Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance tasks need to be completed by the end of 90 days.

Since the 1st July of 2021, if a new, renewed or varied contract is signed on the Breaker Bay rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to comply with any of the Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy agreement there could be an additional fine or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they are related to the house they are living in. If the the property manager doesn’t supply the information requested within 21 days from being informed of the request, they could be issued an infringement notice and could be fined up to $750.

In addition, there is an additional fine of up to $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is whoever is named on the tenancy agreement as the person who is renting the property which could be the name of the landlord as well as the property management company.

All information in the Statement of Compliance requirements to be correct at the time that the tenancy agreement is executed, and it is updated throughout the tenancy as any related work is completed.

It is also important to remember that landlords who manage multiple rental properties could face additional fines for non-compliance. The most severe penalties are handed down only for serious violations. Breaker Bay Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory for all Breaker Bay and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records that prove conformance with all Healthy Homes Standard that apply or will be applied during the tenure of an apartment rental.

From 1 July 2021

  • Private landlords and property managers must ensure their rental properties conform with the Healthy Homes Standard within 90 days of any new, renewed or varied lease.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All households rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.
