Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed for a Fairfield rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Fairfield rental property, all Healthy Homes compliance work must be finished inside of 90 days.

If the property manager does not provide the necessary information within 21 days from having received the inquiry, they could be issued an infringement notice and be fined up to $750.

In addition, there’s also a fine of as much as $900 for landlords and property managers providing a false or inaccurate Healthy Homes Compliance Statement or information. The person who is liable for this fine is whoever is listed on the tenancy agreement as the one who is renting the property, so it could be the landlord’s name or the property management company.

All the information on the Compliance Statement requirements to be up-to-date at the time that the tenancy agreement is completed, and is updated during the entire tenancy, as relevant work gets completed.

It is important to remember that landlords who manage multiple rental properties may receive additional fines for non-compliance. The highest penalties are given only for serious breaches. Landlords with six or more properties can be fined as high as $50,000, or as high as $100,000 for hearing claims.

Fairfield Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is compulsory for all Fairfield and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the conformance to the Healthy Homes Standards that apply or will be applicable to the rental property.

From July 1st 2021

  • Property managers and private landlords are required to ensure their rental properties comply with the Healthy Homes Standard within 90 days of any new, renewed or varied Tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Adequate heaters are crucial for healthy houses

Heating Fairfield

Fairfield rental properties must have a fixed source of heating that can warm the largest or main living room to at least 18 degrees Celsius, even on the winter coldest days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source needs to remain fixed (i.e. not portable) and at minimum 1.5 Kilowatts in heating capacity and have the minimum requirement for heat capacity for the main living space. A Heating Assessment Tool can be used to check if the current fixed heater(s) are adequate or whether you will need to ‘top up’ with a new heater. Open fires as well as unflued combustion heaters like the portable LPG bottle heaters are not considered to be safe heating options under The Healthy Homes Standard.

If the heating you offer is an electric heater or heat source, then it must be equipped with the thermostat. This will make the heating more reliable and efficient. In most homes, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are necessary. However, in some cases like apartments with small spaces small apartments, a smaller electric fixed heater may be sufficient.

If the main living room already has a central heating source, like the heat pump, it may need an update to be able to meet the standards. Certain kinds of heaters aren’t able to be used to meet the quality since they’re either expensive, inefficient or unsafe to operate.
