Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed for a Breaker Bay rental property, all Healthy Homes compliance items need to be done within 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied Tenancy is signed for the Breaker Bay rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to comply with each of Healthy Homes Standards within the expected timeframe can result in the possibility of a fine up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included in the new, renewed or amended tenancy agreement there may be additional penalties or an infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager fails to provide the information requested within 21 days from being informed of the request, they may receive an infringement notification and could be fined up to $750.

In addition, there’s an additional fine of up to $900 for landlords or property managers who provide a false or false Healthy Homes Statement of Compliance or information. The person liable for this fine is the person who is listed on the tenancy agreement as the one who is letting the property out, so it could be the landlord’s name or the property management company.

All information in the Compliance Statement requirements to be up-to-date before the tenancy agreement can be completed, and is updated through the tenancy period as associated work has been completed.

It’s also important to keep in mind that a landlord who own multiple rental properties could face even higher fines for non-compliance. The highest penalties are given for serious violations. Those who have at least six rental properties could be fined as high as $50,000, and as much as $100,000 in hearing claims.

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory to all Breaker Bay and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the compliance with the Healthy Homes Standards that apply or will apply throughout the tenancy period of the rental property.

Starting 1 July 2021

  • Private landlords and property managers have to make sure their rental properties conform with the Healthy Homes Standards within 90 days of any renewal, new or a change in tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All homes that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

What are unreasonable gaps or holes?

Adequate heaters are crucial for well-being homes

Heating Breaker Bay

Rental properties in Breaker Bay require a reliable source of heating that is able to heat the main or largest living room to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source needs for it to be permanent (i.e., not portable), at least 1.5 horsepower in capacity, and meet the minimum required heating capacity for the main living room. For most houses, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in certain instances like small apartment buildings the smaller fixed electric heater could be enough.

If the main living room already has a central heating source such as heat pumps, it could need some additional energy to meet the standards. Certain types of heaters cannot be used to comply with the standard as they are either expensive, inefficient or are unsafe to operate.

Ventilation Breaker Bay

Every living space of a rental property has to have at least one openable window or exterior door to provide natural ventilation. In addition, humid areas such as kitchens or bathrooms should be equipped with an externally vented extractor to eliminate moisture.

Insulation Breaker Bay

Ceiling and underfloor insulation is required to all rental houses from 1 July 2019. All landlords and property managers have to ensure that the insulation meets standards that are in line with the latest quality. In some instances, current ceiling insulation, or the insulation of the subfloor space might need to be topped up or replaced.
