Did you know that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords now have to ensure their Aro Valley rental properties meet the minimum Healthy Homes Standards within 90 days of a new or renewed tenancy, and all private rental properties are required to be fully certified by 1 July 2024.

Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied contract is signed on an Aro Valley rental property, all Healthy Homes compliance work need to be done inside of 90 days.

As of 1st July 2021, when a new or renewed tenancy is signed on an Aro Valley rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards by the end of the anticipated timeframe could result in the possibility of a fine up to $7200. It is also important to note that landlords with multiple rental properties may face additional fines for non-compliance. The most severe penalties are handed down for the most serious violations. Those who have at least six rental properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

When Do I need to be in compliance with the Healthy Homes Standards?

Aro Valley Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is required in all Aro Valley and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records that prove compliance with all Healthy Homes Standards that apply or will apply throughout the tenancy period of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers must ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarder households (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must adhere to the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All houses rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of when the tenancy began.

Heating Aro Valley

Aro Valley rental properties should have a permanent source of heating which can warm the largest or main living area to at minimum 18degC, even on the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The heating source needs to be fixed (i.e., not portable) with at minimum 1.5 horsepower in capacity, and it must have the minimum heating capacity needed for the main living space. Unflued combustion and open fire heaters, such as small portable LPG bottle heaters aren’t considered to be suitable heating options under those following the Healthy Homes Standard.
