Fines for Failing to Comply
Beginning on July 1st, 2021, when a new or renewed contract is signed on a Fairfield rental property, all Healthy Homes compliance items need to be finished inside of 90 days.
Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on the Fairfield rental property, all Healthy Homes compliance work must be completed within 90 days.
Failure to comply with any of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if a present Healthy Homes Statement of Compliance is not included in the new, renewed or amended tenancy agreement it could result in an additional penalty or infringement fee.
Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager is unable to supply the information requested within 21 days of being informed of the request, they may receive an infringement letter and could be fined up to $750.
In addition, there is also a fine of as much as $900 for property owners or property managers providing a false or misleading Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the one who is identified on the tenancy agreement as the person who is renting the property, so it could be the name of the landlord, or the property management company.
All information in the Statement of Compliance requirements to be current before the tenancy agreement can be signed. It should be maintained throughout the tenancy as any associated work has been completed.
It is also important to be aware that a landlord who manage several rental properties can face more severe penalties for not complying. The highest penalties are reserved for serious breaches, and landlords with six or more properties could be fined as high as $50,000, and as much as $100,000 for hearing claims.
