Fines for Failing to Comply

As of 1st July 2021, when a new or renewed contract is signed on a Broadmeadows rental property, all Healthy Homes compliance items need to be completed inside of 90 days.

Since the 1st July of 2021, when a new or renewed tenancy is signed on a Broadmeadows rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to meet each of Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included within a new, renewed or amended tenancy agreement there may be additional penalties or an infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the home they live in. If the property manager does not provide the required information within 21 days of being informed of the request, they may receive an infringement letter and be fined upto $750.

In addition, there’s also a penalty approximately $900 for landlords and property managers providing a false or incorrect Healthy Homes Statement of Compliance or any other information. The person liable to pay this fine is the one who is named on the lease agreement as the one who is renting the property and it could be the name of the landlord as well as the property management company.

All the information on the Statement of Compliance needs to be current when the tenancy agreement is executed, and it is updated through the tenancy period as related work is completed.

It is crucial to remember that a landlord with multiple rental properties may face more severe penalties for not complying. The harshest penalties are handed down for serious breaches. Landlords with six or more properties can be fined as high as $50,000, and even as high as $100,000 in the case of hearing claims.

Tenancies commenced between 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is required in all Broadmeadows and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove the compliance with the Healthy Homes Standards that apply or will apply during the tenure of an apartment rental.

Beginning 1 July 2021

  • Private landlords and property managers should make sure their rental properties conform according to Healthy Homes Standard within 90 days of a new, renewed , or altered lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.
