Fines for Failing to Comply
Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Crofton Downs rental property, all Healthy Homes compliance work need to be done within 90 days.
Since the 1st July of 2021, when a brand new, renewed or varied lease is entered into on the Crofton Downs rental property, all Healthy Homes compliance work must be completed inside of 90 days.
Failure to comply with all of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included in the renewal, new or amended tenancy agreement there may be an additional fine or infringement fee.
Anyone can request information regarding the Healthy Homes Standard and how they relate to the property they are living in. If the property manager does not provide the information requested within 21 days of having received the inquiry, they can be issued an infringement notice and could be fined up to $750.
In addition, there’s also a fine of as much as $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or other information. The person who is liable for this fine is the person who is identified on the tenancy agreement as being the person renting the property and it could be the landlord’s name or the company that manages the property.
All information in the Statement of Compliance requirements to be current when the tenancy agreement is signed, and ideally it is updated throughout the duration of the tenancy when any necessary work related to it is finished.
It is also important to remember that landlords who manage multiple rental properties could face more severe penalties for not complying. The most severe penalties are given only for serious violations, and landlords who own six or more properties could be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.
