Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords now have to make sure their Broadmeadows rental properties meet the minimum Healthy Homes Standards within 90 days of any renewal or new tenancy and all private rental properties are required to be completely conforming by the 1st July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed for a Broadmeadows rental property, all Healthy Homes compliance work must be finished within 90 days.

From the 1st of July in 2021, when a new, renewed or varied lease is entered into on a Broadmeadows rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to adhere to each of Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Additionally, if a existing Healthy Homes Statement of Compliance isn’t included within the new, renewed or revised tenancy agreement there could be additional penalties or an infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or the property manager doesn’t supply the necessary information within 21 days of having received the inquiry, they may receive an infringement notice and be fined up to $750.

In addition, there’s also a penalty up to $900 for landlords or property managers who have provided a false or misleading Healthy Homes Compliance Statement or information. The person liable for this fine is the person who is named on the lease agreement as being the person renting the property, so it could be the name of the landlord or the property management company.

The information contained in the Compliance Statement needs to be accurate when the tenancy contract is executed, and it must be updated during the entire tenancy, as necessary work related to it’s finished.

It is also important to keep in mind that landlords who have several rental properties can face additional fines for non-compliance. The harshest penalties are reserved for serious breaches. Landlords with more than six properties could be penalised up to $50,000, or as high as $100,000 in hearings.

Broadmeadows Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement in all Broadmeadows and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or varied tenancy agreement.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Rental properties in Broadmeadows require a reliable source of heating that is able to heat the principal or the biggest living room to at least 18degC even on the coldest winter days.
