Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed on an Elderslea rental property, all Healthy Homes compliance tasks need to be taken care of within 90 days.

Since the 1st July of 2021, if a new, renewed or varied lease is entered into on the Elderslea rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Tenancies commenced between 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is required throughout Elderslea and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records that prove the compliance with any Healthy Homes Standard that apply or will be applicable during the tenancy of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties conform according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed lease.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of when the tenancy began.

Rental properties in Elderslea must have a fixed source of heating which can warm the main or largest living room to at least 18degC, even on the coldest days of the year.
