Fines for Failing to Comply

It is also important to keep in mind that a landlord who manage multiple rental properties may face more severe penalties for not complying. The harshest penalties are handed down for serious breaches, and landlords with more than six properties could be fined up to $50,000, or as high as $100,000 in hearings.

Crofton Downs Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is required throughout Crofton Downs and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the conformance to each Healthy Homes Standards that apply or will be in force throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties conform according to Healthy Homes Standard within 90 days of a new, renewed or varied tenant.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

If the living area already has a central heating source like a heat pump, then it might require an update to meet the standards. Some types of heaters can’t be used to meet the standard as they are either expensive, inefficient and/or unhealthy to run.

Ventilation Crofton Downs
