Did you be aware that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords are now required to make sure their Breaker Bay rental properties meet the minimum Healthy Homes Standards within 90 days of any new or renewed tenancy, and all private rental properties must be completely conforming by the 1st July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied contract is signed on a Breaker Bay rental property, all Healthy Homes compliance tasks must be done inside of 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on the Breaker Bay rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to comply with all of the Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included in the renewal, new or amended tenancy agreement it could result in an additional fine or infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the home they are living in. If the property manager is unable to provide the required information within 21 days of receiving the request, they can receive an infringement notice and could be fined up to $750.

Furthermore, there’s an additional fine of as much as $900 for landlords or property managers who have provided a false or false Healthy Homes Compliance Statement or any other information. The person liable to pay this fine is the one who is named on the tenancy agreement as being the person who is letting the property which could be the name of the landlord or the company that manages the property.

The information contained in the Statement of Compliance requirements to be correct at the time that the tenancy agreement is completed, and is updated throughout the duration of the tenancy when any related work is completed.

It’s also crucial to remember that a landlord who manage several rental properties can face additional fines for non-compliance. The harshest penalties are given for serious breaches, and landlords with more than six properties could be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

What time do I need to meet The Healthy Homes Standards?

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory to all Breaker Bay and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that prove the compliance with all Healthy Homes Standards that apply or will be applied to an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform to the Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must meet the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Breaker Bay

Draughts may lead to low temperatures inside houses. A cold house costs more to heat, resulting in wasted energy and increased bills.

If a draft can be felt through gaps that are too large or holes, it needs to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air getting in, or see the sound of a clear draught emanating from a hole or gap, then it is likely to be a gap or hole that needs sealing in some way. Large gaps and cracks should be sealed permanently. The gaps that exceed 3mm that let air in or out within your house require the sealing. For instance, if an open fireplace isn’t used it may cause draughts and must be sealed from. Property managers and landlords are responsible for ensuring such draughts are eliminated whenever possible.

There is no need to block off gaps or holes in the construction. For instance, small gaps around doors and windows could be necessary to allow for movement of the building as the household warms and cools so that they can still be shut and opened, rather than securing. Heating Breaker Bay

Breaker Bay rental properties should have a permanent source of heating which can warm the principal or the biggest living area to at minimum 18degC, even during the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

The heating source needs that it be permanently fixed (i.e. not portable) that is, at least 1.5 Kilowatts in heating capacity, and must meet the minimum requirement for heat capacity in the living area. The Heating Assessment Tool can be used to check if the fix heater(s) are sufficient or whether you will need to "top-up" with an additional heater. Open fires as well as unflued combustion heaters such as mobile LPG bottle heaters aren’t considered to be acceptable heating options in the Healthy Homes Standard.

If the heating you provide is electric heating or heat pump, it should have a thermostat. This will make the heating more uniform and effective. For the majority of houses, bigger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in certain instances such as small apartments small apartments, a smaller electric fixed heater may be sufficient.

Ventilation Breaker Bay

Insulation Breaker Bay

Underfloor and ceiling insulation has been compulsory in all rental houses from 1 July 2019. All landlords and property managers are required to make sure that the insulation meets current standard. In some instances, existing ceiling insulation or insulation in the subfloor space may require to be replaced or replaced.

A properly insulated home will help to control condensation and reduce the chances of mould and damp, as well as making more easy for the house to retain warmth.
