Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed for a Breaker Bay rental property, all Healthy Homes compliance items have to be completed inside of 90 days.

Since the 1st July of 2021, once a new or renewed contract is signed on the Breaker Bay rental property, all Healthy Homes compliance work must be done within 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the anticipated timeframe could result in an amount of $7200. Breaker Bay Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory throughout Breaker Bay and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate conformance with all Healthy Homes Standards that apply or will apply during the tenure of the rental property.

From 1 July 2021

  • Property managers and private landlords have to ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All houses which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Heating Breaker Bay

Rental properties in Breaker Bay need to have a stable source of heating that can warm the main or largest living area to at minimum 18 degrees Celsius, even on the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source needs to be fixed (i.e., not portable) that is, at least 1.5 Kilowatts in heating capacity, and meet the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool could be used to determine whether the existing permanent heater(s) are adequate or if you’ll require to ‘top up’ with a new heater. Unflued combustion and open fire heaters such as the portable LPG bottle heaters are not considered to be safe heating options for those following the Healthy Homes Standard.

If the heating that you offer is electric heating or heat source, it should be equipped with a thermostat. This makes the heating more reliable and efficient. For most properties, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are required. However, in certain instances like apartments with small spaces small apartments, a smaller electric fixed heater may be sufficient.

If the living area already has a fixed heating source, such as a heat pump, then it may require some additional energy in order to comply with the standards. Certain types of heaters cannot be utilised to meet the quality since they’re either not effective, cost prohibitive to operate and/or unhealthy to run.

Ventilation Breaker Bay

Insulation Breaker Bay

The insulation of the ceiling and underfloor is a requirement to all rental homes since July 1, 2019. Property managers and landlords must ensure that the insulation meets current standard. In some instances, current ceiling insulation, or the insulation of the sub floor space may require to be filled with or replaced.

A well-insulated house will reduce the risk of condensation, and decrease the risk of mould and dampness, as well as making more easy for the house to hold warmth.
