Beginning on July 1st, 2021, when a new or renewed Tenancy is signed for the Camborne rental property, all Healthy Homes compliance work must be finished by the end of 90 days.
Failure to adhere to one of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not included within a new, renewed or amended tenancy agreement there could be an additional fine or infringement fee.
Anyone can request details about the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager is unable to provide the required information within 21 days of getting the notice, the tenant can be issued an infringement notice and be fined as high as $750.
In addition, there is also a penalty approximately $900 for landlords and property managers who offer a false or inaccurate Healthy Homes Compliance Statement or other information. The person who is liable to pay this fine is the one who is named on the tenancy contract as the person who is letting the property, so it could be the landlord’s name or the company that manages the property.
The information contained in the Compliance Statement requirements to be up-to-date when the tenancy contract is signed. It should be kept updated during the entire tenancy, as associated work has been completed.
It is also important to remember that landlords who have several rental properties can face greater penalties for non-compliance. The harshest penalties are given for severe breaches, and landlords with more than six properties could be fined as high as $50,000, and even as high as $100,000 in hearing claims.
In the end, a failure to adhere to your Healthy Homes requirements can hit your bank account hard, resulting in large fines in addition to still being required to adhere to the regulations.
