Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed tenancy is signed for a Crofton Downs rental property, all Healthy Homes compliance tasks have to be done inside of 90 days.

The information contained in the Statement of Compliance needs to be current when the tenancy contract is completed, and should be maintained throughout the duration of the tenancy when any related work is completed.

It is crucial to remember that landlords who manage several rental properties can face greater penalties for non-compliance. The highest penalties are handed down for the most serious violations. Those who have more than six properties could be penalised up to $50,000, and even as high as $100,000 for hearing claims.

Crofton Downs Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is required throughout Crofton Downs and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included with any renewed, new or amended tenancy agreement.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of when the tenancy first began.
