Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance work have to be completed within 90 days.

From the 1st of July in 2021, when a new or renewed contract is signed on the Breaker Bay rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to adhere to all of the Healthy Homes Standards by the end of the anticipated timeframe could result in the possibility of a fine up to $7200. Breaker Bay Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory throughout Breaker Bay and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records that prove compliance with the Healthy Homes Standard that apply or will be in force during the tenure of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties conform to the Healthy Homes Standard within 90 days of a new, renewed , or altered tenant.

  • All households let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

  • All rental homes must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Adequate heaters are crucial for well-being houses

Heating Breaker Bay

Breaker Bay rental properties should have a permanent source of heating that can heat the living space to at least 18degC, even on the most coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating needs for it to be permanent (i.e., not portable) that is, at minimum 1.5 kW in heating capacity, and must meet the minimum required heating capacity for the main living space. A Heating Assessment Tool can be used to determine if the existing fix heater(s) are adequate or if you’ll need to ‘top up’ with a new heater. Open fires and unflued combustion heaters such as the portable LPG bottle heaters aren’t considered acceptable heating options in the Healthy Homes Standard.

If the heating you provide is electric heating or heat pump, then it must include the thermostat. This will help make your heating more consistent and efficient. For most houses, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In certain situations, like small apartments, a smaller fixed electric heater could be enough.

If your main living space already has a fixed heating source, like the heat pump, it could need a top up in order to comply with the standards. Certain types of heaters cannot be used to achieve the quality because they’re expensive, inefficient and/or unsafe to run.

Ventilation Breaker Bay

Each liveable space in a rental home must have at least one openable door or window to provide natural ventilation. Furthermore, moist areas like kitchens and bathrooms need to have an venting fan outside to remove moisture.

Insulation Breaker Bay

Insulation for underfloor and ceilings is required to all rental houses since 1 July 2019. All landlords and property managers should make sure that the insulation is in line with this new standard.
