Did you know that the Healthy Homes Standards came into effective on July 1st, 2021? Landlords are now required to ensure their Days Bay rental properties meet the minimum Healthy Homes Standards within 90 days of a renewed or new tenancy and all private rentals are required to be completely conforming by the 1st July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed for a Days Bay rental property, all Healthy Homes compliance items need to be done inside of 90 days.

From the 1st of July in 2021, when a new or renewed lease is entered into on the Days Bay rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with all of the Healthy Homes Standards inside of the period of time expected can lead to an amount of $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t incorporated within an updated, renewed, or amended tenancy agreement there may be additional penalties or an infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager does not provide the required information within 21 days of being informed of the request, they may receive an infringement notice and be fined upto $750.

In addition, there’s also a fine of up to $900 for landlords or property managers that provide false or misleading Healthy Homes Statement of Compliance or information. The person responsible for this fine is the one who is listed on the tenancy agreement as the one who is letting the property out and it could be the name of the landlord or the property management company.

All information in the Statement of Compliance requirements to be correct when the tenancy agreement is signed. It is updated throughout the duration of the tenancy when any relevant work gets completed.

It is also crucial to remember that a landlord who have multiple rental properties could face more severe penalties for not complying. The most severe penalties are given only for serious violations. Those who have six or more properties could receive fines of up to $50,000 and as high as $100,000 for hearing claims.

Days Bay Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is required for all Days Bay and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records of their conformance with any Healthy Homes Standard that apply or will be in force during the tenancy of your rental home.

From 1 July 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any new, renewed or varied lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All houses rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts can lead to lower temperatures in homes. A damp house is more expensive to heat, which means wasting energy and resulting in higher bills.

If a draught could be noticed from gaps that are not adequate or holes, it needs to be sealed.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or the air is clear from a gap or hole and you are able to feel it, it’s likely a crack or an opening that requirements sealing in some way. Large cracks and gaps should be stopped permanently. The gaps that exceed 3mm that allow air in or out of your house require the sealing. For instance, if an open fireplace isn’t used it can cause draughts and should be sealed from. Property managers and landlords are responsible for making sure that draughts from the fireplace are removed in the maximum extent imaginable.

You don’t need to cover up gaps or holes which are part of the construction. For instance, small gaps around windows and doors might be necessary to allow for movement within the building as the house is heated and cools in order to let them be opened and closed rather than securing. Heating Days Bay

Days Bay rental properties need to have a stable heating source that can heat the largest or main living area to at minimum 18 degrees Celsius, even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health as well as their mental health.

If the main living room already has a fixed heating source such as an air conditioner, it may require a top up to be able to meet the standards. Certain types of heaters cannot be utilised to meet the quality as they are either costly, not cost-effective to run, and/or unsafe to run.
