Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed on a Cannons Creek rental property, all Healthy Homes compliance items need to be done by the end of 90 days.

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed on a Cannons Creek rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with one of the Healthy Homes Standards within the deadlines can result in penalties of up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager fails to supply the necessary information within 21 days from receiving the request, they will be issued an infringement notice and be fined up to $750.

Additionally, there is also a penalty of approximately $900 for property owners or property managers who provide a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the one who is named on the lease agreement as the person who is letting the property out, so it could be the name of the landlord as well as the property management company.

All information in the Compliance Statement requirements to be accurate before the tenancy agreement can be signed. It is updated during the entire tenancy, as associated work has been completed.

It’s also important to keep in mind that landlords who manage multiple rental properties may face even higher fines for non-compliance. The harshest penalties are reserved only for serious breaches. Landlords with six or more properties can be penalised up to $50,000 and as high as $100,000 in hearings.

Clearly, failure to meet the Healthy Homes requirements can hit your pocket resulting in large fines in addition to having to continue to comply. Do not risk your rental property, contact us today and ask us to conduct a home assessment performed on the rental property you are renting.

Healthy homes are important

What is the reason Healthy Homes Compliance so important?

Unreasonable Gaps & Holes

Draught Stopping Cannons Creek

Draughts are a major cause of less temperature in households. A damp home costs more to heat, resulting in wasted energy and increased bills.

If a draught can be noticed from gaps that are not adequate or holes or holes, it needs to be closed.

What are the most unreasonable gaps or holes?

If you are able to feel external air getting in, or see the sound of a clear draught emanating out of a hole or gap or crack, then it is likely a crack or hole that needs sealing in some way. Large gaps and cracks should be permanently stopped. Cracks that are greater than 3mm and let air in or out from the house require seals. In the case of an open fireplace isn’t being used, it could cause draughts, and should be sealed from. Landlords and property managers are responsible for ensuring that such draughts are squelched as much as imaginable.

There is no need to block up intentional holes or gaps which are part of the construction. For example, tiny gaps around windows and doors may be required to allow for the movement of the structure when the home is heated and cools in order to let them be closed and opened instead of than securing. We will check all doors and windows in the Healthy Homes assessment of your rental property.

A good heating system is important for well-being homes

Heating Cannons Creek

Cannons Creek rental properties need to have a stable heating source that is able to heat the largest or main living room to at least 18degC even on the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating needs to be fixed (i.e., not portable) with at minimum 1.5 horsepower in capacity, and it must have the minimum requirement for heat capacity for the main living space. A Heating Assessment Tool may be used to determine if the existing permanent heater(s) are sufficient or if you’ll require to "top up" with an additional heater. Open fires and unflued combustion heaters like portable LPG bottle heaters aren’t considered to be suitable heating options under The Healthy Homes Standard.

If the heating that you offer is electric heating or heat pump, it must be equipped with an thermostat. This will make the heating more consistent and effective. For most houses, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters will be required. In certain situations, such as small apartments, a smaller fixed electric heater may suffice.

If your living space already has a permanent heating source, such as a heat pump, then it could need an update to meet the standards. Some types of heaters can’t be utilised to meet the quality as they are either expensive, inefficient or unsafe to operate.

Ventilation Cannons Creek

Each liveable space in a rental property must have at least one openable window or exterior door to offer natural airflow. In addition, high moisture spaces like kitchens and bathrooms should be equipped with an externally vented extractor fan that can get rid of moisture.

A ventilation quality is all about recognising the fact that dry air is much easier to heat and heat, and the property that is properly ventilated is less likely to develop damp and mould.

Living rooms, bedrooms, dining rooms, and kitchens are considered liveable areas. Connecting spaces such as the hallways are not living spaces and therefore don’t require an opening window or door.

Each window, door or the skylight requirements to have the ability open to the outside and remain fixed in an open position in order to allow to circulate fresh air as well as air flow.

All kitchens and bathrooms, and any other area in your home that has a bath, shower and cooktop or another moisture generating item will require suitable extractor fans which are vented towards the outside. The Healthy Homes Assessment service will make sure there is sufficient ventilation in each livable space and will also check for the proper extractor fans for areas that are high in moisture.

Insulation Cannons Creek

Insulation for underfloor and ceilings is mandatory in all rental homes since 1 July 2019. Property managers and landlords must ensure the insulation meets standards that are in line with the latest standard. In some instances, existing ceiling insulation or insulation in the subfloor space may need to be replaced or replaced.

A well-insulated property can reduce condensation, and decrease the risk of mould and damp, as well as making more easy to the house to retain the heat.

Insulation needs to meet the R-values required for your area

The "R" signifies thermal resistance and is a measure of how well the insulation withstands heat flow. The more R-value is higher, the more effective the insulation.

  • Zone 1 - Auckland & Northland Ceiling R 2.9, underfloor R 1.3
  • Zone 2 – the rest of North Island except Taupo and the Central Plateau – ceiling R 2.9 and floor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 and underfloor R 1.3

Cannons Creek Moisture Ingress & Drainage

Keeping your rental property safe from moisture isn’t just about the interior of the building It’s about having to ensure there is somewhere to allow surface, rain or ground water, and stop it from coming into the building. When it is damp and moisture, it is frequently not apparent that it could become a major issue, causing the property to suffer and harming the tenant’s health.

Properties that are rented must have efficient drainage to get rid of storm water, surface water, and ground water, which includes an appropriate runoff or outfall. Making sure the water is able to go, and also that it isn’t allowed to remain beneath buildings is an essential part of keeping your property dry.

In addition to an irrigation system to stop moisture ingress, if your property has an enclosed space between your flooring and the soil, a ground-water barrier should be put in place if it is reasonably practicable to do so.

The ground-moisture barrier typically made of polythene and is laid on top of the ground to stop any moisture present in the ground from entering the home. It also helps to prevent any damage to your underfloor insulation.
