Fines for Failing to Comply
As of 1st July 2021, when a brand new or renewed tenancy is signed for a Cannons Creek rental property, all Healthy Homes compliance tasks need to be completed by the end of 90 days.
From the 1st of July in 2021, when a brand new, renewed or varied lease is entered into on a Cannons Creek rental property, all Healthy Homes compliance work must be finished inside of 90 days.
Failure to meet all of the Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement there could be an additional penalty or infringement fee.
Any tenant may request details about the Healthy Homes Standard and how they relate to the property they are living in. If the property manager is unable to provide the information requested within 21 days of receiving the request, they may receive an infringement letter and could be fined up to $750.
Additionally, there is also a penalty up to $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is whoever is listed on the tenancy agreement as being the person letting the property out and it could be the landlord’s name or the company that manages the property.
All information in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is signed. It should be kept updated throughout the duration of the tenancy when any associated work has been completed.
It’s important to note that landlords who manage multiple rental properties may face greater penalties for non-compliance. The most severe penalties are handed down for severe violations, and landlords who own six or more properties could be fined up to $50,000 and as high as $100,000 in hearings.
