Did you be aware that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords now have to ensure their Breaker Bay rental properties meet the minimum Healthy Homes Standards within 90 days of any renewed or new tenancy and all private rentals are required to be fully certified by 1 July 2024.

Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

As of 1st July 2021, once a new or renewed lease is entered into on a Breaker Bay rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to each of Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy agreement there may be an additional fine or violation fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the building they reside in. If the property manager fails to provide the necessary information within 21 days of getting the notice, the tenant could be issued an infringement notice and be fined upto $750.

In addition, there’s also a fine of up to $900 for landlords and property managers providing a false or misleading Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the person who is named on the tenancy agreement as the person who is leasing the property out which could be the landlord’s name or the property management company.

All the information on the Compliance Statement needs to be current before the tenancy agreement can be signed. It is updated throughout the tenancy as any related work is completed.

It’s important to keep in mind that a landlord who have multiple rental properties may receive even higher fines for non-compliance. The highest penalties are handed down only for serious violations, and landlords who own six or more properties can be fined up to $50,000, and even as high as $100,000 in hearings.

Tenancies commenced from 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is a requirement in all Breaker Bay and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the compliance with all Healthy Homes Standards that apply or will be applied during the tenancy of the rental property.

From July 1st 2021

  • Private landlords and property managers must ensure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of any renewal, new or a change in tenancy.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Draughts are a major cause of dropping temperatures within homes. A humid house costs more to heat, which results in wasting money and energy.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or the air is clear out of a hole or gap, then it is most likely a gap or an opening that needs sealing in the way you can. Cracks or gaps with large gaps must be permanently stopped. Cracks that are greater than 3mm and let air into or out within your house need to be sealed. For example, if an open fireplace is not in use, it could cause draughts, and must be sealed from. A good heating system is crucial for healthy homes

Heating Breaker Bay

Rental properties in Breaker Bay require a reliable heating source that is able to heat the principal or the biggest living room to at least 18degC even on the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating needs to be fixed (i.e. not portable) and at minimum 1.5 kW of heating capacity and have the minimum requirement for heat capacity for the main living room. The Heating Assessment Tool can be used to determine whether the current installed heater(s) are adequate or if you’ll require to "top-up" with an additional heater. Fires that are open and unflued heaters such as portable LPG bottle heaters aren’t considered to be suitable heating options for The Healthy Homes Standard.

If the heating you provide is an electric heater or heat source, then it must include a thermostat. This will help make your heating more consistent and effective. For most properties, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in some cases like small apartment buildings small apartments, a smaller electric fixed heater may suffice.

If your main living space already has a fixed heating source such as heat pumps, it may need some additional energy in order to comply with the standards. Certain kinds of heaters aren’t able to be used to achieve the quality since they’re either costly, not affordable to run, and/or unsafe to run.

Ventilation Breaker Bay
