Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Churton Park rental property, all Healthy Homes compliance tasks must be taken care of inside of 90 days.

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Churton Park rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to comply with all of the Healthy Homes Standards inside of the deadlines can result in an amount of $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy contract, there may be an additional fine or violation fee.

The person who is liable for this fine is the one who is named on the lease agreement as the one who is renting the property which could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance needs to be up-to-date before the tenancy agreement can be completed, and must be updated throughout the tenancy as any associated work has been completed.

It is also important to keep in mind that a landlord who have multiple rental properties may face more severe penalties for not complying. The harshest penalties are handed down for serious breaches. Landlords with at least six rental properties could be penalised up to $50,000, and as much as $100,000 for hearing claims.

Churton Park Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 June 2021

  • Underfloor and ceiling insulation is a requirement to all Churton Park and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records that prove the compliance with the Healthy Homes Standard that apply or will be applied to an apartment rental.

From 1 July 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

What are the most unreasonable gaps or holes?

Heating Churton Park

Churton Park rental properties need to have a stable source of heat which can warm the living space to a minimum of 18degC, even on the most coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat requirements to be fixed (i.e., not portable) and at least 1.5 Kilowatts in heating capacity, and it must have the minimum requirement for heat capacity in the living area. If your main living space already has a permanent heating source, such as the heat pump, it might require an update in order to comply with the standards. Certain types of heaters cannot be used to comply with the standard because they’re inefficient, unaffordable to operate and/or unsafe to run.
