Fines for Failing to Comply
As of 1st July 2021, if a new, renewed or varied tenancy is signed for a Crofton Downs rental property, all Healthy Homes compliance work have to be done by the end of 90 days.
Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed on a Crofton Downs rental property, all Healthy Homes compliance work must be completed by the end of 90 days.
Failure to comply with any of the Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy agreement it could result in an additional fine or violation fee.
Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or the property manager doesn’t supply the information requested within 21 days of being informed of the request, they can be issued an infringement notice and be fined as high as $750.
Furthermore, there’s an additional fine of as much as $900 for property owners or property managers that provide false or incorrect Healthy Homes Compliance Statement or information. The person who is liable for this fine is the one who is named on the lease contract as the person leasing the property out, so it could be the landlord’s name or the property management company.
All the information on the Compliance Statement requirements to be accurate before the tenancy agreement can be executed, and it must be updated throughout the tenancy as any related work is completed.
It’s also important to remember that a landlord who own several rental properties can face additional fines for non-compliance. The highest penalties are given for the most serious breaches. Landlords with more than six properties could be fined up to $50,000, and even as high as $100,000 for hearing claims.
