Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance work have to be taken care of by the end of 90 days.

As of 1st July 2021, once a new, renewed or varied contract is signed on the Breaker Bay rental property, all Healthy Homes compliance work must be completed within 90 days.

When do I need to be in compliance with the Healthy Homes Standards?

Tenancies that were signed from 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is required to all Breaker Bay and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove compliance with all Healthy Homes Standards that apply or will be applied during the tenancy of their rental properties.

From 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties comply in accordance with Healthy Homes Standards within 90 days of any newly renewed, extended or changed Tenancy.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All households which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Breaker Bay

Rental properties in Breaker Bay need to have a stable source of heating which can warm the living space to at least 18 degrees Celsius, even on the coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

If the living area already has a permanent heating source like heat pumps, it may require some additional energy in order to comply with the standards. Certain types of heaters cannot be used to meet the standard as they are either inefficient, unaffordable to operate or unsafe to operate.

Ventilation Breaker Bay

Each liveable space in a rental property must contain at minimum one open window or exterior door to provide natural ventilation. In addition, high moisture areas such as kitchens and bathrooms need to have an externally vented extractor to eliminate moisture.

This ventilation standard is all about acknowledging how the dry atmosphere is less difficult to heat and an apartment that is well-ventilated is less likely to grow mould and damp.
