Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on a Breaker Bay rental property, all Healthy Homes compliance tasks must be done inside of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied Tenancy is signed for the Breaker Bay rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with any of the Healthy Homes Standards inside of the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance isn’t included within the renewal, new or amended tenancy agreement it could result in an additional penalty or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the home they are living in. If the property manager fails to provide the required information within 21 days from being informed of the request, they can receive an infringement notification and be fined upto $750.

In addition, there is an additional fine of approximately $900 for landlords or property managers providing a false or incorrect Healthy Homes Compliance Statement or information. The person who is liable for this fine is the person who is listed on the tenancy agreement as the one who is who is letting the property It could also be the name of the landlord, or the company that manages the property.

All information in the Compliance Statement requirements to be current before the tenancy agreement can be signed, and ideally it is updated throughout the tenancy as any necessary work related to it’s finished.

It’s crucial to note that a landlord who own multiple rental properties may face additional fines for non-compliance. The highest penalties are reserved for severe violations, and landlords who own six or more properties can be fined up to $50,000, or as high as $100,000 in hearing claims.

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement for all Breaker Bay and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.

  • All rental homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.
