Fines for Failing to Comply
Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance items need to be completed inside of 90 days.
Since the 1st July of 2021, if a new or renewed lease is entered into on the Breaker Bay rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.
Failure to meet any of the Healthy Homes Standards inside of the deadlines can result in the possibility of a fine up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or revised tenancy agreement, there could be an additional fine or infringement fee.
Every tenant is entitled to request details about the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager is unable to supply the required information within 21 days of having received the inquiry, they will receive an infringement notice and be fined upto $750.
In addition, there’s an additional fine of up to $900 for landlords or property managers that provide false or misleading Healthy Homes Statement of Compliance or any other information. The person who is liable to pay this fine is the one who is named on the lease agreement as being the person leasing the property out It could also be the name of the landlord or the company that manages the property.
All the information on the Compliance Statement requirements to be current at the time that the tenancy agreement is completed, and should be kept updated through the tenancy period as necessary work related to it’s finished.
It’s also crucial to note that a landlord who own several rental properties can face greater penalties for non-compliance. The most severe penalties are reserved for serious breaches, and landlords with at least six rental properties could be penalised up to $50,000 and as high as $100,000 in hearing claims.
