Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on an Epuni rental property, all Healthy Homes compliance items need to be taken care of by the end of 90 days.

From the 1st of July in 2021, when a new, renewed or varied Tenancy is signed for the Epuni rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy agreement, there could be an additional fine or violation fee.

The person who is responsible for this fine is whoever is identified on the tenancy agreement as being the person letting the property out and it could be the name of the landlord or the company that manages the property.

All the information on the Statement of Compliance needs to be up-to-date when the tenancy contract is executed, and it should be kept updated during the entire tenancy, as related work is completed.

It is also important to keep in mind that landlords who own multiple rental properties could face additional fines for non-compliance. The highest penalties are reserved only for serious violations, and landlords who own six or more properties can be fined up to $50,000, and even as high as $100,000 in hearing claims.

Epuni Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory for all Epuni and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the compliance with all Healthy Homes Standard that apply or will apply throughout the tenancy period of your rental home.

Beginning 1 July 2021

  • Private landlords and property managers must ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Epuni

The insulation of the ceiling and underfloor is mandatory in all rental houses since 1 July 2019. All landlords and property managers should ensure that the insulation is in line with the new quality. In some instances, current ceiling insulation, or the insulation of the subfloor space may require to be topped up or replaced.
