Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Crofton Downs rental property, all Healthy Homes compliance work need to be done within 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied lease is entered into on the Crofton Downs rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to comply with all of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included in the renewal, new or amended tenancy agreement there may be an additional fine or infringement fee.

All information in the Statement of Compliance requirements to be current when the tenancy agreement is signed, and ideally it is updated throughout the duration of the tenancy when any necessary work related to it is finished.

It is also important to remember that landlords who manage multiple rental properties could face more severe penalties for not complying. The most severe penalties are given only for serious violations, and landlords who own six or more properties could be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

Crofton Downs Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement throughout Crofton Downs and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records of their the compliance with each Healthy Homes Standard that apply or will be applicable during the tenancy of the rental property.

From July 1st 2021

  • Private landlords and property managers are required to make sure their rental properties conform to the Healthy Homes Standard within 90 days of any new, renewed or varied tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts increase the likelihood of low temperatures inside homes. A draughty house costs more to heat, meaning wasting money and energy.

If a draught could be noticed from gaps that are not adequate or holes that it needs to be closed.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or a clear draught out of a hole or gap that is, it’s likely to be a gap or an opening that requirements sealing in somehow. Cracks or gaps with large gaps must be stopped permanently. Any gaps greater than 3mm that allow air to enter or exit into the home require seals. For example, if the open fireplace is not in use, it could cause draughts, and should be shut from. Landlords and property managers are responsible for making sure that such draughts are squelched in the maximum extent imaginable.

There is no need to block off holes or gaps in the construction. For example, tiny gaps around doors and windows could be required to allow movement of the structure when the house gets warmer and cooler, so that they can still be closed and opened rather than being stuck. Adequate heaters are important to ensure well-being houses

Heating Crofton Downs

Crofton Downs rental properties should have a permanent heating source that can warm the principal or the biggest living area to at minimum 18 degrees Celsius, even on the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heating requirements to be fixed (i.e., not portable) and at minimum 1.5 horsepower in capacity, and must meet the minimum heating capacity needed in the living area. A Heating Assessment Tool may be used to determine whether the existing fix heater(s) are adequate or if you’ll need to "top up" by adding a second heater. Open fires and unflued combustion heaters, such as the portable LPG bottle heaters aren’t considered acceptable heating options in the Healthy Homes Standard.

If the heating system you provide is an electric heater (or heat pump), it should be equipped with a thermostat. This will make your heating more consistent and efficient. For most properties, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in some cases such as small apartments, a smaller fixed electric heater may be sufficient.

If your main living space already has a central heating source, such as the heat pump, it might just require a top up to ensure it meets the requirements. Certain kinds of heaters cannot be utilised to meet the standard as they are either expensive, inefficient or are unsafe to operate.

Ventilation Crofton Downs
