Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed for a Breaker Bay rental property, all Healthy Homes compliance tasks must be finished inside of 90 days.

From the 1st of July in 2021, if a new, renewed or varied contract is signed on a Breaker Bay rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to meet one of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy contract, there could be additional penalties or an infringement fee.

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is required for all Breaker Bay and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records of their conformance with all Healthy Homes Standard that apply or will apply to the rental property.

Starting 1 July 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts increase the likelihood of low temperatures inside households. A humid home costs more to heat, meaning wasting energy and increased bills.

For instance, if an open fireplace isn’t in use it can cause draughts and should be sealed off. Heating Breaker Bay

Breaker Bay rental properties require a reliable heating source which can warm the principal or the biggest living area to at minimum 18degC, even on the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heating requirements that it be permanently fixed (i.e., not portable) with at least 1.5 kW of heating capacity, and must meet the minimum required heating capacity in the living area. A Heating Assessment Tool can be used to determine whether the installed heater(s) are adequate or if you’ll require to ‘top up’ by adding a second heater. Open fires and unflued combustion heaters like the portable LPG bottle heaters are not considered to be suitable heating options in those following the Healthy Homes Standard.

If the heating system you offer is electric heating (or heat pump), it should include an thermostat. This will make your heating more consistent and efficient. For the majority of houses, bigger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. In some instances, such as small apartments, a smaller fixed electric heater might be enough.

Underfloor and ceiling insulation is mandatory to all rental houses from 1 July 2019. All landlords and property managers have to ensure that the insulation is in line with standards that are in line with the latest standard.
