Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on a Camborne rental property, all Healthy Homes compliance work have to be taken care of by the end of 90 days.

Beginning on July 1st, 2021, once a new, renewed or varied contract is signed on the Camborne rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

The person who is responsible to pay this fine is the one who is identified on the tenancy agreement as the person who is letting the property out which could be the name of the landlord, or the company that manages the property.

The information contained in the Compliance Statement requirements to be correct at the time that the tenancy agreement is completed, and is updated during the entire tenancy, as related work is completed.

It is also important to keep in mind that landlords who have multiple rental properties may receive greater penalties for non-compliance. The highest penalties are given for severe breaches. Landlords with six or more properties can receive fines of up to $50,000, or as high as $100,000 for hearing claims.

Tenancies signed from 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is required throughout Camborne and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove the conformance to any Healthy Homes Standards that apply or will be in force to your rental home.

Starting 1 July 2021

Cracks and gaps that are large should be stopped permanently. The gaps that exceed 3mm that allow air in or out within the house require to be sealed. For example, if the open fireplace is not in use, it can create draughts. This should be sealed from. Property managers and landlords are accountable for ensuring that draughts from the fireplace are removed whenever possible.

There is no need to block off holes or gaps which are part of the building. For instance, small gaps around windows and doors could be required to allow for movement within the structure as the house heats and cools, so that they can still be shut and opened, rather than securing. Proper heating is important for healthy homes

Heating Camborne

Camborne rental properties should have a permanent source of heating that is able to heat the largest or main living room to at least 18degC, even during the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating needs to be fixed (i.e., not portable), at minimum 1.5 Kilowatts in heating capacity, and meet the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool could be used to check if the installed heater(s) are sufficient or if you’ll need to "top-up" with an additional heater. Fires that are open and unflued heaters like mobile LPG bottle heaters aren’t considered to be suitable heating options under the Healthy Homes Standard.

If the heating that you offer is electric heating or heat pump it requirements to include an thermostat. This makes the heating more consistent and efficient. For most properties, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. However, in some cases like apartments with small spaces the smaller fixed electric heater may be sufficient.

If the main living room already has a fixed heating source like heat pumps, it could need an update in order to comply with the standards. Certain kinds of heaters aren’t able to be used to comply with the standard as they are either not efficient, cost prohibitive to operate and/or unhealthy to run.

Ventilation Camborne
