Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed for an Aro Valley rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Aro Valley Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement to all Aro Valley and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the conformance to each Healthy Homes Standard that apply or will be applicable to their rental properties.

From 1 July 2021

  • Property managers and private landlords should make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any new, renewed or varied tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must adhere to the Healthy Homes Standard regardless of the date the tenancy was started.

  • All homes rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

  • All rental homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Aro Valley rental properties require a reliable source of heat that can warm the principal or the biggest living space to a minimum of 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat requirements for it to be permanent (i.e. not portable), at minimum 1.5 horsepower in capacity, and meet the minimum requirement for heat capacity to heat the living space in general. A Heating Assessment Tool could be used to determine if the current fixed heater(s) are adequate or whether you will require to "top-up" by adding a second heater. Open fires and unflued combustion heaters such as portable LPG bottle heaters are not considered to be suitable heating options in those following the Healthy Homes Standard.

If the heating system you provide is electric heating (or heat pump), it should include a thermostat. This will make the heating more reliable and effective. For most houses, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. In certain situations, like small apartment buildings small apartments, a smaller electric fixed heater could be enough.

If the main living room already has a central heating source, such as a heat pump, then it could require an upgrade in order to comply with the standards. Certain kinds of heaters aren’t able to be used to achieve the standard as they are either not efficient, cost prohibitive to operate and/or unhealthy to run.
