Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for a Breaker Bay rental property, all Healthy Homes compliance work have to be completed by the end of 90 days.

Since the 1st July of 2021, if a new or renewed lease is entered into on the Breaker Bay rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to adhere to any of the Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or revised tenancy contract, there could be an additional fine or infringement fee.

If the property manager does not supply the necessary information within 21 days of having received the inquiry, they will be issued an infringement notice and be fined upto $750.

It is important to note that a landlord with multiple rental properties may receive greater penalties for non-compliance. The most severe penalties are given for severe violations. Those who have six or more properties can be fined up to $50,000, or as high as $100,000 for hearing claims.

Tenancies commenced between 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is required in all Breaker Bay and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords are required to keep records that prove conformance with all Healthy Homes Standard that apply or will apply during the tenancy of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers should make sure their rental properties comply according to Healthy Homes Standards within 90 days of any renewal, new or a change in Tenancy.

Heating Breaker Bay

Rental properties in Breaker Bay should have a permanent source of heat which can warm the principal or the biggest living area to at minimum 18 degrees Celsius, even on the coldest winter days.
