Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Broadmeadows rental property, all Healthy Homes compliance items need to be completed inside of 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied contract is signed on the Broadmeadows rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the anticipated timeframe could result in the possibility of a fine up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or amended tenancy agreement it could result in an additional fine or infringement fee.

It’s crucial to keep in mind that a landlord who own multiple rental properties could face greater penalties for non-compliance. The harshest penalties are handed down only for serious violations. Those who have six or more properties can be fined up to $50,000, and as much as $100,000 in hearings.

Tenancies that were signed from 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory in all Broadmeadows and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records that prove the conformance to all Healthy Homes Standards that apply or will be applicable during the tenancy of their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords must ensure their rental properties conform according to Healthy Homes Standards within 90 days of a new, renewed or varied Tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All homes rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Draughts may lead to lower temperatures in households. A humid house will cost more to heat, meaning wasting energy and increased bills.

If a draught can be perceived as a result of gaps or holes, it needs to be closed.

What are unreasonable gaps and holes?

If you can feel external air flowing in or the sound of a clear draught emanating from a hole or gap and you are able to feel it, it’s likely a crack or crack that requirements sealing in somehow. Cracks or gaps with large gaps must be permanently stopped. Any gaps greater than 3mm that let air in or out from your home need the sealing. For example, if an open fireplace isn’t being used, it could cause draughts, and should be sealed from. Landlords and property managers are responsible for making sure that draughts from the fireplace are removed as far as possible.

You don’t need to block up intentional holes or gaps that are part of the building. For instance, small gaps around windows and doors could be required to allow for movement within the building when the home gets warmer and cooler, so that they are able to be closed and opened instead of instead of being stuck. Heating Broadmeadows

Broadmeadows rental properties need to have a stable source of heat which can warm the largest or main living space to at least 18 degrees Celsius, even on the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating needs that it be permanently fixed (i.e., not portable) and at least 1.5 kW in heating capacity, and must meet the minimum heating capacity needed in the living area. A Heating Assessment Tool can be used to determine whether the existing fixed heater(s) are sufficient or whether you will require to top up with a new heater. Unflued combustion and open fire heaters such as small portable LPG bottle heaters aren’t considered acceptable heating options in those following the Healthy Homes Standard.

If the heating that you offer is an electric heater or heat pump it must have a thermostat. This makes the heating more reliable and efficient. In most houses, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are necessary. In some instances, such as small apartments small apartments, a smaller electric fixed heater may suffice.

If your main living space is already equipped with a fixed heating source such as the heat pump, it may require a top up to meet the standards. Some types of heaters can’t be used to meet the standard since they’re either costly, not affordable to run, and/or unsafe to run.

Ventilation Broadmeadows

Every living space of a rental property must include at least one open window or exterior door to offer natural ventilation. In addition, high moisture areas such as kitchens and bathrooms should be equipped with an externally vented extractor to remove moisture.
