Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on an Aro Valley rental property, all Healthy Homes compliance items need to be finished inside of 90 days.

Since the 1st July of 2021, when a brand new or renewed contract is signed on the Aro Valley rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Inability to adhere to each of Healthy Homes Standards within the expected timeframe can result in an amount of $7200. Additionally, if a present Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy agreement there could be an additional fine or infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the property they live in. If the property manager is unable to supply the information requested within 21 days of getting the notice, the tenant will receive an infringement letter and be fined as high as $750.

In addition, there is an additional fine of up to $900 for landlords or property managers who have provided a false or false Healthy Homes Statement of Compliance or information. The person responsible for this fine is the person who is listed on the tenancy agreement as the one who is letting the property out which could be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be up-to-date when the tenancy contract is signed. It should be kept updated throughout the duration of the tenancy when any related work is completed.

It is also important to remember that a landlord with several rental properties can face more severe penalties for not complying. The highest penalties are given for the most serious breaches, and landlords with more than six properties could receive fines of up to $50,000, and even as high as $100,000 in hearing claims.

Aro Valley Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory in all Aro Valley and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords must keep records that demonstrate compliance with each Healthy Homes Standards that apply or will apply to the rental property.

From July 1st 2021

  • Property managers and private landlords have to make sure their rental properties comply with the Healthy Homes Standard within 90 days of any new, renewed , or altered tenancy.

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts can lead to lower temperatures in homes. A draughty home is more expensive to heat, meaning wasting money and energy.

If a draught is noticed from gaps that are not adequate or holes or holes, it needs to be sealed.

Heating Aro Valley

Rental properties in Aro Valley must have a fixed source of heating that can heat the main or largest living space to at least 18degC even on the winter coldest days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat requirements to remain fixed (i.e. not portable), at least 1.5 horsepower in capacity, and it must have the minimum requirement for heat capacity for the main living space. A Heating Assessment Tool may be used to determine whether the existing fixed heater(s) are adequate or whether you will need to top up with a new heater. Unflued combustion and open fire heaters like small portable LPG bottle heaters are not considered to be acceptable heating options for The Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump, it requirements to be equipped with an thermostat. This will help make your heating more consistent and efficient. In most homes, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are required. In certain situations, like small apartment buildings, a smaller fixed electric heater may suffice.

If the living area already has a fixed heating source like heat pumps, it could require a top up in order to comply with the standards. Some types of heaters can’t be used to comply with the quality because they’re not effective, cost prohibitive to operate or are unsafe to operate.
