Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed tenancy is signed on a Days Bay rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

The person liable for this fine is the person who is named on the lease agreement as the one who is renting the property, so it could be the landlord’s name or the company that manages the property.

All information in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is signed. It must be updated throughout the tenancy as any related work is completed.

It is crucial to note that landlords who have multiple rental properties may face more severe penalties for not complying. The highest penalties are reserved for the most serious breaches. Landlords with six or more properties can be fined as high as $50,000 and as high as $100,000 in hearing claims.

When will I need to be in compliance with my Healthy Homes Standards?

Days Bay Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory throughout Days Bay and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords must keep records of their the compliance with any Healthy Homes Standards that apply or will be in force to their rental properties.

From 1 July 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenancy.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.
