Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed for an Epuni rental property, all Healthy Homes compliance work have to be completed inside of 90 days.

As of 1st July 2021, if a new or renewed Tenancy is signed for an Epuni rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Inability to adhere to one of the Healthy Homes Standards by the end of the expected timeframe can result in a fine of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy contract, there could be an additional penalty or infringement fee.

Anyone can request details regarding the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager is unable to supply the required information within 21 days from receiving the request, they could receive an infringement letter and be fined up to $750.

It’s important to note that landlords who manage multiple rental properties may face even higher fines for non-compliance. The harshest penalties are handed down only for serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000 and as high as $100,000 in hearing claims.

Epuni Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory to all Epuni and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the compliance with any Healthy Homes Standard that apply or will be in force during the tenancy of the rental property.

Starting 1 July 2021

  • Property managers and private landlords should ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a new, renewed , or altered tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.
