Fines for Failing to Comply

Failure to comply with all of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy agreement, there could be an additional fine or infringement fee.
Any tenant can ask for information about the Healthy Homes Standard and how they relate to the building they live in. If the property manager does not provide the required information within 21 days from having received the inquiry, they may receive an infringement letter and be fined up to $750.
Additionally, there is also a penalty of approximately $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is liable to pay this fine is the one who is named on the tenancy agreement as the one who is letting the property out which could be the name of the landlord or the property management company.
All information in the Statement of Compliance requirements to be accurate at the time that the tenancy agreement is signed, and ideally it should be maintained during the entire tenancy, as associated work has been completed.
It’s also crucial to note that a landlord who have multiple rental properties could face even higher fines for non-compliance. The highest penalties are reserved for serious breaches. Landlords with at least six rental properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.
