Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance items need to be completed inside of 90 days.

Since the 1st July of 2021, if a new or renewed lease is entered into on the Breaker Bay rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet any of the Healthy Homes Standards inside of the deadlines can result in the possibility of a fine up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or revised tenancy agreement, there could be an additional fine or infringement fee.

If the landlord or property manager is unable to supply the required information within 21 days of having received the inquiry, they will receive an infringement notice and be fined upto $750.

Tenancies that were signed between 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is mandatory in all Breaker Bay and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate compliance with all Healthy Homes Standards that apply or will be applicable to an apartment rental.

From 1 July 2021

  • Property managers and private landlords should ensure their rental properties conform according to Healthy Homes Standard within 90 days of a new, renewed , or altered Tenancy.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must adhere to the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.

For example, if an open fireplace isn’t being used, it can create draughts. This should be shut from. Property managers and landlords are responsible for ensuring that these draughts are stopped as much as possible.

There is no need to cover up holes or gaps in the construction. For example, tiny gaps around windows and doors might be necessary to allow movement of the building when the household gets warmer and cooler, to allow them to be opened and closed rather than securing. Heating Breaker Bay

Breaker Bay rental properties require a reliable source of heat that is able to heat the largest or main living space to a minimum of 18degC, even on the most coldest days of the year.
