Fines for Failing to Comply

Tenancies established in the period between July 1st 2019 to 30 June 2021

  • Ceiling and underfloor insulation is required throughout Breaker Bay and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove the compliance with all Healthy Homes Standards that apply or will be in force to an apartment rental.

Beginning 1 July 2021

  • Private landlords and property managers should ensure their rental properties conform with the Healthy Homes Standards within 90 days of a renewal, new or a change in tenant.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Heating Breaker Bay

Breaker Bay rental properties need to have a stable source of heat which can warm the largest or main living space to a minimum of 18 degrees Celsius, even on the coldest days of the year.
