Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Fairfield rental property, all Healthy Homes compliance tasks have to be finished within 90 days.

Beginning on July 1st, 2021, if a new or renewed lease is entered into on a Fairfield rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. In addition, if the present Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement it could result in an additional fine or violation fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager is unable to provide the information requested within 21 days from getting the notice, the tenant may receive an infringement letter and be fined up to $750.

In addition, there is also a penalty as much as $900 for property owners or property managers who offer a false or incorrect Healthy Homes Compliance Statement or other information. The person responsible for this fine is the person who is identified on the tenancy agreement as being the person who is letting the property and it could be the name of the landlord, or the property management company.

The information contained in the Compliance Statement requirements to be up-to-date at the time that the tenancy agreement is executed, and it should be kept updated through the tenancy period as associated work has been completed.

It is also crucial to be aware that landlords who manage several rental properties can face greater penalties for non-compliance. The harshest penalties are reserved for severe breaches, and landlords with six or more properties can receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

When will I need to be in compliance with requirements of the Healthy Homes Standards?

Fairfield Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory to all Fairfield and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the conformance to the Healthy Homes Standards that apply or will be applicable during the tenure of an apartment rental.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of any renewal, new or a change in Tenancy.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Fairfield

Draughts are a major cause of low temperatures inside homes. A cold home is more expensive to heat, which means wasting money and energy.

Large cracks and gaps should be permanently stopped. The gaps that exceed 3mm that allow air to enter or exit of your house need sealing. In the case of an open fireplace isn’t in use it may cause draughts and should be shut off. Landlords and property managers are accountable for ensuring that these draughts are stopped in the maximum extent imaginable.

There is no need to block off holes or gaps that are part of the construction. For instance, small gaps around doors and windows may be required to allow movement of the structure as the house is heated and cools so that they can still be shut and opened, rather than being stuck. Proper heating is crucial for well-being homes

Heating Fairfield

Rental properties in Fairfield must have a fixed heating source that can warm the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source needs for it to be permanent (i.e. not portable) and at least 1.5 kW in heating capacity, and it must have the minimum capacity for heating required in the living area. Ventilation Fairfield

Insulation Fairfield

The insulation of the ceiling and underfloor has been compulsory on all rental homes from 1 July 2019. All landlords and property managers must make sure that the insulation is in line with the new standard.
