Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed contract is signed on an Epuni rental property, all Healthy Homes compliance work have to be completed by the end of 90 days.

Since the 1st July of 2021, when a new, renewed or varied lease is entered into on an Epuni rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance is not included within the renewal, new or amended tenancy agreement there may be additional penalties or an infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager does not provide the information requested within 21 days of getting the notice, the tenant could receive an infringement notice and be fined up to $750.

Epuni Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is required to all Epuni and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records of their the compliance with any Healthy Homes Standards that apply or will apply throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Private landlords and property managers have to ensure their rental properties comply with the Healthy Homes Standards within 90 days of a new, renewed , or altered Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Epuni rental properties should have a permanent source of heat that can warm the main or largest living space to at least 18degC, even on the coldest winter days.
