Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed contract is signed on a Churton Park rental property, all Healthy Homes compliance items need to be done within 90 days.

Churton Park Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 June 2021

  • Underfloor and ceiling insulation is required in all Churton Park and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the compliance with any Healthy Homes Standard that apply or will apply during the tenancy of an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords should make sure their rental properties comply to the Healthy Homes Standards within 90 days of any renewal, new or a change in Tenancy.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All homes which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

Churton Park rental properties must have a fixed source of heat that is able to heat the largest or main living space to at least 18 degrees Celsius, even on the winter coldest days. For most homes, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. However, in some cases like small apartments the smaller fixed electric heater may be sufficient.

If the living area already has a central heating source like heat pumps, it could need a top up to be able to meet the standards. Certain types of heaters cannot be used to achieve the quality as they are either inefficient, unaffordable to operate or unsafe to operate.
