Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance work have to be taken care of by the end of 90 days.

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory to all Breaker Bay and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records of their conformance with any Healthy Homes Standards that apply or will be applicable during the tenure of your rental home.

Starting 1 July 2021

  • All rental homes have to meet the Healthy Homes Standard regardless of when the tenancy began.

Heating Breaker Bay

Rental properties in Breaker Bay should have a permanent source of heating which can warm the main or largest living space to at least 18 degrees Celsius, even on the coldest winter days. If your living space already has a fixed heating source like an air conditioner, it could need some additional energy to meet the standards. Certain kinds of heaters cannot be used to achieve the standard since they’re either not efficient, cost prohibitive to operate or unsafe to operate.
