Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed on a Churton Park rental property, all Healthy Homes compliance tasks have to be taken care of by the end of 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied lease is entered into on a Churton Park rental property, all Healthy Homes compliance work must be finished within 90 days.

The person responsible for this fine is whoever is listed on the tenancy agreement as the person who is leasing the property out, so it could be the name of the landlord as well as the property management company.

All information in the Statement of Compliance requirements to be up-to-date at the time that the tenancy agreement is signed. It should be kept updated throughout the tenancy as any associated work has been completed.

It is important to remember that a landlord who own multiple rental properties may face additional fines for non-compliance. The harshest penalties are handed down only for serious breaches. Landlords with six or more properties could be fined as high as $50,000, and even as high as $100,000 in hearings.

Tenancies that were signed between 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is a requirement to all Churton Park and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included in any renewed, new or amended tenancy agreement.

  • All rentals houses must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.
