Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed for a Broadmeadows rental property, all Healthy Homes compliance tasks have to be finished by the end of 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on the Broadmeadows rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Broadmeadows Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory to all Broadmeadows and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or altered tenancy contract.

Large cracks and gaps should be fixed permanently. Any gaps greater than 3mm that let air in or out of the home need to be sealed. For example, if the open fireplace isn’t being used, it may cause draughts and should be blocked from. You don’t need to block up intentional gaps or holes in the construction. For example, tiny gaps around windows and doors could be required to allow movement of the structure when the home is heated and cools so that they can still be closed and opened rather than being stuck. Heating Broadmeadows

Broadmeadows rental properties require a reliable heating source that can heat the largest or main living room to at least 18 degrees Celsius, even on the coldest winter days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental outlook.

The source of heat requirements for it to be permanent (i.e., not portable) that is, at minimum 1.5 horsepower in capacity, and it must have the minimum heating capacity needed in the living area. A Heating Assessment Tool could be used to determine if your current permanent heater(s) are adequate or if you’ll need to "top up" with a new heater. Open fires and unflued combustion heaters such as the portable LPG bottle heaters are not considered to be safe heating options under the Healthy Homes Standard.

If the heating that you offer is electric heating or heat pump, it should have an thermostat. This will make the heating more reliable and effective. For the majority of homes, bigger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. All landlords and property managers should make sure the insulation meets standards that are in line with the latest standard.
