as well as cardiovascular conditions. In addition, people who have reported at least four major issues with their housing often have low life satisfaction and reduced mental wellbeing.

The improvement in the standard of Fairfield rental property will allow tenants to enjoy improved physical and mental health as well as lessen disturbance to learning, work and living due to illness. Your investment will be secured from mildew, mould and damp damage, meaning lower maintenance costs over the long term.

The Healthy Homes Standards are a list of specific and minimum standards for Heating, Insulation Ventilation, Moisture Ingress and Drainage, as well Draught-stopping in Fairfield rental properties.

Unreasonable Gaps & Holes

Draught Stopping Fairfield

Draughts can lead to lower temperatures in houses. A damp home costs more to heat, resulting in wasted money and energy.

If a draught can be perceived as a result of gaps or holes the area needs to be sealed.

What are unreasonable gaps and holes?

If you can feel external air getting in, or see the air is clear out of a hole or gap that is, it is likely to be a gap or hole which requirements sealing in the way you can. Large cracks and gaps should be permanently stopped. The gaps that exceed 3mm that let air in or out within the home need the sealing. In the case of an open fireplace isn’t used it could cause draughts, and should be blocked from. Property managers and landlords are responsible for making sure that these draughts are stopped whenever possible.

You don’t need to cover up gaps or holes which are part of the building. For instance, small gaps around doors and windows could be necessary to allow movement of the building when the house gets warmer and cooler, to allow them to be opened and closed rather instead of being stuck. We will test all windows and doors in our Healthy Homes assessment of your rental property.

A good heating system is crucial to ensure healthy homes

Heating Fairfield

Fairfield rental properties should have a permanent source of heating that can warm the principal or the biggest living room to at least 18 degrees Celsius, even on the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat requirements to remain fixed (i.e. not portable) that is, at minimum 1.5 kW in heating capacity and have the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool could be used to determine whether the current installed heater(s) are adequate or if you’ll need to top up with a new heater. Fires that are open and unflued heaters, such as the portable LPG bottle heaters are not considered to be suitable heating options under The Healthy Homes Standard.

If the heating system you offer is an electric heater or heat pump, it should be equipped with a thermostat. This will help make the heating more reliable and efficient. For the majority of homes, bigger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in certain instances such as small apartments, a smaller fixed electric heater may suffice.

If your main living space already has a fixed heating source like heat pumps, it might require an update to make sure it meets the requirements. Certain kinds of heaters aren’t able to be utilised to meet the standard because they’re not effective, cost prohibitive to operate and/or unhealthy to run.

Ventilation Fairfield

Each liveable space in the rental property should have at least one opening door or window to provide natural ventilation. Additionally, areas with high moisture spaces like kitchens and bathrooms should have an externally vented extractor to eliminate moisture.

A ventilation quality is all about acknowledging that dry air will be easier to heat and the property that is properly ventilated is less likely to grow damp and mould.

Living rooms, bedrooms, kitchens, and dining areas are all considered living spaces. Spaces that connect, such as the hallway are not considered liveable and don’t require an opening window or door.

Each door, window or skylight requirements to have the ability to open up to the outside, but remain at an open angle in order to allow the circulation of fresh air and ventilation.

Bathrooms, kitchens, and any other area in your home that has a bath, shower and cooktop or another water-generating appliance will require adequate extractor fans that vent towards the outside. We offer a Healthy Homes Assessment service will ensure that there is sufficient ventilation in every living space, including suitable extractor fans in areas of high moisture.

Insulation Fairfield

Underfloor and ceiling insulation is required in all rental homes since July 1, 2019. All landlords and property managers are required to make sure the insulation meets the new quality. In certain situations, the an existing insulation on the ceiling or in the subfloor space might require to be replaced or replaced.

A well-insulated house will help to control condensation and lower the chance of dampness and mould, and also makes much easier for the home to hold heat.

Insulation needs to be in compliance with the R-values for your area

The "R" refers to thermal resistance, and is a measure of how well insulation is able to resist heat flow. The greater the R-value, the higher the standard of insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9 in the underfloor, 1.3
  • Zone 2 – the remainder part of North Island except Taupo and the Central Plateau – ceiling R 2.9 and floor R 1.3

Fairfield Moisture Ingress & Drainage

Protecting your rental property from moisture isn’t just about the inside but you must make sure there is somewhere for surface or ground water, and stop it from coming into the building. When it is about damp and water, it is usually what you don’t see that could be a huge problem and cause damage to your investment and affecting the tenant’s health.

Rental properties should have effective drainage to eliminate storm water, surface water, and ground water, including an appropriate runoff or outfall. Making sure the water has a location to go and that it isn’t allowed to remain beneath buildings is an essential part of maintaining your property’s dry.

Alongside a drainage system to prevent the ingress of moisture, if your rental has an enclosed gap between floorboards and the ground, a ground water barrier should be put in place if it is reasonably practicable to install it.

An underground moisture barrier typically an insulating sheet of polythene laid over the ground, to block any moisture present in the ground from entering the building. It also assists in preventing moisture damage to the underfloor insulation.
