Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed contract is signed on an Aro Valley rental property, all Healthy Homes compliance tasks have to be completed by the end of 90 days.

As of 1st July 2021, when a new or renewed tenancy is signed on the Aro Valley rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or revised tenancy agreement there could be an additional fine or infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager fails to provide the necessary information within 21 days of having received the inquiry, they can receive an infringement notice and be fined upto $750.

Additionally, there is also a fine of up to $900 for landlords or property managers that provide false or misleading Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the person who is identified on the tenancy agreement as the person who is leasing the property out which could be the name of the landlord as well as the company that manages the property.

All information in the Statement of Compliance needs to be up-to-date when the tenancy contract is signed, and ideally it should be maintained throughout the duration of the tenancy when any relevant work gets completed.

It’s also important to remember that a landlord who have several rental properties can face additional fines for non-compliance. The harshest penalties are reserved only for serious breaches. Landlords with more than six properties could be fined up to $50,000 and as high as $100,000 in the case of hearing claims.

When Do I require to be in compliance with requirements of the Healthy Homes Standards?

Aro Valley Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and 30 June 2021

  • Ceiling and underfloor insulation is required to all Aro Valley and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records of their compliance with the Healthy Homes Standards that apply or will apply throughout the tenancy period of your rental home.

From July 1st 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a new, renewed or varied tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts are a major cause of less temperature in households. A draughty home costs more to heat, which means wasting money and energy.

What are unreasonable gaps or holes?

If you can feel external air entering or the air is clear from a crack or a gap and you are able to feel it, it’s probably a gap or hole that requirements sealing in the way you can. Large cracks and gaps should be fixed permanently. Gaps greater than 3mm that allow air to enter or exit from your home need seals. For example, if an open fireplace is not in use, it could cause draughts, and should be sealed from. Heating Aro Valley

Aro Valley rental properties need to have a stable source of heating that is able to heat the living room to at least 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source needs that it be permanently fixed (i.e. not portable) with at minimum 1.5 kW in heating capacity and have the minimum requirement for heat capacity in the living area. In most homes, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters will be required. In certain situations, like small apartment buildings the smaller fixed electric heater could be enough.

If the main living room already has a permanent heating source like a heat pump, then it may require an update to be able to meet the standards. Certain types of heaters cannot be used to comply with the quality since they’re either expensive, inefficient and/or unhealthy to run.

Insulation Aro Valley

The insulation of the ceiling and underfloor has been compulsory to all rental homes since July 1, 2019. All landlords and property managers have to make sure that the insulation is up to this new standard. In some cases, current ceiling insulation, or the insulation of the subfloor space might require to be topped up or replaced.
